Man Busted For Manicuring Without License Free-Stater Protests Licensing Laws

CONCORD, N.H. -- A self-proclaimed manicurist decided to open for business in Concord on Monday without the state's approval, attacking state licensing laws with a nail file.

Police Arrest Man For Giving Manicure

Michael Fisher, 23, of Newmarket, N.H., was arrested and charged with violating the state's license law. He said he organized the protest to call attention to what he said are needless obstacles facing small businesses in the state.

His first and only customer was Kat Dillon, of Frost, Texas, who said it was her first manicure. It was also Fisher's first time giving one.

"I'm going to buff it and shine it with one of these, a buffer, basically," he said.

The manicure performed without a license was undertaken right outside the state Board of Barbering, Cosmetology and Esthetics office.

"The reason I'm doing this is because it's one of the harmless things I can do to prove that the law is unjust," Fisher said. "Without the government's permission, you can't do nails, hair, lot of other things."

Fisher said his manicure movement was inspired by the movie "Ghandi" and backed by his fellow Free-Staters, who favor minimal government and maximum personal freedom. Dillon is also a member of the group, which has organized members to move to New Hampshire in an effort to influence the state adopt a more libertarian government.

"It's wrong for the state to tell you you can or can't open a business," Free-Stater Dave Ridley said.

Fisher had advertised his protest, so it was no surprise when board inspectors arrived on the scene, and it was no surprise that Concord police soon followed.

"Initially, we were going to issue him a summons and release him on a summons to appear in court," Sgt. Roger Baker said. "He indicated he wouldn't stop, so at that point, it was a full custody arrest."

Performing a manicure without a license is a misdemeanor. Fisher remains in Merrimack County Jail, refusing to see a bail commissioner. He will be arraigned Tuesday morning in Concord District Court.

He said he plans to plead guilty to "help get the message out there."

I'm glad the government is here to protect us from manicurists.

Really, far too many resources are invested in fighting terrorism and solving rape and murder cases. It's nice to find a police locality that realizes that painting nails is the true peril to our citizenry.

Mr. Fisher is quite correct that the state has no reason to be in the license business. The way to fix this is to repeal the law. Right or wrong about the merits of the case he will be punished. Maybe a jury would agree with him, but not likely.

My wife and I have been in business for years and have no license for the business itself, we work as consultants in our professional fields. My wife is licensed however as it is required even if she worked as an employee for, say a hospital. In NH, many tradesmen do not need to be registered or licensed such as roofers, siding applicators, landscapers, and businesses like that.

I am not sure about that. You always have the right to open a sole proprietorship under your own name, e.g. "John Smith's Lawn Mower Repair".

I gotta agree with the state here. Over regulation is a major problem for many businesses, but I don't think this is one of them. We had a situation here in San Jose where a series of raids were conducted on unlicensed manicurists. Seems they weren't cleaning their equipment properly and people were ending up with disgusting fungal infections on their hands and feet.

Basically, I don't want to have to inspect every barbershop I go into to make sure their clipping shears and combs are clean. But then again, I don't know if I trust the government to do it either.

The State of NH didn't tell the man he couldn't open a business, just that a license was needed. I wonder if this idiot has ever heard of HIV or Hepatitis or how either of these disease processes can be transmitted via a manicure?

Let him spend time in jail. Perhaps he'll get "buffed and polished" by the other law breakers.

If you trained another person to bite someone's nails, for a fee - you could go to jail.

I remember reading that case, but I think they were actually licenced manicurists that weren't cleaning their equipment. They only sent the health inspectors in because people were getting the nasty infections.

What has that got to do with the state licensing his business? The proprietor paying a fee to the government to get a slip of paper makes the customer safe from fungi in the same way that having a police department in your town makes you invulnerable to crime. In other words, it doesn't.

In a free country, once word got out that a manicurist was giving people infections, customers would stop going and the business would go under. End of problem.

How is it different? The condition of the food on the plate is still an unknown to you if you didn't prepare it yourself. Even then, there is risk. And, of course, we all know that government licensed food operations never sicken anyone. Interesting you should mention Hepatitis, as that is the particular disease that was transmitted by a ChiChi's in the Pittsburgh, PA area a couple of years ago. Several people were sickened. Did the county or state government take responsibility for the incident? Of course not. If we want to prevent disease transmission, bureaucrats are not the answer. Pieces of government issued paper are not the answer. Washing the feces from the green onions is the answer.

Having started and operated two businesses in New Hampshire I'm very familiar with their laws. First, individual business are recorded in the individual cities and towns. Unless the business is utilizing a DBA or is incorporated, there is no official state registration. Please make note of the word "registration."

Just as a barber shop, the shop itself doesn't not require registration, however the individual barbers must be licensed. The license is essentially stating that the individual has met basic educational requirements in that profession. This applies to most trades where the profession is performed or applied on an individual be it a physician, nurse, physical therapist, radiology tech, respiratory therapist, massage therapist, barber, hair stylist, or manicurists. Should we eliminate all licensure? Do you object to a driver's license? Should we eliminate licensure for pilots?

The Freeloader, opps, Freestater was looking for his 5 minutes of fame. Let him spend his time in jail where he obviously belongs.

Alright, you may not know this ( I'm guessing all of you are men) BUT manicures if not done right can cause infection and your finger can fall off. Really!

There are certain chemicals that are illegal and some places still use these chemicals. And a nail file can be dangerous if you're going to get those glue on nails, because first they have to file the front of your nails.They will literally file your nail front down and if they screw up...your whole nail can fall off. And some of those chemicals can infect your finger or open it up to infection. Paula Abdul almost lost her finger after getting a manicure by an idiot. I'm serious.

Yes, we should eliminate all licensure. A driver's license has to do with driving on other people's property - you don't need a DL if you only drive on closed racetracks or your own property. And pilots, even licensed, still die when they make mistakes - funny how that piece of paper doesn't even function as a parachute, isn't it?

Sure, I can see a difference between events. I simply don't see how the government license keeps me safer. Why is it that profit seems to be the thing that makes a license necessary? Does a non-profit need a license? (This certainly varies by jurisdiction, but I'm talking philosophically here.) Is it an issue of quantity? Meaning, that a foodservice operation is ongoing? What if I pay a friend to make something for me to take to a picnic? Does the fact that he made a profit, a loss, or a wash matter? If he intended to profit but didn't, is that still a crime? What makes it ok for me to roll the dice on Aunt Matilda's chicken salad, but not on the unlicensed back-alley for-profit deli run by my next-door neighbor? I simply do not see how the license squares with the principle of voluntary exchange.

Yeah, I had a nail fall off once. See, I was standing at shortstop, and that sucker NAILED it right at me - it tore my fingernail off as it went by.

Now, the only time I had a finger fall off, it was because I was stabbed.

I was a young paratrooper, and one of my buddies got excited...

Nevermind.
