Bars face new test for suits involving drunken drivers

That would be something you should take up w/ your dinner companions. :)

In places that didn't take care of the DDs, our group would. Since several people were not participating in alcohol consumption, so that the rest of us safely culd, we just all assumed the responsibility of paying the tabs of the DDs. It sure is a lot cheaper paying for a couple extra burgers or whatever than it is to deal with the costs of a DUI.

It is unfortunate people were killed however, but what ever happened to personal responsibility? Is it all about getting money to make things better? I do not condone drunk driving. But placing blame on several establishments over a period of many hours goes way to far.

I look forward to the day when anyone filing such a lawsuit gets hit with fines for wasting the court's time.

Only one person had their hands on the steering wheel. The search for liability ends there.

Ive found that I have more fun in the bar now that I don't drink. I'm not going to get drunk anymore, I'm going to have a good time.

I would be a definite threat to the drunken honeys if I were single, but Sarah (my wife) doesn't mind if I flirt.

I hope she learned a tough lesson at Christmas. She lost a bran new car, will likely lose her job and her apartment, and will lose a ton of money in the courts.

She's lucky she didn't kill someone. We offer a choice when we've been confronted with someone who wants to drive impaired: it's us, a taxi, or the cops. So far we've never had to call the cops.

Yup, I think that's all around the best way to go. After all, your DD may save your life or the life of someone else. It's a lot cheaper (and a great way to say thanks) to pay for the DD's meal. I know that I always have, and have had the favor returned when I was the DD. Everyone leaves happy, and no one ends up in the clink (or worse) for a DUI.

BS. The guy, or girl, drinking is the one responsible not the person selling the booze. What if I bought rat poison and then killed several people with it? Do you think the store that sold it to me should be sued? This is the same type of thinking. Lawyers start this kind of crap so they can make money. The bars have deep pockets ( so they think) so lets get them! This is the same thing that motivated the law suits against tobacco, firearms, and any other "dangerous" item that you can think of. MONEY, and the liberal penchant fot not making people responsible for their own actions. It is always somone else's fault.

LOL!!!! My husband is also an incurable flirt!

Some of our friends still joke about my being the DD while I was pregnant - all I wanted to do was eat!!!! I wasn't drinking alcohol, but I sure as heck wasn't a cheap date.

That's right.

As much fun as I had in the past working behind the bar or waiting tables, in this litigious society we now have, I don't think I would want that kind of a job ever again.

Judge Chad Schmucker ruled against the plaintiffs, saying they were "required to show by positive, unequivocal, strong and credible evidence" that Breton was visibly intoxicated when he was served at the Beach Bar.

I watched a local bar owner chase a very drunk drunk out of her bar. The owner followerd her to the parking lot ... to make sure the drunk did hit her car. I went to the parking lot to try and stop the drunk but she was out of the parking lot and running a red light before I could get there.

When I told the bar owner she was wrong she got mad at me and told me I could not come back in her pub. I told her to call the police, I'd love to talk to them, and went back in.

I don't agree with all this lawsuit stuff, bringing every bar owner and their brother into court. But this incident was definitely a case of an bar owner that was responsible for any accident that happened.

Every car should have a mandatory breathalizer to start up.

And every post should have a "Stop me before I say something incredibly stupid"filter that prevents stupid things like that from being posted.

I'm with you in that I have no use for the lawsuits as a rule - but in some cases, such as the one you describe, there is a liability on the part of the establishment.

Unfortunately it only takes 1 or 2 irresponsible owners/servers to blow it for the majority of responsible ones.

I think maybe you need re-read my post. I certainly think the drinker is at fault. What I was referring to was establishments that choose to serve alcohol to people who are CLEARLY inebriated and in no condition to drive. Having worked in a bar, it's pretty obvious who those people are. It's much better to take away the keys and call 'em a cab, than to continue serving the dipstick who doesn't know when to say when. To me, serving a drunk and letting them drive away IS negligence.

That may be the kind of thinking that starts lawsuits, but so be it. For one thing, if you buy RAT poison, and kill PEOPLE with it, then you are using the product in a way it was not intended to be used. Alcohol is intended to be consumed, it's not against the law to drink... but everyone knows it's against the law to drink and drive. It's not against the law to buy rat poison to kill rats...but it's against the law to use it to kill people.

To my mind, if you knowingly serve a drunk alcohol, and he goes on to kill someone by driving drunk, that's accessory to a felony. Reckless disregard for human life for another...which I believe is manslaughter, same as the person who got behind the wheel drunk.

Cigarettes kill, everyone knows that, and that is why there are separate sections in restaurants, and smoking is banned in a lot of public places, so you can't be harmed by other people's bad choices.

LOL. I wouldn't want that kind of job again, either. Of course, being a cocktail waitress has it's own pitfalls. I needed a bouncer for more than just escorting out drunks, unfortunately.

I'm sorry to say, but equating smoking with drunk driving is irresponsible.

I am as anti-lawsuit as the next person is, however, serving alcohol to an obviously intoxicated person should have consequences.

Having had to act as one on more than one occassion, I must say they are an absolute necessity in nearly any type of establishment serving alcohol.

Oh, don't get me wrong. I was simply trying to point out the same thing to the person who had posted to me that by holding tavern owners responsible for drunk driving, we were on a slippery slope for more litigation. They had brought up the lawsuits against tobacco companies. I was trying to point out the difference. I guess I didn't do a good enough job. Sorry. :)

I know that the bouncers where I worked saved me from many an unpleasant situation. Things that, if I were working anywhere else, would probably have gotten those folks charged with assualt. More than once, bouncers walked me to my car after a shift, and boy was I grateful. Some folks didn't get that cocktail waitress doesn't equal prostitute or stripper, and to keep their hands to themselves.

If drinking and driving are illegal, why are there parking lots at bars?

Everyone of us that drinks could have been caught and convicted of DUI. .08 = two beers an hour.

I think we should have DUI checkpoints at the gates to every Pro Sports stadium in the country.

Its all a joke.

My apologies - now that I reread the entire exchange, I see what you were saying.

I sometimes have a hair-trigger response when someone appears to be equating smoking with drunk driving.
