well...democrats will never win in the south again, other than the welfare plantations that they already have.

The local were kicked to the side at the Superdome when the mayor allowed the tourist to go to the head of the line for the buses, the mayor and governor wanted to hold back the appearance that Bush had helped and starved the Superdome crowd, and now they are taking away their only defense against the crooks and the cops (which at times are interchangeable)...

Any thinking African-American will look at this as the final genocide by Nagin and Blanco... The Dems have gone off the deep end.

If you want your city to look like New Orleans, Detroit, Newark, Chicago, Oakland, South Los Angeles, Overtown (Miami)... and of course Washington DC.....vote democrat.

Doncha know BROTHA's that it's the man keeping ya down........ but it ain't the white man in the Republican party..... but the black man who you trust that is sucking on the white man's nipple from the government t#t...

these poor people are now doing and have made the same mistake as the "Good German Jew" did..... trust the "man" to take care of them if they obeyed the "law" of gun control and believed in allegiance to the "state" as opposed to the individual rights that God gave them....

...don't worry it couldn't happen to you all, these are just stupid poor folk in New Orleans ..... that trusted "our people" in charge...like the Mayor, Governor and the cops..... ...... if I were an African-American in a Democratic controlled, gun-control city... I'd be looking on and very nervous..... who do you "trust"... if this goes down like it seems to be happening, Waco is going to look like a water balloon fight.

This violent forceable evacuation and seizing of a private citizen's firearm was done by jack-booted thugs imported from the Peoples Republic of Kalifornia (they were CHP). They made it look easy because she was a little old lady, AND, because they are quite used to running roughshod over their law-abiding citizens due to the Draconian anti-gun laws implemented by gun-grabbing, leftist, demonRAT politicians in that hell-hole of a state.

I heard, early on, that LA doesn't have that provison in their state lwas/constitution. From what I understand, they can, however, declare a state of emergency, but I don't think it is as far reaching as martial law.

It's a public health crisis. The city is oozing with bacteria off-the-charts, since the water is a festering, stinking mess containing all kinds of chemical contamination and raw, unprocessed sewage.

Add into the mix the fact that there is no infrastructure whatsoever, it simply is not realistic to expect to survive in New Orleans until the cleanup is done.

With those two factors - and the fact that it is an emergency zone under all but martial law - it's not hard to see why the Fourth and 2nd Amendments do not apply. The Fourth Amendment prohibits unreasonable search and seizure; it's eminently reasonable to expel people from a public health danger.

Even if this order has nothing to do with the gun grab one of the WHEREAS's needs to be envoked by these people!

La. Constitution Art. I, Section 22 provides that all courts shall be open, and every person shall have an adequate remedy by due process of law and justice, administered without denial, partiality, or unreasonable delay, for injury to him in his person, property, reputation, or other rights;


NOW THEREFORE I, KATHLEEN BABINEAUX BLANCO, Governor of the state of Louisiana, by virtue of the authority vested by the Constitution and laws of the state of Louisiana, do hereby order and direct as follows:

SECTION 1: All deadlines in legal proceedings, including liberative prescriptive and peremptive periods in all courts, administrative agencies, and boards are hereby suspended until at least September 25, 2005, including, but not limited to, any such deadlines set for in the following:

A. Louisiana Civil Code;
B. Louisiana Code of Civil Procedure;
C. La. R.S. Title 9, Civil Code Ancillaries;
D. La. R.S. Title 13, Courts and Judicial Procedure;
E. La. R.S. Title 23, Chapter 10, Worker=s Compensation;
F. La. R.S. Title 40, Chapter 5 Part XXI-A, Malpractice Liability for State Services; and
G. La. R.S. Title 40, Chapter 5, Part XXIII, Medical Malpractice.

SECTION 2: This Order is effective upon signature and shall apply retroactively from Monday, August 29, 2005, through Sunday, September 25, 2005, unless amended, modified, terminated, or rescinded by the governor, or terminated by operation of law prior to such time.

First of all I don't see that anyone has declared Marshall law. Secondly, I don't buy into this "health crisis" nonsense as the lady that was expelled from her home was not in any sense in any danger of being exposed to any bacteria that the soldiers and police did not drag into her home.

I could not help but notice that the thugs who took her down were not wearing any biological protective gear, which, if the city were as awash in dangerous bacterial elements one would expect everyone on the ground to be wearing.

The fourth amendment prohibits what was done to this lady. There is no constitutional exception that is applicable in this case.

There is something ugly going on in New Orleans. I don't buy into the excuses that are being promulgated to confiscate weapons and seize personal and real property of law abiding citizens. If this can happen in New Orleans it can happen in Buffalo.

NO. This order deals ONLY with the jurisdiction of the courts. It allows the courts to operate in other than their otherwise legal boundary areas. In other words, a court whose jurisdiction is Parish or district A, can now use a court building in Parish or district F.

Doubtful – I was about to post “can you say martial law”?, then decided to check and find out if New Orleans really is under martial law. It seems to be a case of a lot of people blowing smoke. I looked up several sources and they all had the same thing. Some officials say there is, others say there isn’t. It’s obvious that the local commander believes there is.
