A good commentary overall, except that the following must be one of the stupidest rhetorical questions I've ever seen:

Why on earth does this man deserve or require yet another trial?

No doubt there was a better way to convey whatever the point.

Read a book years back on our jury system after my first time out as a juror. In it, one judge was quoted as saying that a jury was a group of people applying laws they don't understand to facts they can't get straight. That about summed up my experience.

I wonder when the ACLU is going to get around to defending this beast and claim that he can't get a fair trial in front of a judge because he killed a judge.

Need I remind everyone of FR that the writer like the one who wrote this article would have gladly slammed all of Georgia, calling all us Georgians racist if said jury had found Nichols guilty of rape because Nichols is black.

Let him confront the witnesses against him, challenge the evidence and exercise all the other rights that the legislatures have voted on and the Constitution whether of the State of Georgia or the United States have guaranteed.

I just can't take all of these "rights" granted by judicial fiat. Up here in New York, we got to spend $10,000 of taxpayer money on a private investigator so Colin Ferguson (Long Island Railroad shooter) could try and find the "real killer." I missed the right to a PI in the 6th Amendment-- must be one of those fine print contract things.

I think you are missing the point. This is not a question about whether law abiding citizens deserve due process. This is a question as to whether we should give due process to terrorists, hardened criminals and liberals

What passes as the "legal system" in this country is totally broken. Our Founders had a good system going, but it has become totally corrupted over the years.

The "system" is now geared to protecting violent predators and harassing decent Americans via millions of edicts.

Unfortunately, every time a violent predator commits an heinous crime, there are always those that will try to take away the few Rights decent citizens have left.

It's already happened in Britian.

Hate to admit it but we, along with most of the elements of Western Civilization, have reached a sort of 'Maturity' where process has overtaken rationality as the mode of operation. The author does make the point that the mere passage of time does not always assure 'Real' progress.

Unfortunately, he undermines an otherwise reasonable article by suggesting that we can dispense with a trial, presumably because this Perp is indisputably guilty on all counts. A slippery slope indeed.

America, speaking collectively, has indeed 'lost it's mind'. Where we were once under a common moral code, outlined in the Old Testament, we have now 'progressed' to a nation of amorality. Whatever is deemed right and correct by the mass media, and those who blindly follow, is allowed to stand. Anyone who dares to stand up for what once guided America, and indeed all of civilized society, is deemed to be a 'religious fanatic' and a 'fundamentalist' who is not worth listening to. Our options are two: continue on the path to destruction, that is war and eventual take over by people who are more determined than us, or back toward civilization by re- adopting the moral code we once lived by. "Those who fail to learn the lessons of history are condemned to repeat them".
