Shiavo's "Legal" Legacy
MSNBC ^ | 3/31/05 | Hubert D. Rabon

Judge critical of Bush, Congress One of the appeals court judges rebuked the White House and lawmakers Wednesday for acting “in a manner demonstrably at odds with our Founding Fathers’ blueprint for the governance of a free people — our Constitution.”

“Any further action by our court or the district court would be improper,” wrote Judge Stanley Birch Jr., appointed by President Bush’s father.

The primary legacy of Terri Shiavo's life and death is the incalculable income the American legal industry stands to gain, guaranteed by the anti-citizen decisions of its American Bar Gang leadership in black robes.

The judiciary's chastising of Congress is a ruse, since so many in Congress are lawyers. It's time for us to make the legal industry stop foolin' us and pitting us against each other for its own lucrative gain.

Lawyer jokes aren't funny anymore. . . .

NPR was gloating over the rebuke this morning. The pro-death quality-of-life Nazis are out in force today.

Liberals and their stooge judges are about to have political war made on them. For far too long we have put up with their nonsense. Order must be restored.

Yep, the real problem here is that congress waited till now to exercise its Article III powers. The Republicans have held congress for ten years and have abdicated their Article III responsibilities during that time. At least they fired the first shot in this battle, but it is too late for Terri and this issue was the wrong one to fire the FIRST shot.

Why? Because the MSM has been able to mislead a majority of Americans, most of whom were not paying attention to this matter prior to congress stepping in, and demagogue this issue. The MSM pushed the following facts to achieve the public opinion results it wants: 1) Terri was on life support (read respirator) or in a coma; 2)Terri left a living will; 3) Terri's family was in agreement that she would not want to live (this is a private matter); and 4) Terri received a full judiciary hearing no less than 14 times.

Given those facts, their are few amongst us who would not say that government should but out. (No wonder the poll results are what they are, they are, as usual, loaded.) BUT, the only reason the congress became involved in the first place is that NONE of the above assumptions were even remotely true.

So, here we are. The MSM has used this issue not so much to push a pro-death agenda as to promote a Judicial Supremacy agenda. For example, "you see, this is why the Judiciary should reign supreme, because it protects you dumb voters (we told ya so) from those Jesus freak evangelical Republicans!!!"

Of course, this has been a coordinated effort by the MSM and dems since they lost the election. Namely, they took the exit polling data (the same exit polls that had Kerry winning) and honed in on the "values" responses. But does anyone know what the question was that lead to the response being given that "values" were the most important thing to voters? Does anyone know what those "values" were? The MSM took it and ran with it. Values=Evangelicals=Jesus Freaks=White Male, Pickup Driving Hayseeds=Dangerous. Terri's tragedy has served as a convenient tool for the MSM (a large bunch of tools).

I just hope that the next issue, and there will be a next issue, where the Judicial Branch oversteps its bounds, congress is not afraid to act. What is going on now can't be allowed to stand. The Judicial Branch is simply grabbing all the power and proclaiming itself above the law. . ."holy committee of public safety Batman!!!" In the instant case, a Judge just basically said to Congress, F.U. and the Constitution you rode in on. How long before some Judge starts to decide on our foreign policy? How long before some Judge declares the Constitution Unconstitutional?

Forget liberal/conservative, Republican/Democrat. The legal industry uses all these tags to further its gains. In the light of the legal industry, the tags as they apply to the REAL people mean nothing.

This Atrocity is Judicial Murder by Starvation and Dehydration

ALL JUDGES INVOLVED SHOULD BE IMPEACHED FOR CONSIPIRACY TO MURDER

Pinellas county, Florida subhuman murderer Judgenfuhrer Greer:
"Tonight begins Holocaust Remembrance Month with our "Perfect Murder".
Never forget that we Judgenfuhrers in Florida --who let you live at our convenience--
celebrate Holocaust Remembrance Month with our worldwide public
2 week starvation-execution of a young handicapped woman.
Now that America's honor is finished in the eyes of the World, thanks to me and my black-robed Mullahs,
you have no more hope. So you WILL serve us,
and then quietly and meekly die after we have enough of your money
or are in sudden need your organs for ourselves or the PRC.

I think this is the left's death knell. The MSM have the rictus grin of Herod celebrating after the slaughter of the innocents. The whole world knows who killed Ms Schindler.

Yes, you are correct, Article I powers, as I have phrased it, but Article III also serves as a companion in that it clearly states Congress's relationship to the judiciary. Thanks for the correction.

The legal legacy of the Terri Schaivo case is, if you don't have a "living will", some court may now find some reason or other to put you to death. One no longer have any presumed "right" to live.

Is this twisted, or what!!??

It used to be the opposite. A "living will" showed your specific desires and gave the doctors permission to withold certain treatments without liability. Otherwise, they had to take all measures to keep you alive - including food and water. Why should it now be presumed such a legally drawn document is now required to protect your rights, otherwise they can be overlooked by some court?

How many children with Downs Syndrome have a "living will"? Are they next?

Ah, yes, NPR. I hear Senator Chris Dodd and Professor Peter Singer are going to write a book about this legislative battle. They're going to call it "Retexting Nuremburg."

And today this citizen sent my kneejerk responce that Stanley ought stick hi shead in a toilet and flush a couple of times. I cited the same sources he did ,and others-to express my belief that the Declaration of Independence as ratified recognized that Governments are
instituted among men to secure the God given Right to life.
That the Court ignored this fudamental right legally and
rightly motivated the Legislative and Executive to appeal for reason from the Court. Under our constitution-and Marbury v. Madison,1803,and under the 14th amendment ,1868
they acted according ot the powers recognized under the
Constitution.

How long before some Judge starts to decide on our foreign policy?

Court ruling on rights of imprisoned terrorists.

How long before some Judge declares the Constitution Unconstitutional?

Life, liberty, pursuit of happiness. The courts didn't protect Terri's right to life. One down, two to go.

Congress should just eliminate those federal appeals courts that refused their request for a full hearing on the issue. These courts serve at the whim of congress according to the constitution. Closing a couple of them down and sending the judges home would get some people's attention. They can make the SC the appealant court for federal district courts.

Insurance companies can halt Mike Schiavo's payoff with a wrongful death suit. There's plenty of evidence, so he should see one American cent for what he's done.
