Eminent domain still divisive issue Ferlo wants to limit what governments can take

Pittsburgh Mayor Tom Murphy applauded yesterday's Supreme Court decision securing municipalities' broad rights to use eminent domain. But state Sen. Jim Ferlo said he'd seek to carve out an exception in Pennsylvania.

That's how controversial the government taking of private property for private uses is in Pittsburgh, nearly five years after the proposed Fifth and Forbes development made it a big issue.

Murphy said his administration has used the city's eminent domain power to take private property just once -- in its effort to remove the X-rated Garden Theater from the Central North Side. Litigation in that case is continuing.

But he said eminent domain was a key tool in convincing the Pittsburgh Wool Co. to make way for an expansion of H.J. Heinz Co. facilities, a move that he said,kept Heinz here and paved the way for Del Monte Foods Co.'s purchase of the facilities.

"There are 1,500 jobs here in Pittsburgh that wouldn't have been here if we had not had the ability to work with Heinz," Murphy said.

I've written to all of my local, state and federal representatives. I've also emailed this reporter to urge him to keep the spotlight on this issue.

Pittsburgh's mayor recently tried to seize a chunk of downtown and turn it over to private developers. He lost because of intense public pressure on our city, county and state representatives. Here's a quote from our elected thief:

Eminent domain "is a great equalizer when you're having a conversation with people," Murphy said. "It's about having a fair conversation and not being held up by people who do not have any interest in the community, but only have an interest in putting more money in their pockets."

I've called ALL my elected representatives, including Bush.

Now it is time to call the news services. Tell them to stop talking about Aruba (I really can't stand it anymore) and start dealing with some important issues.

I'm calling Fox now about this.

Why would you expect him to rush out and give the darling communist media outlets that we call the press, another round of endless Bush bashing over his hostility to established law?

Wait awhile. Besides nominating some good judges, there isn't much he can do.

Yep -- and he has no shame over portraying people who merely want to keep their family homes or businesses as money-grubbing, anti-social scum.

I had to hold my nose and write Ferlo a supportive letter, urging him to follow through and introduce the eminent domain limit in the PA senate. Ferlo may be a commie too -- but right now, I am a single-issue gal.

When they put the interstate through the north side 35 years ago I was greatly distressed that they would whack the home of a nonagenarian and give her $10,000 as if she could relocate that easily. It was cold. It is a cold world. It is time that everybody wake up to reality, and this decision apparently has done that, to a degree. People still don't get it, but at least they know something is going on. Ignorance is bliss, and we are blissed out.

All I'm going to say on this matter, is look at who appointed the judges who voted that Eminent Domain can be used to allow developers to take your land for the next Wal Mart.....

And then tell me there is not a damn bit of difference between the leftist/socialists/progressives/commies.. and the right!

It was harsh. That was my first reality lesson in gov't and funny I learned it from reading the Pittsburgh fishwrap instead of in school where they are supposed to be teaching us the nature of reality.

Most kids don't appreciate civics class and wouldn't take it if it weren't required. They don't mind practical classes such as algebra and science quite as much. But, it turns out that knowing the nature of the State is vastly important, and yet there is little known about it even in theory, and little coherent thought since the discredited Marx. We apparently don't even know the reality in which we live.
