Title XXIXPUBLIC HEALTH
Chapter 406MEDICAL EXAMINERS; DISPOSITION OF DEAD BODIES

406.11">406.11 Examinations, investigations, and autopsies.--

(1) In any of the following circumstances involving the death of a human being, the medical examiner of the district in which the death occurred or the body was found shall determine the cause of death and shall, for that purpose, make or have performed such examinations, investigations, and autopsies as he or she shall deem necessary or as shall be requested by the state attorney:
(a) When any person dies in the state:
1. Of criminal violence.
2. By accident.
3. By suicide.
4. Suddenly, when in apparent good health.
5. Unattended by a practicing physician or other recognized practitioner.
6. In any prison or penal institution.
7. In police custody.
8. In any suspicious or unusual circumstance.
9. By criminal abortion.
10. By poison.
11. By disease constituting a threat to public health.
12. By disease, injury, or toxic agent resulting from employment.

(b) When a dead body is brought into the state without proper medical certification.

(c) When a body is to be cremated, dissected, or buried at sea.

(2)(a) The district medical examiner shall have the authority in any case coming under subsection (1) to perform, or have performed, whatever autopsies or laboratory examinations he or she deems necessary and in the public interest to determine the identification of or cause or manner of death of the deceased or to obtain evidence necessary for forensic examination.

(b) The Medical Examiners Commission shall adopt rules, pursuant to chapter 120, providing for the notification of the next of kin that an investigation by the medical examiner's office is being conducted. A medical examiner may not retain or furnish any body part of the deceased for research or any other purpose which is not in conjunction with a determination of the identification of or cause or manner of death of the deceased or the presence of disease or which is not otherwise authorized by this chapter, part X of chapter 732, or chapter 873, without notification of and approval by the next of kin.

(3) The Medical Examiners Commission may adopt rules incorporating by reference parameters or guidelines of practice or standards of conduct relating to examinations, investigations, or autopsies performed by medical examiners.

Maybe it's because so many loons on FR have been insisting Judge Greer and Michael Schiavo had conspired to order her instantly cremated without autopsy, and kept right on saying it even after being told it wasn't true.

It was true. Terri's parents were trying to fight it. He wanted her toasted "within an hour of her death."

instantly cremated without autopsy

PS...No one knows why she collapsed to this day. All we have is a story from her husband she had an eating disorder. Her friends disagree. No one has ever checked.
You'd think he'd want to know what happened being a nurse now himself (His education paid for by Terri's support money, BTW, so he could care for her forever - or so he said)

My father died three years ago in Ocala, FL, at home, but in poor health (CPD). We had him cremated, right away. No questions at all by anyone when we had him cremated.

Well, just darn. I wouldn't say that too loudly, someone might be watching.LOL. How did you do that? My relatives had to have an autopsy performed

But, hey, I truly didn't offer this post as my opinion, nor to argue any point, so I don't think you did either. Right?

I went to the Florida Statues, it took me a while to find it going through a lot of windows, but there it was.

I just wanted to get the facts, since this has been mentioned but I never saw the actual law.

If people support Michael (not you, not mentioning names) I have no idea why they read the threads that they disagree with, yet have no valid references, links, or quotes to support their expressions. (Not necessary in your case - and I am not picking on you at all - but you have firsthand, actual experience, so that is different.)

FR used to be a place where we could exchange information - not only raw emotion. I loved to get links to articles, etc. here that I might never have seen. Now, it is mostly a battle ground.

True, I have my opinions, but I mostly try to support what I am saying with the resource where I found it. And I am glad when something I read might not have all the information or truth, and another FReeper points me to another direction. That is how we learn.

However some people on this very thread just make a statement and have never, here or on other threads offered actual viable support for their statements.

That is not what the FR is/was all about. It has changed so much recently. It is hard for us who are looking for truth to read through all their nasty comments. So sad.

Sorry, I guess it just finally got my goat. But as I said, you are not a target. I wanted to just make "my emotional" statement finally. Ugh!

Do you know how Michael became a nurse and why he said he wanted to be a nurse?

He was suing a doctor. He said he needed money to pay for his education to become a nurse. That way, he could care for his wife forever.
He won $2 million dollars for training and Terri's life time support.
After he got the money, 7 years after the accident, he "remembered" she wanted to die.
So much for wanting to "care for Terri."

Michael Schive and his lawyer sure are pulling the murder of the century as far as I am concerned! And it frustrates me to know end that the Bush Administration can't pull a Clinton and Janet Reno and put this woman back on a feeding machine! She has the will to live!!!!!!!! But being denied because of a control freak husband and lawyer as well as a judge who won't open the records! What a waste and tragic murder being held right under our noses!

A New York State special education teacher has filed a detailed eight-page complaint with the U.S. Department of Justice on behalf of Terri Schindler-Schiavo, alleging numerous violations of the Americans with Disabilities.

An immediate stay of execution has been requested until the matter can be investigated..

There's good news. The disabled lobby is looking into this.

After years of refusing an autopsy upon the death of Terri Schindler-Schiavo, suddenly the attorney for Michael Schiavo has announced that Dr. Jon Thogmartin, medical examiner for Pinellas/Pasco Counties, District 6, will conduct an autopsy to attempt to dispel rumors of criminal wrongdoing in the case.

Michael Schiavo, estranged husband and guardian of the severely brain damaged woman who is dying of starvation and dehydration at a Florida hospice, has steadfastly maintained that no autopsy would be performed upon her death and that cremation would immediately follow.

It now appears that his attorney, euthanasia advocate George Felos, may have acquired knowledge that would help cover up the alleged wrongdoing, even in death. In announcing the hurriedly scheduled autopsy, he claims that Michael Schiavo wants proof of the extent of his wife’s brain damage and to put to rest rumors of her physical condition.

Good article. I didn't dare post the whole article, but it is a good one.
With dehydration comes brain shrinkage. It gets dehydrated like all the other organs and makes it appear smaller. I hope more than one doctor is available for the autopsy if Terri is left to die - and the doctors account for that shrinkage when diagnosing the damage!!!
I'm sure Michaels layer knows all about shrinkage, too!!

I think this is going to have to be a wait and see issue.

The fact that MS wouldn't allow any definitive tests (like a functional MRI after removing her probes or a PET scan) to prove she was a PVS, hired Florida's Dr. Death and start having affairs about a year after her demise (let alone the testimonies of the nurses that make Michael a monster) naturally make people suspicious of his motives. We all should be. I couldn't do that to my husband. Never. Ever.

If the autopsy takes place, her supporters will have to seriously rethink Internet info. If he cremates her what will you say?

The real problem seems to be that we don't really know very much about anything regarding the Schiavo case. But the bottom line is that she did not have a written living will;therefore, Terri dies on hearsay and by starvation. It is appalling. Also, it would have been legal for the judges to have shown equity or compassion. Law and order are not devoid of these.

We can see plainly that the judiciary needs lopping severely. Who the hell do these lawyer/judges think they are? Time for change. We the people have to do it, as the Ukrainians, Lebanese, Iraqis, Afghans, Kyrgyzastanians, Georgians and others have done. So many people non-violently refusing the tyrants. So many they can't kill and imprison them all so the tyrants have to leave the country.The winds of freedom start to blow and sweep the earth, as Pres. Bush said.

We Americans have lost much of our freedom. We must get it back and kick out of office those who have changed, desecrated, misinterpreted our Constitution.
