Under the law.

Yes.

You didn't answer the other question, but by your answer, if justice is blind, both the boy and the girl should be charged with rape, right?

Actually I would think the law only states if the child is under 15 and the "perp" is an adult. I don't think you can have statutory rape between juveniles. It wouldn't be called statutory unless one of them is an adult and has taken advantage of a child's inability to make sound decisions due to maturity.

You're lucky to have found George WAshington in that picture. I attended a meeting in Germantown, Wisconsin in the high school cafeteria a couple of years ago. Germantown is a mostly white, conservative suburb of Milwaukee. The end of teh cafeteria where the raised platform was was covered wall to wall and floor to ceiling with an enormous mural. It pictured huge representations of Winnie Mandela, Martin Luther King, Cesar Chavez, Marie Curie (I think) and a lot of other ethnic figures. There was a tiny little figure in the forefront of Mozart at a keyboard. There were no founding fathers, whatsoever.

Well, it would be so inappropriate to teach respect for our members of the military, don't you know...

I hear you. It's still further evidence of our deline as a civlized society and nation.

Yes, and you reminded me. Caesar Chavez was also mentioned by the guy I was talking about. And the teachers can't figure out how we can tell what they are teaching. Idiots!

Clearly the school you were involved with was a far cry from the concept of true Christian schools that have joined together nationally for a common purpose. Was this school ACSI accredited? Certainly that history curriculum and text were way out of line for what they review and approve.

It's another reason why you need to be present at at the school and in the classrooms as often as possible. Reviewing the curriculum and texts prior to the start of the school year would have prevented this.

(BTW: Five is a good number, I'm one of five and to my great astonishment, I now have five of my own.)

"Is that how it went down?" Indeed"

Uh-oh - I have used that phrase before and I am most likely older than that nurse. I would hate to have you on my jury based on that condemnation. :o)
Anyway, I'll wait to hear both sides. Fifteen-year old girls have been known to lie on occasion. But sounds like the nurse overstepped her boundaries based on gossip she heard from another school.

I am only going by what the law says, not what anyone thinks it should be.

What was your other question?

"Or do you think the girl is incapable of initiating the sexual advances"

Are you asking me if it should be legal for a girl under the age of consent to be able to say "I want to have sex" and take off her clothes, engage in sexual activity, and then the act is now legal?

>"I remember the incident," Eastwood said. "Is that how it went down? No, of course not."
>>What normal school nurse talks like that? Is SHE a gangbanger?

Chances are, if you
worked and talked with kids all day,
you'd talk THUGGISH too!

Section 22.011 (a) (2) of the Texas Penal Code provides that a person who has sexual relations with a child younger than 17 years of age is guilty of Sexual Assault.

I think the key here may be the word "person". I don't know statute and section of PA code, but the term "person" assumes someone over 18. In PA statutory rape (as I understand it) consists of one party being an adult (over 18) and the other a minor, or sexual action where both parties are minors, but the difference in age is more than 3 years, i.e. 17yr old + 13 yr. old.

a child may consent to medical treatment by a licensed physician if the child "is unmarried and pregnant and consents to hospital, medical or surgical treatment, other than abortion, related to the pregnancy."

The nurse assumed the girl was pregnant and told her to take a pregnancy test to confirm this. The assumption was that she was able to give consent, however, since she was not pregnant at all that means that the above exemption wasn't in effect. The consent was invalid.

If the story presented is accurate

Excellent observation. Anyone who accepts at face value everything that a plaintiff's attorney puts in a lawsuit is fairly gullible.

"I literally hate the people who run this nation's education system"

Remember many years ago when teachers loved to teach and loved their students? Ask any teacher that you know if they love their work and their students and I bet most would say no. Most of them are angry, rigid, and don't really like what they are doing. The education system has run off many of the good teachers. The day will come when there will be a major teacher shortage. I sincerely believe that in our lifetime we will see new educational systems sprout up based around home schooling. Public schools will merely be warehouses for poor children.

"Well let's not split hairs"

Was I doing that?

"But it sure as hell wouldn't or COULDN'T happen at my kids' school."

Sorry, I'm never that sure about anything, except death and taxes.

"The board the policies and rules are all drafted and overseen by parents and a no-nonsense board"

Same here, this book just slipped past because no one had ever heard of "Mapplethorpe", including an arts history minor.

"That's what we pay the big bucks for and everyone knows it."

With tuition and donations, we are in for a half million dollars. Does that count as big bucks?

Still, in his presentation he rattled off a number of historical figures the kids should emulate themselves after. Absent the list were any of our forefathers. Absent the list were any white U.S. citizens from the present or from history. Mentioned were, Martin Luther King, George Washington Carver, Mia Angleu (sp?), Nelson Madella... and others. My wife did say he mentioned one white guy, Michaelangelo.

I guess Michaelangelo can be forgiven for being a white male because he was (allegedly) gay.

Hey, she's supposed to be the example as a mature adult, or so I would think.
