SAN FRANCISCO (Reuters) - A California city's regulation requiring some distance between exotic dancers and their audience during a performance is constitutional, the U.S. 9th Circuit Court of Appeals ruled on Wednesday.
The San Francisco-based court conceded nude and scantily dressed dancers may be impaired from exercising their rights to freedom of speech by the rule requiring at least two feet (60 cm) between them and their audience, but held it did not entirely ban the performers from conveying an "erotic message."
The court held the city of La Habra, near Los Angeles, California, crafted its regulation narrowly to deter negative "secondary effects" from adult cabaret venues, such as the exchange of drugs and money for prostitution.
The owner of a La Habra club and several of its dancers had challenged the city regulation and sought to enable dancers to get even closer to the patrons.

What next? The ninth circuit didn't buy the argument that keeping exotic dancers 2 feet away from their customers inhibits freedom of speech in conveying their erotic messages?
Next thing you know some municipality will up the ante to 3 feet, and then where will our freedom of speech be? I see a slippery slope here.

I can't believe I agree with the court's decision. Although the city ordinance is arbitrary and stupid, they have the power to do so. If the city folk wanna change it they can.

So if a) the court's saying this is freedom of speech, and b) the it's saying it can be regulated based on content, then what's that imply for real freedom of speech? I feel a chilling effect coming on.
Those poor girls are going to have a difficult time making a living now.....................

The club I go to occasionally has girls that smell fantastic. The last time I was there I asked one of the girls what the scent of her perfume/body spray was. She told me it was called "Cookie Dough" Now I know why she smelled so good. :-)
My wife loved a stripper's "cotton candy" perfume so much, she spent an afternoon trying to find it.
