Minnesota CCW: Legislature is in session - Bills of concern

The legislature is in session so your rights are at risk. Within days of the session opening, legislators are looking for ways to whittle away at your rights below are two bills of concern we want you to know about.

Bill Name: SF0213

Authorizing probation officers to access information relating to persons permitted to carry pistols under the citizens personal protection act

Authored by Sen. Moua

The law Sen. Moua wants to change has been declared unconstitutional and no longer exists. This does not mean that Sen. Moua and other Metrocrats will want to find a way to open up handgun and carry laws. So far she has not yet found a Metrocrat in the house to be an author. This bill opens up MN chapter 624 dealing with firearms ownership and possession so we are naturally concerned.

GOCRA/CCRN will be watching this bill.

Bill Name: HF0215

Natural Resources Department volunteer instructor background checks provided, and safety training provisions modified.

This bill requires background checks for safety instructors providing training for licenses.

The bill authorizes the DNR commissioner to fingerprint any volunteer safety instructors including those providing instruction in firearms training. GOCRA/CCRN is always concerned when the fingerprinting of law-biding volunteers and gun owners is required. WE will also be watching this bill.

Bill text:

The commissioner may conduct background checks for volunteer instructor applicants for department safety training and education programs, including the programs established under sections 84.791 (youth off-highway motorcycle safety education and training), 84.86 and 84.862 (youth and adult snowmobile safety training), 84.925 (youth all-terrain vehicle safety education and training), 97B.015 (youth firearms safety training), and 97B.025 (hunter and trapper education and training).

The commissioner shall perform the background check by retrieving criminal history data maintained in the criminal justice information system (CJIS) and other data sources. If the volunteer instructor has resided in Minnesota for less than ten years, the commissioner may conduct a search of the national criminal records repository or the criminal justice data communications network records in the state or states where the applicant has resided for the preceding ten years.

The commissioner may exchange fingerprints with the Federal Bureau of Investigation for the purposes of the criminal history check.

In other words, Sen. Moua, wants those who lawfully exercise their 2nd Amendment rights to be denied of their 4th Amendment rights.
