A US marine filmed apparently shooting dead an injured Iraqi in a Falluja mosque last year may not be formally charged, according to media reports.
Military investigators have concluded there is not enough evidence to prosecute over the shooting, US television network CBS news says.
However, the US military said the investigation had not been completed.
"The facts of this case are being thoroughly pursued to make an informed decision," a Marine statement said.

According to an earlier report, Gen. Hagee says this guy is still being investigated. The Beeb is just trying to generate anti-American outrage that a soldier killed a murdering terrorist POS before he could kill more Americans.

I'm sorry to hear that, if this is they guy I've been wondering about.
We put these young kids in terrible situations, he shot someone who could have had explosives. Don't know, wasn't there, all I do know is I think he had every right to protect himself and his fellow armed forces around him. Perhaps they should just talk to the armed forces that were there with him, do they blame him? If not, then just set him free and get over it.
Pukes that have never walked though the site of a recent firefight --- where any of the crumpled "corpses" on the ground might still be capable of killing you, should be required to do so before being permitted to critize the actions of a young Marine doing exactly that.....
One does not approach and take neck pulses, or ignore the actual or imagined movement of a "corpse".....
Carelessness, hesitation or a mistake -- can lead to your own and your brother's death...

You and I both know every thing you said is correct. The problem is that very few in the MSM ever laced up a pair of combat boots in their lives and hate the military especially the Marine Corps and everything it represents.

Its ok, I started to look into who 'snipes' was, as I had forgotten the name.
It might be unfair to be attacking the JAG folks.
Probably the first and last lawyer I ever trusted and respected was with the JAG...
Remember - it was the JAG lawyers that decided there should be no charges brought against this Marine..
Once the Leftist bastards started screaming for his hide -- they HAD to investigate to give his "clearing" some credibility...

More precisely, the Marine's commander would have made the decision but with plenty of input from JAGs.
Civilians are often surprised to learn that military prosecutors, unlike district attorneys, do not have independent authority to choose which cases to prosecute. In the military, that decision is solely a prerogative of command.

As a military (1978-1995) and DoD civil service (1995-present) court reporter, I can say that I would much rather have a case be investigated and examined by the chain of command and the JAG Corps than I would through civilian channels. Military JAGs are, for the most part, professionally sharp and driven individuals; the military judges are knowledgeable and fair; and I would prefer to be tried by the military justice system and a panel of my true peers than the civilian practice of a jury of deadbeats and Perry Mason-wannabees.

Thanks to you and everyone else who see this situation rationally and fairly. No one wants war or the tragedies that it must bring.
It's refreshing and uplifting to witness young and older Americans bravely face our obligations.
Here's the problem I have with the whole thing. John F'n Kerry gave himself a Silver Star for beaching his boat (against squadron SOP), chasing down and killing a half-naked, wounded (by the boat's .50 cal guns) Vietnamese teenager and no one sees anything wrong with it.
This guy took an action to protect his and his comrades' lives and someone thinks he should be investigated for a crime.
This is all BS.
