If you have to ask, there is probably no point in answering, BUT OF COURSE IT MATTERS!!!!

I don't think any of the "three strikes" laws require you kill someone.

I have to agree. I would be much harsher on DUIs than most people.

For those who complain that worse crimes, are not punished so harshly. You're right, but should we not make those punishments more harsh, than lighten this punishment?

My reply: In California, shoplifting is a felony if you have any prior conviction for any theft-related crime (another shoplifting, burglary, auto theft, etc). However, a shoplifting conviction is NOT a "strike" under our three-strikes law - even a felony shoplifting offense. A "strike" is only "a serious or violent felony".

No, maybe the fourth will be the lucky one!!! I mean give me a break, I don't agree that life should be the punishment but frankly nothing short of ten years would make me feel safer.

I think driving a car drunk is like shooting into a crowd of people. Maybe this is the only way to deal with the problem.

I agree!

The DUI guy should share a cell with the HIV guy. If that was the punishment their would be less DUI's if not zero.

A habitual offender DUI is a lot more likely to repeat his offense than a first offense murderer. And either one can make you just as dead.

According to http://www.hivcriminallaw.org/prosecutions/index.cfm there have been 164 convictions for infecting someone with HIV. It doesn't say how many were gay, though.
