Did Seaman Stower instigate a fight with the marshal? If so, that was violent behavior. When Seaman Stowers told the officers, on seperate occasions, if they'd like to fight him, that is violent behavior. The only reason there was no altercation was because the officers involved did not engage Stowers.

You'll seldom find an incident involving a fight where two or more people walk up to one another and just start going at it without first exchanging words.

If you are suggesting that words are just words, and nothing more, than I'd challenge you to go into a movie theatre and yell "FIRE!!!" at the top of your lungs. Or walk up to a 6'6'' thug and say, "Let's go! You and me, right now! I'll kick your *!#@!." After all, they're just words.

Look, the whole thing boils down to at that time was the marshall justified to shoot. I do not think so. He shot first an unarmed man. I guess the marshall forgot the rules. LEO or not you never use pull a weapon unless it is to kill. He knew he was not justified so he shot him in the ankle/leg.
What is the marshalls history. We do not know but chances are he was a desk jockey. Lack of training is not an excuse and the marshall was out of line when he pulled the trigger the first time.

I will go as far as to say that the marshal, at the very least, showed poor judgment. He certainly bit off more than he could chew.

Stowers had the right to get drunk in the privacy of his own home. He also had the right to freely express his opinion. But it becomes a problem when his freedom endangered the lives of others.

I'm inclined to believe that the marshal does not go to bed with a guilt free consciences. Truly, there were no winners in this case.

Absolutely! Guilty or not guilty his career and finances will be ruined. The possible civil suit hangs out there also. The kids if they saw it will be affected plus the stress on the family life. I just look at it from the perspective if it had been me from the CCW class I took.

Law enforcement should go to extreme measures to avoid altercations while off duty. No radio, no backup, no car or uniform that spells authority, etc.

That being said, generally those that engage in fights with cops have loose screws, and it usually does not end up well for them.
