US Senate (Oath or Affirmation)

(Same Rule III Oaths The oaths or affirmations required by the Constitution and prescribed by law shall be taken and subscribed by each Senator, in open Senate, before entering upon his duties.)

Oath Required By The Constitution And By Law To Be Taken By Senators:

"I, A__ B__, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God." (5 U.S.C. 3331.)

Since Dick Durbin has clearly violated the oath he swore upon entering office, why is he still a United States Senator?

Because, as BJC proved, an oath don't mean squat in the USA anymore.

Well, he probably was actually administered the oath. The fun starts when you start looking into state officials. They're supposed to have a current oath on file and many states also require a bond although they hate that. Try looking up the current oath of the judges in your state and watch the fun begin...

He has an out here....or so he and his colleagues might think. It's the same one Michael Moore used; the same one Hillary used. In Durbin's twisted view, he really IS protecting the U.S. against domestic enemies--our military. They take their socialist vision and stamp "America" on it and then say that they're defending the United States.

Lame. How can he oppose our military and "bear true faith and allegiance " to the Constitution at the same time?

As I see it, the oath REQUIRES the remaining Senators to proceed to expel Durbin. But, of course, they've allowed sKerry to languish in that body, also.

An oath is required by the Constitution; not spelled out. The oath is spelled out in law but not in the Constitution.

But it won't happen. The Pelosis, Boxers, Waxmans, et al in the Democrat camp think what the Sheikh said out loud. The RINOs don't want to rock the boat. So the traitors and seditionaires stay, Constitution be damned.

People don't take oaths seriously anymore, anyways--especially politicians.

Cynicism is an offshoot of anger, which is completely natural in this shameful circumstance. As long as we don't become too cynical to act and speak against these Durbin creatures.
