Bill Clinton: Investigate Judge Roberts' Civil Rights Record

Ex-president Bill Clinton is calling on Senate Democrats to investigate Supreme Court nominee John Roberts' civil rights record, based on a memo he wrote as a lawyer in the Reagan administration arguing that Congress should be allowed to bar courts from ordering busing to desegregate schools.

In an interview on National Public Radio on Thursday, Clinton said:

"The only thing I've seen in these [Roberts] documents that bothers me that I really want to see the Senate explore . . . [is Roberts' memo] claiming that the Congress could keep the Supreme Court from hearing all kinds of cases involving school busings, school prayer, abortion, flag burning, lots of other things."

The ex-president said that Roberts "apparently had a big fight within the Reagan administration" over his position, "where he was to the right of other people in the Reagan Justice Department."

Clinton said the Roberts civil rights memo "might indicate an unwillingness to allow the Supreme Court to be the court of last resort when people assert their constitutional rights."

On Wednesday, Clinton told Bloomberg News that he was "surprised" by the Roberts memo, calling his position on civil rights "to the right" of conservative scholar and then-assistant U.S. Attorney General Ted Olson.

"I'd like to see that explored in the hearings," he urged. "I think that'd be good for America."

Oh, and he's not going to keep her out of the race. He's just going to slice her up just enough. Get inside his head, the last thing he wants is to stand behind her. Can't blame him for that but it's always about him. She knows all this of course and can't do anything about it.

Take time to study the Clinton's accusation more carefully. If Roberts did write such a memo and it accurately captures his legal philosophy, this is arguably good news, perhaps very good news, for conservatives.

How about we investigate Bill's civil rights record...using government power to sic the IRS on his enemies; silencing witnesses with threats and bribes; publicly defaming others, etc.

Won't it be interesting if Congress ever gets around to limiting the jurisdiction of the federal courts, and the courts then say that such laws are in violation of the Constitution? I think such a scenario is entirely possible, and Congress will need to assert it rights under the Constitution.
