(Talon News) -- Homosexual advocates in California are hailing a new law that went into effect on January 1 that established "gay marriage" in the state. Assembly Bill 205 grants "all rights, protections, and benefits" of married couples to registered domestic partners.
The new law was authored by lesbian Assembly member Jackie Goldberg (D-Los Angeles) and passed in 2003. It was supported by 66 out of 73 Democratic legislators, opposed by every Republican legislator, and signed by former Gov. Gray Davis shortly before he was recalled. A Sacramento Superior Court judge, Loren McMaster, ruled that the law should take effect despite the expressed will of 61.4 percent California voters who approved Proposition 22 in 2000 that established marriage as "the union of one man and one woman."
But the Third District Court of Appeals has ordered McMaster to reverse his ruling in favor of AB 205 that created "homosexual marriage by another name" in violation of the people's vote on Proposition 22. The appeals court may be signaling that it would strike down AB 205.
On December 21, Presiding Justice Arthur Scotland of the state appeals court in Sacramento signed an order, an alternative writ of mandate, stating, "the relief requested" by marriage-protection organizations "should be granted." By issuing a rare alterative writ, the appeals court ordered McMaster to reverse his ruling upholding the anti-voter bills or try to convince them otherwise by January 10.
"It appears to this court that petitioners have no other plain, speedy, or adequate remedy at law, and that the relief requested should be granted," Scotland wrote in his order. "Therefore, the Sacramento Superior Court, Respondent, is directed to forthwith grant the relief requested in this petition and indicate to this court that it has done so."
Randy Thomasson, executive director of Campaign for California Families, a family issues leadership organization and a plaintiff in the case to protect marriage, is hopeful that the homosexual-marriage law could be struck down as soon as February, unless Judge McMaster obeys the court and reverses his ruling by January 10. He pointed to the effect the law would have across the country if allowed to stand.
He said that AB 205 awards virtually every state right of marriage to homosexual couples, literally creating "homosexual marriage by another name."
Thomasson added, "Whether you call it 'domestic partnerships' or 'civil unions,' homosexual 'marriage' by another name is still homosexual 'marriage,' and the people of California voted against that."
He also said that the rule of law appears to support his position, noting, "There's a big difference between liberal judges like McMaster and the law-and-order justices on the state appeals court."
Even though AB 205 went into effect on January 1, Thomasson remains confident, saying, "We are very hopeful that the Democrat politicians' deceptive homosexual-marriage scheme will be struck down by the appeals court just like San Francisco's 'gay marriages' were reversed after 30 days of insanity."
He continued, "When the people of California voted to protect everything about marriage for man and a woman, no politician, no attorney, and no judge has the legal right to reverse the people's vote, especially when they've voted to protect the beautiful and natural institution of marriage for a man and a woman."
Homosexual advocates claim that AB 205 is not in conflict with Proposition 22 and will guarantee civil rights to gay, lesbian, and transgendered Californians.

Judicial activism alert. When was the last impeachment in California? Looks like the time has arrived.

OK - no one else that I noticed said it and I don't know whether they're slipping or what - but where's the observation that this is just marriage by "the back door"?

Yep. Sounds like a de facto violation of Proposition 22, but then again, the government obviously knows best, why in heck should they listen to the little people?
