This sounds much more equitable than a small fine and temporary loss of his security clearance!
I agree. Three years loss of security clearence would give the ability to serve under a new President in 2009 if a Dem would win.
This will enhance his resume, with democRats.
although a misdemeanor doesn't create much baggage.
Why is this a misdemeanor? What is the value of secret gov. documents? If I were to steal millions of dollars of jewelry would I get off so easy? It seems like the justice department works for the dept. of state.

It remains unclear whether Berger knew that, or why he destroyed three versions of a document but left two other versions intact. Officials have said the five versions were largely similar, but contained slight variations as the after-action report moved around different agencies of the executive branch.The NY Times says:Back in his office, he studied them in detail, realized they were largely identical, and took the scissors to three of the copies, the associate said.
In comparing the versions at his office later that day, he realized that several were essentially the same, and he cut three copies into small pieces"Largely the same" and "essentially the same" do not mean THE SAME! Neither article refers to WHAT the differences were among the copies, only that they "contained slight variations as the after-action report moved around different agencies of the executive branch".
"Variations"! There were 5 copies of the same memo. Some or all "copies" apparently bore handwritten notes and/or marks made by the different recipients of the memo. In my opinion, that makes each of the documents an "original", i.e. bearing information not depicted on the others. A more honest description would be to call them "versions of the same memo", not copies.
But all the coverage continues to refer to them as "copies". Thus the MSM will perpetuate the perception that no harm was really done because there are still "copies" in the Archives. And we will never know what was depicted on those destroyed versions.
One can inadvertantly stuff something in one's pockets. I have never heard of somebody accidentally shoving something down his socks or his pants.
It is unclear what impact the case will have on Mr. Berger's future in government. While the plea agreement requires him to give up his secret security clearance for three years, it allows him to have it reviewed and restored within that time if the government asks him to serve on a panel or in another position with access to secret material, associates said.
Reason Number 5312 why the Democrats must never again be allowed access to the Levers of Power...

Hmmmm, if I remember correctly, the case against Martha Stewart essentially boiled down to her alleged lying to the prosecutors after other charges petered out. She was hauled off to a federal pen where she served her time with good grace.
Berger King steals classified national papers, LIES to the feds, and then gets off with a slap on his chubby wrist.
