Schiavo Family, Husband Spar Over Funeral

The medical examiner completed the autopsy of Terri Schiavo on Friday, clearing the way for the release of the body to her husband, who plans to cremate her remains and bury the ashes without telling his in-laws when or where.

Results of the autopsy may not be released for several weeks, the medical examiner's office said. Husband Michael Schiavo hopes the autopsy will settle questions about her medical condition, but experts differ on whether that will happen.

Michael Schiavo and his in-laws spent Friday planning separate funerals for the 41-year-old woman, who died Thursday - 13 days after her feeding tube was removed.

Her parents, Bob and Mary Schindler, have scheduled a funeral Mass for Tuesday in nearby Gulfport. The Mass will be preceded by a gathering for people to express their condolences.

Michael Schiavo's family has said he plans to take the cremated remains to Pennsylvania, where she grew up, but her parents want to bury her body in Florida so her parents and siblings can visit her grave.

Michael Schiavo declined to comment on the autopsy. The body is now ready for release to an unidentified mortuary designated by her husband.

Terri Schiavo had been the center of a long legal battle over whether she would have wanted to be kept alive with the feeding tube for 15 years after suffering a devastating brain injury.

David Gibbs, the Schindlers' attorney, said there have been no further discussions between Michael Schiavo and the Schindlers about their daughter's remains. The Schindlers do not plan to press the issue in court, he said.

"The court has already determined that (Michael Schiavo) will control the burial decisions," Gibbs said.

Outside the Pinellas Park hospice where Terri Schiavo lived for five years, just a few protesters returned Friday for a brief mass as city workers took down barricades used to control the crowd. Media crews from around the country packed up their gear.

You know what the solution here was simple all along - either this situation needed an permanent mediator, and perhaps the court appointed guardian should have been making all decisions all along here, I'm beginning to think neither side here deserved to be making any decisions in respect to Terri, should have been a totally objective third party all along

this is disgusting and sad that the two sides of this tragedy can't even agree on a funeral, and I'll agree, the husband seems to be a prick on all this

I say let the court appointed guardian make all the decisions, he's got to be fairer than the husband

IMO he should allow the Schindlers to have possession of the body, I think he is being hard assed over this, probably as a result of the Pi**ing contest he and the family embarked on over removal of the feeding tube. Having been called everything from a murderer to a wife beater he has probably made his mind up to do whatever he can to hurt those who have tried to hurt him, figuring they cant say anything worse than they already have so paybacks are hell.

I dont agree with his doing that and its just a guess as to his motives .

Father Pavone was very charitable in saying MS is cruel and heartless. And Felos whined like the devil at having been exposed to the light of truth.

You know, the whole death scene wherein M.S. pushed Terri's brother out of her room just as she was about to expire, and "caressed" his wive's head under the drooling gaze of that freak Geo. Felos, and now this....I'm beginning to wonder if M.S. killed Terri off simply to get at the Schindlers.

The parents should just hold a memorial service on their own, I did that for my spouse whose body had been taken by the hospice and was being prepared for cremation. It is the spirt that counts not the flesh, nor the ashes. The ceremony was an appropriate closure.

Okay, I'll chime in on this one, and I'm actually on the husband's side on this one.

My brother was cremated after his death a few months ago. My sister-in-law has the ashes, and has not determined what she is going to do with them.

The memorial service was done before the cremation, and just a few days after my brother died.

Now, my sister-in-law is going to do something private with the ashes.

My brother knew he was dying, and they did make all of the arrangements beforehand. That's the main difference. My brother was not very religious, but my parents are devout Methodists, and my sister-in-law is a devout Catholic. She did everything the way my brother would have wanted it.

I understand the family is extremely disappointed that they won't be able to bury Terri in the way that they wanted, but MS is a control freak and feeds off of spiting them.

If it were me, I would purchase a grave and headstone and plan a funeral for her without the body. Others have had to do this when their loved ones died tragically in accidents or terror acts and there was nothing to bury.

MS just wants to see them beg so he can tell them "no." Don't give him that pleasure.

There was a court-appointed Guardian ad Litem- Richard Pearse. In 1998. He recommended that Michael Schiavo be replaced. Judge Greer discarded his recommendations and fired him as GAL.

Next case....

At least when Terri is cremated or buried, the Schindlers will be done with Michael with respect to the physical person of Terri. I sincerely hope that they will then focus all their energies on figuring out how best to nail him and hopefully the vampire Felos to the wall, and I hope they get top-notch legal help to do it. I also hope they will be able to venue-shop to their advantage. They might not be able to get Michael and Felos for murder, but they might be able to get them for fraud or dereliction of guardianship or something.

See my post above. Felos was instrumental in having Greer dismiss the court-appointed GAL when his (GAL)recommendations went against Miacael.

The GAL (Richard Pearse, do web search) was critical that the court was approving Felos to be paid questionable (unusual) legal fees from Terri's unaudited trust fund. Felos has received over half of Terri's medical trust fund - $400,000 not including recent charges for billable hours for hovering over the death bed.

The GAL was paid $5,000 (from Terri's trust fund) dismissed by the court.

In effect, Terri's trust fund subsidized her euthanasia and gave George Felos a good living for the past 7 years.

Saw them, and saw his girlfriend/fiancee's brother last night for a few minutes on LKL. Oddly enough, he's married to a woman who just happened to be Terri's nurse after her collapse in 1990. Coincidence?

There are some excellent articles on this case at www.theempirejournal.com. Hopefully, Schiavo, Felos, and Greer will get everything that is coming to them. They deserve to be dehydrated and starved, then cremated.

Keep in mind Father Pavone is a Christian Gentleman keeping the good father from really stating anything about this piece of trash. Michael Schiavo's day is coming though absolutely no one can dish out as much evil vile hatred as Michael has and escape unscathed.

I concur.

On my only post on this subject I said essentially the same thing as you.

At the first hint of disagreement between the two families a court appointed guardian should have been put in place with full power of attorney and the award for malpractice placed in trust for Terri's care with instructions that the funds be spent on the maximum care and therapy available.

That would have been the honorable and fair solution. If that approach had been followed Terri would be alive and the best that could have been done for her would have been done.

This attorney doesn't seem to bright. Since the autopsy was completed at lightning speed, it is obvious that it was done only to determine cause of death. If the Schindlers want more answers as to what happened to their daughter, it seems that this lawyer should have suggested an immediate wrongful death lawsuit. That lawsuit would prevent Terri's body from being destroyed by cremation.

So you honestly believe that Terri would have WANTED for her parents to not attend her funeral or even know where she was buried.

The difference IS that your SIL did what your brother would have wanted. This is not the case with this creton.

If the Schindlers want any peace, they will now stop future contact with him or the people surrounding them. Lawsuits, court actions would just lead them into constant horrows. Sometimes you have to know when it is time to fold them. I hope they can.

The autopsy was not done at lightning speed. They usually take 4 hours, then the organs are examined later, after they are fixed in formalin and cut up into pieces for microscopic slides.

And once an autopsy is done, the body is no longer of interest in a forensic suit unless some later evidence comes up. I don't think there will be such as this forensic pathologist knows the likelihood of suits etc.

I strongly doubt Michael will end up in the same place as Terri.
