Failure to comply does not have to be 'intentional' in order to get a revote. Only need to establish that failures to comply and there are at least 129 questionable ballots.

King County (Dean Logan) said that this years discrepency was on the order of past discrpencies - typical lawyer-speak. What he failed to mention was that it really wasn't and that in 2000 it was 17. It should be zero.

if they thought this was reason to dismiss, why didn't they say so until now

The judge presiding over the case may not have entertained any motions until today.

I think what is happening right now is each individual county is trying to get out of the case, get the case dismissed.

Today is the first day of any motions to dismiss. So far the Dems are 0-2. Can't wait to see how the media are going to spin this into a Republican defeat.

The guy for Ferry County is good. Ferry County was to be considered an indispensable party. That's good.

I like that logic.....they cant prove we were intentional in failing to follow the rules.

Lots of litigation in WA now....that Neuheisel trial is another comedy of errors.

  Just a sec here. Was that 3700 total for the whole state, or just for King County? I've only followed this story lightly - and now I'm getting confused.

  Anyone know anything about this judge? Given that the Democrats were arguing it should be tried in a different county - why did Rossi pick this particular county? Why not King County, where most of the problems occurred?

  This appears to be a big scandal - I'm trying to get some fairly basic information. Thanks for any help,
