Colo. Prof Challenges Speech Cancellation

Boulder -- A University of Colorado professor under fire for comparing the victims of the Sept. 11 attacks to Nazis went to federal court Tuesday challenging a decision to cancel his speech.

On Monday, Colorado administrators announced they had canceled the speech by ethnic studies professor Ward Churchill for Tuesday because of security concerns. Earlier this month, Hamilton College in upstate New York canceled another speech by him because of death threats against the professor and its administrators.

The dispute over the professor is one of several controversies that have roiled the Boulder campus.

In his filing Tuesday in Denver federal court, Churchill asked a judge to prohibit CU from canceling the speech, calling the last-minute decision to do so "nothing but an effort to stifle me and not let me speak on a matter of public and personal concern."

"I was intending to explain my meaning to the audience, in particular the CU student body," Churchill said in an affidavit. His lawsuit alleges the university violated his rights and those of the people who hoped to hear him speak.

A hearing on the matter was scheduled for Tuesday afternoon, three hours before Churchill was to speak. A university spokeswoman did not immediately return calls, but campus police spokesman Lt. Tim McGraw said authorities are prepared to provide security if the judge clears the way for the speech.

The university in the past year has weathered a sex scandal in the football program and the alcohol poisoning death of a fraternity pledge at a campus trying to shed its party-school image. But nothing has incited more passion and outrage than Churchill.

Two students were arrested at a Board of Regents meeting last week and swastikas were spray-painted on Churchill's pickup truck.

Everyone should be thankful that this Churchhill fella is such a sanctimonious bas..rd!

He brings to light the plight of students in universities having to sit thru his sort of pablum ad nauseum....

And, he helps to bring more (hopefully) to the cause of responsibility and morality.

And, like Howard Dean, he is anathema to America, I do not want tax $$ going in his pocket.

Fire him, now!

It is a typical liberal who thinks conservative values must be cesnored, but their "free speech" should never get them into trouble.

Congress passed the Smith Act in 1940 -- making it unlawful to advocate the violent overthrow of the U.S. government.

The Smith Act of 1940 5 made it a criminal offense for anyone to knowingly or willfully advocate, abet, advise, or teach the duty, necessity, desirability, or propriety of overthrowing the Government of the United States or of any State by force or violence, or for anyone to organize any association which teaches, advises, or encourages such an overthrow, or for anyone to become a member of or to affiliate with any such association.

Ch. 439, 54 Stat. 670, 18 U.S.C. Sec. 2385.

Sec. 2385. Advocating overthrow of Government

-STATUTE-
Whoever knowingly or willfully advocates, abets, advises, or
teaches the duty, necessity, desirability, or propriety of
overthrowing or destroying the government of the United States or
the government of any State, Territory, District or Possession
thereof, or the government of any political subdivision therein, by
force or violence, or by the assassination of any officer of any
such government; or
Whoever, with intent to cause the overthrow or destruction of any
such government, prints, publishes, edits, issues, circulates,
sells, distributes, or publicly displays any written or printed
matter advocating, advising, or teaching the duty, necessity,
desirability, or propriety of overthrowing or destroying any
government in the United States by force or violence, or attempts
to do so; or
Whoever organizes or helps or attempts to organize any society,
group, or assembly of persons who teach, advocate, or encourage the
overthrow or destruction of any such government by force or
violence; or becomes or is a member of, or affiliates with, any
such society, group, or assembly of persons, knowing the purposes
thereof -
Shall be fined under this title or imprisoned not more than

short version this fraud has been published as saying he
wants the US out of Existance. He has also been published as saying there ought be more 9-11 type attacks against the US. I do NOT believe the taxpayers and students who go
to these Universities ought be paying Anyone to publically call fo rth eoverthrow of our system of government.Sort of
like him demanded he be paid to be such an Arse.If I were in
charge of that college I would cut off any University support and Take legal action against him for money he has
recieved while calling for the overthrow of our government.
