Hmmm, recent rulings of the US Supreme Court make me wonder whether spelling things out in a constitution is worth the effort.

Yeah, well everyone seems to think judicial activism is funny until they wind up with a Constitutional Convention to fix the problem (not that I have any convidence that it would).
