Writer Coulter, arresting officer missed 1st trial
Pima County prosecutors plan to take another shot at two men accused of throwing pies at political writer Ann Coulter, even though she didn't show up at their first trial last month.
The Pima County Attorney's Office intends to refile misdemeanor criminal damage and assault charges against Phillip Edgar Smith and William Zachary Wolff in connection with an Oct. 22 incident involving Coulter at UA's Centennial Hall, said Chief Criminal Deputy David Berkman.
The two 24-year-olds are accused of throwing cream pies at Coulter as she spoke before 2,500 people on that date.
Smith and Wolff were scheduled to go to trial March 18, but neither Coulter nor the arresting officer showed up, Berkman said.

Why would Coulter have to testify and not just the state prosecute? Its on tape... Not like you need the victim there to say, "yes i had a pie throw at me" you have the incident on tape. The state should prosecute these guys.

Ann complained about that in her column, but it didn't seem to bother her enough to get her to show up and testify. There's no obligation on the part of a victim to show up at the trial. It's the arresting officer's job to be there.

Exactly, the prosecutor is not in the covering of butt mode after Coulter's latest column. Sending a victim notice of a court appearance is hardly the same thing as asking them to come testify. And of course the incident is on tape so they don't need her to testify.
Heck do they even need the arresting officer? They show the tape. Then the ball is in the perp's court. They either can show that Coulter consented to being pied or they can't. Why would the officer need to be there?

There have been several incidents of this type in recent weeks, and little, if anything, is being done about it by the authorities where these attacks have occurred. A lot of people will just laugh it off as a "harmless prank", since the attacker is "only throwing a pie". The lack of consequences will only embolden others. It's just a matter of time before one of these clowns decides to go after someone with a knife or gun, rather than a pie or salad dressing.

Wolff, in an e-mail to the Star, said, "Given that I hear that the prosecutor's office is terribly overburdened, I find it rather absurd that this is being pursued." Yea Wolff, it was only a case of assault after all.
There has been pie throwing assaults against Chrystal and Horowitz since then and if nothing is done and these cases aren't pursued, it will be open season on conservatives on college campuses.
Coulter,Chrystal and Horowitz better show up at these court hearing or have an representative show up in their places.

Quite possibly true. I would like to hear from someone who knows the procedural niceties here. With arresting officer to attest to the identity of the perps, and tape of the event to establish the assault, is the victim's testimony required? I suspect the answer is yes. A defense attorney would have an appealable objection if the (live and available) victim were not available to testify to the assault, and identify the perps.
Sorry, but video evidence can be manufactured. Consider it a precaution for defending YOU against some future entrapment scam.

I got in trouble when i was 19 for having friend sister out past curfew she was 17 the police took her to the station, and charge me with contributing to the delinquency of a minor. SHE didn't press charges OR her parents(her parents like me) BUT the state pressed charges against me. Same thing could happen here.

You know what, thinking of assault... think of MY prior history. Me and a friend were at a dance club, playing pool and were messing around and starting wrestling in the club. The bouncer threw all of us out, my friend was drunk(they didn't serve alcohol in this club it was a teen thing) my friend got into a fight with the bouncer and the bouncer pinned him to the ground of of his bouncer buddies tried to come outside to help him, he got 1/2 way out the door and i slammed the door on him crushing him with the door(it was a huge wooden door I threw my body into the door as hard as i could) then that guy at smashed went back inside and called the cops. then I told the guy to let my friend up or i was going to kick him in the head... so he let him up... we then got in my truck and he got my license plate. i dropped my 2 buddies off and proceeded to drive home, and was then arrested. couple days later got a letter in the mail for "assault" it said "illegal touching of a person without permission" something like that. I got a lawyer and and a few months later went to court, the bouncer never showed up and the charges were dropped. EVEN though that night the police took me back to the club and the bouncer IDed me. Maybe some laws need to be changed on assault? I was in the wrong and got off totally free of this charge.
