High Court to homeowners: Stick 'em up!

It's like a bad dream...But this is real. We live under a regime that can...grab our homes...pays us what it thinks the property's worth, and then hands our property — in finely crafted "sweetheart deals" — to developers...

This is not an isolated case...[t]his is happening all across the nation. Local officials looking to boost their tax take through eminent domain like a vampire looks for fresh neck arteries....

Politicians' lust for money doesn't stop with homeowners and small businesses, though. Churches don't even pay taxes. No revenue stream for politicians at all. Uh-oh....

"We don't oppose churches," Council Chairman Samuel Dean told The Post. "The concern we have is that sometimes churches eat up a lot of land that could be used for other things." ..."None of us are against God." But added: "We're losing tax money and retail." ....

Don't be fooled.. In this case judicial restraint means a general increase in government power....

Certainly, the only meaningful public benefit is more tax dollars collected and spent by politicians. The public gets whatever trickle down benefits come of this government spending. Lucky us.....

They actively expand government power whenever citizens threaten to exert some control over it. And when governments kick John Q. Public in the teeth, the black robes stand aside, in "judicial restraint....."

It reminds us of the fact that while our judicial system has been hijacked, so too have our legislatures and city councils become dens of thieves...

. The Kelo decision tells us how predatory our government has become. The America Dream, cut into and carved up by so many politicians, was this week struck down by the courts. But we're not giving in to them. We must get it back.

This guy has it right.

Don’t be mislead. Today, the NY Post called it a “liberal land grab”-that’s obfuscation and an attempt to misdirect conservative anger. This WAS NOT a liberal decision, this was an ELITE decision. This was not a constitutional decision, it was a GOVERNING CLASS decision. Unless, we objectively recognize this coup d’etat of the US Constitution for what it was-( i.e. a bi-partisan governing/power elite “tyranizination” of the average citizen-) we will lose ourselves in the partisan rhetoric blame game.

This issue transcends paritisan politics. There exist a multiplicity of issues for which we can legitimately fault LIB/DEMS, ad infinitum- but this is not one. Souter, Kennedy, Stevens may be liberals, but they’re GOP nominees on the GOVERNMENT payroll.

FOLLOW THE SILENCE. My name sake made famous the Legal Maxim, “qua tacet consentire”, silence betokens consent. Where was the separate dissent of Mr. Constitution, Justice Scalia? Where was the outrage from any of the national governing class? How about outrage from a GOP Mayor of a major muncipality? Only silence. Don’t be mislead by the fig-leaf charade of the 5-4 decision- it was every bit as effective as 9-0 in favor of the bi-partisan minions of Government.

It is ironic that this case involved “New LONDON”. Old London tyrannized us in the 1700's. Now the Ruling Monarchs of New London, abetted by its fellow governing elites, attempt to take back what we won in 1776, the right to be free in our possession of property. Frankly, the current corrupted governing elite is coming all too close to becoming King George III and the “new” London.

The Kelo decision tells us how predatory our government judiciary has become.

The judicial branch of government has been out of control for years, and what's been done about it? Nothing.

The people could have controlled the judiciary years ago, through their congressmen and senators, when the first activist judges took to their benches, but they did nothing.

So, now we reap what we have sown, and it'll get worse before it gets better.

When I first wrote about this subject, I thought it would be of narrow interest. I mean, normal human beings don't get excited about Supreme Court cases, do they?

But it turns out that people of all types (except hard-shell, lib-Democrats) are getting up in arms about this New London case. It is an abomination. But it is terrific to see regular Americans getting their knickers in a twist over the latest judicial outrage.

EXACTLY. We can't allow ourselves to fall for it when the media tries to get liberals and conservatives to blame each other. This isn't a liberal vs. conservative issue, there are just as many DUers pissed of about this as there are Freepers.

It's not just Dubya- its EVERYONE. Ask a GOP Mayor if he wants this decision overturned.

On this one, I know of what I speak. I personally argued my eminent domain case before the Ct Appellate and Supreme Court- and I have an action pending in Fed Court on this.

If it happens to you- this is how it goes. By Legislative act, a Legislative Agency (e.g. Dept of Transportation) takes your land by recording a taking on the town record against your property.

When you respond in suit,or appeal of "just compensation, the Executive Branch (i.e. State Attorney General) defends the Legislative agency. That's 2 branches against you.

Then, you are before the 3rd branch of Government- the Judiciary. The Judiciary is conflicted because it is predisposed to save the State money- You can see why, right?
Judges get their raises based on how much taxpayer money is in the government kitty- why are they going to dip into it for the average Jane or Joe.

At end point, there are no checks and balances in eminent domain. You are fighting the entire government apparatus.

Of course I'm against this.

There is no such thing as a private use if this ruling stands.

What's a shame is that no GOP Congressman, to my knowledge, has yet introduced articles of impeachment.

Liberals vs. conservatives? To frame this as such would be shameful. It's libertarians vs. authoritarians at the most fundamental level. Do we have the freedom to keep our own property in the face of the government judging that someone else could use it better or more beneficially?

Not just yeah, but HELL, YEAH.

I find it amazing that the liberals on the court were so fixated in their exuberance to expand governmental powers that they forgot they were enhancing the business class at the expense of so-called working class (in most of these situations). I realize liberals use the (again, so-called) working class only when they need them and crap on them whenever they don't, but they are usually consistent in their support of this group versus business.

So help me out here: is expanding governmental power the holy grail of liberalism over abortion on demand and all homosexuality all the time, or are these three issues co-equal?

I think the "expansion of government power": is an end in itself for all those in government. I say it's akin to the globalization- one world order-. It is just part and parcel to all the elite trade agreements and multinational corporations.

Those plebeians in Europe just wised up- and I think this decision is helping the American people to realize that the governing elite is going too far.

Pzifer, ground zero in New London, is already on record that they intend to "farm out" jobs to other countries. So much for helping the New London economy.

My parents almost lost our family home several years ago in California. They wanted to build a new freeway extension and off ramp. There were many meetings and even more lawyers involved. My Mom and Dads home was appraised at $350,000. The company that was building the freeway offered them half that and expected my parents to just roll over. Fortunately they construction company lost and the freeway was voted to another location (across the road) without any homes that would need to be leveled. I think this decision is bulls**t. Most of the malls and the crap thats built in small or large towns don't last long. We are becoming less and less safe on our own turf, even if we own it.

You should realize that this ruling on property rights (or lack there of) proved the tinfoil hat wearers right in their paranoia against government.

YES, I have been wearing that tinfoil hat for a while. My lefty friends were always shocked when I agreed vehemently with their claims that we were sinking into "corporatism". The writing's on the wall now.
