Parents ask judge to let Schiavo divorce husband/Jacksonville

A Jacksonville victim rights group and a state legislator urged Gov. Jeb Bush on Monday to launch a criminal probe into events that put Terri Schiavo in the hospital with severe brain damage 15 years ago.

Justice Coalition founder Ted Hires also asked the state Department of Children & Families to take Schiavo into protective custody and Florida's attorney general to initiate a civil rights investigation into her treatment and efforts by her husband to have the feeding tube that keeps her alive removed. . . .

Her parents said they filed the divorce proceedings because of Michael Schiavo's "total disregard for Terri as his wife." ....

This is a good article. I tried to excerpt judiciously, but had to keep cutting, so please go to the Times Union site to read the rest.

The Schindlers were in Jacksonville for a press conference with the Justice Coalition, a local court watchers group. Speakers included Ted Hires of the JC, FL Senator Stephen Wise, FL Rep. Don Davis, and Bishop Victor Galeone of the Catholic Diocese of St. Augustine .

In addition to the above, other points made: Terri is indeed responsive (meaning that her guardian is willfully misrepresenting her), that she is not being given ordinary care due to any other person in her situation, (which is the basis for the DCF), that her husband, Michael Schiavo has left Terri and taken up with a woman he describes as his fiancee, with whom he has two children, and he should be removed as an unfit guardian.

Terri's father, Bob, told about his visit Friday 2/25*, to her in the company of the attorney David Gibbs. Terri could not take her eyes off Gibbs, totally ignoring her father, which of course lead him to tease her. He talked about her sour face when he goes to kiss her. Her mother told about her being denied a swallowing test, even though they are mandated -- part of the ordinary care that has been denied Terri.

Her family was presented with a purple stuffed bunny which they promised to give to Terri.

My personal abbreviated account -- lol, newsperson I am not!

It was a good gathering and I met some good people there, including talking with the Schindlers, whom I had met in St. Petersburg in October '03. I did not get to talk with Sen. Wise to thank him for being there -- and THANK YOU to all who were there for Terri.

Weather was ok -- it was real windy on the courthouse steps, but at least no rain! I did take photos, which may end up posted here down thread.

I'm probably being politically incorrect, but I think her husband probably did know her wishes and her parents should not interfere. The doctors say she is brain dead and so there really isn't a point in keeping her alive against her wishes.

What's more, you don't see her priest or bishop coming out against her husband.

It looks to me more like the parents can't accept their daughter's predicament and are inflicting pain and suffering on everyone in their effort to save what's left of their daughter.

Let's first address the issue of if her husband is a fit guardian and a creditable spokesperson for her.

The fact that Terri is not even allowed to take the swallowing test is an obvious concern, as is the fact that she is not given the ordinary care given to other patients in her condition.

I want to know that Terri is allowed to enjoy that bunny, and that it will not be callously discarded, as are flowers, Christmas cards, birthday & get well cards, and other things that have been sent to her.

Are you a sheeple who thinks AP or NBC or whomever just report the unbiased facts?

Are you unable to use logic to come to the conclusion that the "husband" wants her dead because he has moved on?

Does a husband shack up with a woman, father and raise two kids with this shack-up honey, and make plans to marry her once his wife is dead strike you as a loving husband/guardian who has the best interest of his mentally handicapped wife in mind?

Have you ever seen the very recent video of Terri laughing and interacting with people and a ballon? Brain-dead people do not do that.

Perhaps you are not as informed on this situation as you think you are.

She is brain damaged, likely by the husband who now wants her to shrivel and die so he can get a million bucks in insurance money. THIS WOMAN IS NOT BRAIN DEAD. CHOOSE LIFE!

It is my understanding that a person who is "brain-dead" does not move and respond as Terri does. I doubt doctors said she was brain dead.

I cringed at the suggestion of euthanizing people in her condition and the elderly (to contain costs).

This person she unfortunately married needs to get out and stay out of the picture as he does NOT have her best interest at heart all he wants is money.

It is my understanding that a person who is "brain-dead" does not move and respond as Terri does. I doubt doctors said she was brain dead. That is incorrect. Patients in persistent vegetative states move randomly and it is very unsettling to see. It appears to be normal movement, but it is random. Eight doctors have said that she is brain dead. How many do you need?

Terri, hearing Mr. Gibb's deep voice immediately turned to her left to look at him. Terri's Dad stated that once she eyed Mr. Gibbs that was the end of his visit with her because she was no longer interested in anything he had to say to her..."she was goo-goo eyes over Attorney Gibbs."

Mr. Schindler then exclaimed, "Terri, Terri, look at me. I've come here to see you as well and now you cannot take your eyes off of Attorney Gibbs, what am I chopped liver?" Terri responded with laughter to her father's comment but her eyes remained focused on Mr. Gibbs.

Bob said,"Well, Cheryl that's the last time I will be taking Mr. Gibbs along with me since my daughter did not hear anything I had to say once he had her attention.

Her priest was actually denied permission to give her the Eucharist the last time they tried to kill her. He was threatened with arrest.

He is in fact supporting the family.

This has nothing to do with being politically correct.

Please go to her web site to learn the facts.

Had she been brain dead, she would not be alive today. People who are brain dead usually cannot survive without a ventilator.

She and her husband did not discuss their wishes. At the malpractice trial - he sued for money to take care of her and get her the best care possible.

After he won the money and move on is when he had a change of heart and decided she would be better off dead.

He won't divorce her because of the loss of financial gain in his favor.

She will suffer if her tube is removed. She still feels pain and the same emotions we do.

I should have pinged you to the above post -- perhaps you weren't aware of that and other similar stories (widely available here on FR) that give quite a different account of Terri's condition than what the public has been led to believe.

To persist would be to call Mr. Schindler a liar ... and Atty. Gibbs ... and Cheryl Ford, RN ... and ....

Well, this is a tough one. It certainly raises a bitter irony.

On the one hand: in the fact of, I believe, NO recorded statements that this would be her will, the courts seem ready to starve her to death. This, on the wishes of a husband who formerly argued that he'd need a lot of money for her rehabilitation. The court seems comfortable reading her mind on this issue. The MSM certainly is.

But, on the other hand, I don't know how likely the courts would be to grant this divorce. That is, they mightn't be willing to read her mind, that she'd want to be divorced from a man who committed adultery against her to the extent of fathering two children while still married to her. They might not be willing to read her mind to that extent. And surely the MSM won't.

Sick situation, very difficult.

Here is the definition:

What is a persistent vegetative state? According to the National Institute for Neurological Disorders and Stroke people in PVS "have lost their thinking abilities and awareness of their surroundings, but retain non-cognitive function and normal sleep patterns. Even though those in a persistent vegetative state lose their higher brain functions, other key functions such as breathing and circulation remain relatively intact. Spontaneous movements may occur, and the eyes may open in response to external stimuli. They may even occasionally grimace, cry, or laugh. Although individuals in a persistent vegetative state may appear somewhat normal, they do not speak and they are unable to respond to commands." People suffering from PVS can generally be distinguished from afflicted but cognitively intact patients who suffer from "locked-in syndrome" by the fact that "locked in" patients can track visual stimuli and use eye blinks for communication.

According to most neurological experts, Terri Schiavo is definitely PVS—her eyes do not really track visual stimuli and she cannot communicate using eye blinks.

Hires was joined at the afternoon news conference by Bishop Victor Galeone of the Catholic Diocese of St. Augustine. Galeone left without comment but signed a statement released later Monday by the Florida Catholic Conference and signed by eight bishops. They said too many questions persist about Terri Schiavo's true prognosis and wishes.

As a "defenseless human being" Terri Schiavo is "deserving of our respect, care and concern," the bishops said. "We reiterate our plea that Mrs. Schiavo continues to receive all treatments and care that will benefit her," the bishops said.

HELLO, anyway -- why would what someone else says or does influence my ability to discern right and wrong?

They might not have to. Back in '90 - '91 medical records recorded that Terri was able to vocalize appropriate to stimulus. This ability still remains, so it is not inconceivable that the question "Do you want to divorce Michael?" would be asked, and she answers, "Yeah".

Doggone, I meant to ask Mr. Schindler that yesterday.... he needs to be bringing these things out in press conferences and other interviews. Not that such stories and facts are necessarily reported later!

Thank you for posting this. I have been very disappointed in the bishops, and this is a wonderfully encouraging thing. Bp. Galeone is a particularly strong pro-lifer, and I am not surprised that he was their spokesman.

Speaking of political causes, someone has noted a link between "her" bishop and a law firm that donated to Judge Greer's campaign; I'll see if I can find the link to that info.

And, as you mention and has been posted here to FR, her priest was not allowed to give her last rites. I was there at the vigil outside of hospice Oct '03 and heard this -- and I saw her parents in their distress over that.

This is to Bishop Lynch's shame.

Note: Attorney George Felos and Judge Greer are/have been Hospice board members

 

May 1997- Attorney Deborah Bushnell writes the Judge on the case, Judge Shames, and states in the letter that the Schindler's need to be notified that Michael Schiavo intends to have Terri moved to a Hospice and have her feeding tube removed.

 

(February 13, 1997 until at least April 26, 2001, George J. Felos was listed as a member or recent member of the Board of Directors for "The Hospice of The Florida Suncoast" on the non-profit's annual reports.)

 

When was Terri Moved?

What happened to Deborah Bushnell and Judge Shames?

 

August 1997 - New attorney for Michael Schiavo, George Felos, notifies the Schindlers that Michael was going to have the feeding tube removed.

 

May 1998 - George Felos files a petition to have Terri's feeding tube removed.

 

April 1999 - House Bill 2131 was introduced in the legislature by the Florida Elder Affairs & Long-Term Care Committee to amend  Section 765 (Civil Rights) of the Florida Statutes. Amendments to Section 765.101 = legal definition of life prolonging procedures to add: "INCLUDING ARTIFICIALLY PROVIDED SUSTENENCE AND HYDRATION, WHICH SUSTAINS, RESTORES, OR SUPPLANTS A SPONTANEOUS VITAL FUNCTION". It becomes law on October 1, 1999.

 

January 24, 2000 - Judge Greer presides over the case determining whether Michael Schiavo can have Terri starved/dehydrated to death.

 

February 11, 2000 - Judge Greer orders Terri Schiavo to rot away.

 

Notice, Felos becomes the lawyer and files the petition. Then the law in Tallahassee gets changed. Then the Schiavo case gets heard. In that order.

amdg, we have here a classic stimulus / response. As another poster said, this shows that not only is Terri not in pvs, but she has a good eye, lol! I really appreciate Cheryl sharing her accounts, but I especially enjoyed this one -- please tell her, thanks.

The Schindlers really, really need to bring out the details of their visits with Terri in EVERY public appearance or interview. Most folks just do not know Terri's real condition and situation. And they need to point out that Terri has not had the ordinary care given to other patients in her condition, including the mandated swallow test.

I want to see a wheelchair delivered to hospice for Terri to get out in like she used to, since Michael Schiavo has not seen fit to have hers fixed.

Terri's priest, Monsignor Thaddeus Malanowski, did indeed speak out against Michael Schiavo and his negligance of Terri. Michael Schiavo has been co-habitating with Jodi Centonze for over 10 years and has fathered two children with her. He has clearly moved on with his life. Now he needs to let Terri be with her family so they can take proper care of her. In addition, about 6 doctors gave court depositions stating that Terri is not in a persistant vegetative state. How can some who is PVS smile and laugh at her family, and interact with her nurses?

lol, I stand by my "mom fussing as only a mom can" assessment of that clip! I really prefer the version on http://www.Terrisfight.org, in which I could hear Terri's mom ask, "How's your cold?" as she was arranging and fluffing Terri's pillow.

I'm probably being politically incorrect, but I think her husband probably did know her wishes and her parents should not interfere. The doctors say she is brain dead and so there really isn't a point in keeping her alive against her wishes.

These two sentences demonstrate how little you know about this case. No doctor who has treated her has ever described her as brain dead, because she isn't. She recognizes people, she responds to others' speech, even though she cannot speak.

Learn a bit more about it - and since you are clearly not a parent, think about whether her parents might have some insight into her wishes and think about whether they have her best wishes at heart or whether her husband does - remember, he gets more than a million in cash as soon as she is dead.

And all this is beside the fact that her husband is proposing to have her starved and dehydrated to death. If you did that to a cat in FL you would be in prison. But it's apparently OK to treat an injured human being like that, as far as you are concerned.

"April 1999 -- House Bill 2131 was introduced in the legislature by the Florida Elder Affairs & Long-Term Care Committee to amend  Section 765 (Civil Rights) of the Florida Statutes. Amendments to Section 765.101 = legal definition of life prolonging procedures to add:
"INCLUDING ARTIFICIALLY PROVIDED SUSTENENCE AND HYDRATION, WHICH SUSTAINS, RESTORES, OR SUPPLANTS A SPONTANEOUS VITAL FUNCTION".
It becomes law on October 1, 1999."


We must note that until this date, it was not considered an extraordinary measure to provide water and food in any way to a patient. Meaning, obviously, that Terri could not have anticipated that she would be denied food and water.

I'd looked into this legislation a year or so ago, trying to understand the (to me unfathomable) thought process that led the FL legislature to this change. I found a flow of thought in medical journal articles in the '80s and '90s that rationalized such treatment of patients. This is clearly an agenda.

Oh, tut, speaking of Jim King's legacy:

"State Sen. Jim King, R-Jacksonville, called the request [to Gov. Bush for a special prosecutor] an obvious tactic.

"The plan seems to be to elongate this as much as they can, and there's going to be all kinds of that in the coming weeks," King said.'

Well, what's it to him if they do?

What is this to Sen. King that he has to take such cheap shots at a family?

I've also been pondering this question of "who lobbied to change the law in FL". In digging around, here are some interesting documents that I have found in relation to this question.

"The 1998 Florida Legislature created (CS/CS/HB 3387),The Panel For The Study of End-Of-Life care. This 22 member panel was directed to study issues related to the care provided to persons as they near the end of their lives." This panel was the starting point for the legislation that was eventually passed and changed the law in 1999 in Florida.

Here is an interim report from this Panel For The Study of End Of Life Care(http://www.fha.org/acrobat/interimquality.pdf)

This interim report details the individuals who were on the panel, which included none other than Mary Labyak, Executive Director And CEO, Hospice of The Florida Suncoast.

In reading this report and looking through the 22 member panel, I do not see anyone representing the interests of the disabled and incapacitated.

The panel was administered by the Pepper Institute on Aging and Public Policy from Florida State University. The Pepper Institute is listed on the "Center For Practical Bioethics" Website as being on their "community state partnerships to improve end-of-life care." Thank you for posting that. It was so good to be there, so good to see the Schindlers. They are truly awesome people. I do not know how they handle this struggle day to day with all its ups and downs and dead ends!

King isn't interested in anything that doesn't benefit him directly in one way or another, IMO.

He had a hissy that UF did not open the chiropractic college. . . what's it to him? Did he lose some money over that? Course we'll never know the answer to that one but King will have strong resistance if he runs for reelection.

The videos don't show any cognition by Terri at all.

In contrast, the MRI's apparently show that the upper part of her brain is all but gone. Physically gone. I don't mean non-functioning. I mean the cells aren't there.

The video clip is just that. The only way to get to know Terri better is to just go visit her. If a public official, who is being told by a "knowing" public that another person is being heinously victimized, and law enforcement will not even go up against the guardian to investigate the complaints, then something is wrong here. This is when a legislator, senator, governor or judge is bound and has authority to find out for themselves what is happening to one of their citizens. Sworn oath to defend ALL laws. And the laws say that these reports of crimes against this or any person that are not being investigated and could be causing harm to the person every day that no one is "permitted in the house" to find out if the husband is abusing by denying -- who the heck is this Michael Schiavo anyway.

Since when. These heinous people are playing the "privacy card" just one too many times.

So that Dollar family, should have told the police that what goes on in this family is none of yours or the worlds business.

But it doe not apply when it comes to Terri Schiavo. TILT !!!!

Disabled people such as Terri Schiavo and others are in some ways better than the able-bodied people because they are faced with far greater daily challenges than most. They possess incredible adaptive abilities that are driven by a force that we rarely tap daily, that of instinctual survival powers. The life forces associated with that aspect of our being are redlining off the scale and they have ready access. We however, are disabled from touching that source by our own abilities. If you treat the person in the disabled person, with the same respect and human expectation as a being then they have a chance to relate on a level field. If your expectations of another out in your daily encounters with others do not balance with the other, on any given interaction, then the result will be as it is, non conversationally compatible. So who is really lesser than who. The answer is No One. Just needs more adjustment to equalize and permit a two way understanding even if one can speak words and the cannot or has difficulty.

To intentionally deprive a person from those things they are to be provided to help bridge the gap and create an environment and atmosphere for improvement is to criminally abuse, neglect and exploit their vulnerability. To gain for yourself from all that is despicable and the law says that because you have no respect for life, especially when you are one who is specifically responsible for that life, that person, then you need to be away from all persons as you are a threat to each and every one of us.

Michael Schiavo and the bunch attached to him are just such people the criminal code defines, and need to be prosecuted.

They have no time, care or patience for those who they are charged with this highest responsibility. They are an immediate threat to any disabled person by their resolve to deem them as inferior, non-human and only worthy of extermination.

This refers to my earlier post #19, and considering the account in posts #14 and #31 -- which I'm sure you have read and carefully considered in your quest for truth here on FR.
