"It came with the virtual elimination of personal property rights."

I had the same thoughts as I read the news of this. This is it folks, we have lost the essence of freedom in this scotus decision and we lost it during a republican administration (who'd a thunk?)

It's only a matter of time before it is used as a dirty political revenge modus operandi. Hillary must licking her chops tonight.

Nonsense. This vote was 5-4. But 4 of 5 of the majority are liberals (including 2 Clinton appointees), and 4 of 4 of dissenters are Conservatives.

The message is clear: Conservative justices support your property rights, and Liberal justices want to strip them from you. That is the banner we should march beneath next year, in 2008, and in every governor and local race in between.

We the people can stop this decision across America, and make sure a property-rights litmus test be applied for every SCOTUS nominee from now on.

The libs on the Court are gobbling up every bit of our freedom while they still can. They know their numbers will soon be altered. I keep thinking it can't get any worse but it does.

Serious issues like this one can be reversed with a Constitutional Amendment (I think) - I know, everyone thinks their issue is serious. This one is - it means any developer can enrich himself at your expense. There would be some case for this if most new development was an improvement - but more strip malls etc. we don't need.

And that doesn't even touch on the payoffs that already go on at city hall to get "things approved."

Or what about this scenario: your property is confiscated and after it's torn down and the foundation for the "improvement" has been poured, the developer suddenly goes belly up - with their gambler mentality and penchant for being over-extended this happens all the time.

It isn't only that these judges are libs or don't believe in private property - they really don't understand how real life proceeds.

Sorry for the incoherence - just a collection of thoughts generated by this latest "vehicle for mischief" on the part of the what is supposed to be our most supreme court.

It was during a Republican administration true. However, it was due to 5 liberal justices. This underscores the absolute need to break the Democratic Senatorial movement to keep conservative judges from the bench. Forget SS, forget taxes, forget everything. This is the number one problem, because even if the majority want freedom, laws, and common sense, it only takes 5 liberals to trump it. This is the war that needs to be fought.
