Within a matter of days, the Senate could face a truly momentous decision - one with consequences that will reverberate across America for decades to come.

Senator Frist, the Republican Majority Leader, has a plan to make President Bush's judicial nominations immune to a Senate filibuster. If he can convince enough Republican Senators to go along, the nomination and confirmation of judges will become a tightly-controlled, one-party affair.

John, how about going back to the long tradition of bringing the nominee up for a vote if the nominee clearly had majority support. Also, how about the 180 you still haven't signed?

Senator Byrd recently said all this stuff isn't necessary....Just have a voice vote in the Senate. There is no law or constitutional stipulation which supports the current rules according to Byrd.

He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

Article II, section 2 of the Constitution (see above in bold)does not mandate any vote at all. All that's necessary is for 51 Senators to tell the president that the president has their "consent" for a nominee. There is nothing in the Constitution about hearings for the nominee either.

We have people in Washington that need to learn that if they want to run the government they might consider reading the "users manual" the founders provided.

Since Kerry deemed it to be an important issue, it looks like I may need to call my two Senators. It's an odd situation, where a smallish state like mine has two Senators on the Judicial committee, both from the minority party. "Blue" state Wisconsin is more like purple than true blue & it might be a good idea to remind the guys we (cough, cough) send to DC to represent us.

I suggest everyone go to that web page and leave a note in SUPPORT of the "Constitutional option". I did and left a short 2 word message to mr sKerry personally.

Hey John,
Look under that thing called the constitution and you can see senate filibuster aren't in there. This senate filibuster thing has just been something thrown back and fourth by both sides for sometime now. If Bush and Frist want to follow the majority of the country in nominating judges who will interpret the rules that govern us all and not activist judges who are political hacks for progressive causes then they are entitled to by the American citizenry and god himself.

Not only FREEPED but called Sen. Alexanders office, told them about the e-mail, forwarded it to them. Got a reply saying thank you, that explains all the calls.

I have called Senator Frist's office so many times....to tell him to do whatever is necessary to get President Bush's nominees to the floor for a vote.

At this point they probably think I am one of the nominees!

States like yours being red made so much more sense than the way they do it now. When they first made the switch, they tried to say that they changed it based on which party had won the last time. 2004 proves that they were lying about it or they hadn't come around to the actual results of 2000 yet.

And since we did precisely that, nominate and approve Judges we democrats for abortion, homosexuality, etc. without the need for a single Republican vote so our courts are now packed with our liberal rubber stamptroopers, we damn sure don't want our successes to be eroded by the Republicans doing the same thing.
