THE RED, WHITE AND BLUE Business owner told to dump U.S. flags Stars and stripes in windows of shop violate city ordinance

A Florida business owner has been cited by the city of Orlando for displaying several U.S. flags in the windows of her office building – and a religious-freedom law group has gone to bat for her.

Orlando flag display in dispute.

According to a statement from Liberty Counsel, Nancy Maddox, the owner of Peacock Home Collection, has been targeted by Orlando's Code Enforcement Bureau because of the small flags hanging on the outside of 15 windows at her home furnishings company. The flags measure no larger than 34 ½ inches by 23 inches.

The daughter of a U.S. veteran who served in three wars, Maddox says she wanted to display the flags as a way to honor American military personnel. She says the flags are temporarily displayed on specific days, such as Independence Day, Memorial Day and September 11.

Liberty Counsel says the city has ordered the flag's immediate removal. A violation hearing is scheduled for Sept. 14.

The legal organization has contacted the city citing alleged procedural defects in the citation and warning that the sign ordinance used against Maddox is unconstitutional.

"I am astounded that the city of Orlando would reprimand anyone for displaying the American flag. We should encourage patriotism, not punish it," stated Mathew D. Staver, president and general counsel of Liberty Counsel.

Staver says if the city does not back down, Liberty Counsel will file a federal lawsuit on constitutional grounds.

NO!  Enough of this anti-American crap already.  This is America, dammit, and it is not a crime to fly the flag.  I have a flag pole in my yard and would just love to see any entity tell me to take the flag down ... won't happen.

i dont think this will ever stand up in court, if it even gets that far. i dont think even the 9th circuit court out in cali would restrict flying the US flag. citizens would be up in arms and the judges would have to sleep with one eye open.

Sometimes I wonder, after seeing images out of the New Orleans region the past two weeks. I swear, watching some of the video it did not appear to be in America.

The only dispute I have with the flags being flown are that, unless the picture is backwards, the flags are incorrectly displayed. The Stars ALWAYS, ALWAYS to in the upper left hand corner.

Other than that, she has every right to put them up. To be told she has to take them down, well...(shakin head)..

Dimwit. The mayor and some cronies were forced to stepdown for a few weeks as it looked as if they were going to be strung up for vote fraud. But the courts ruled otherwise. Used to be a Repulican office for the most part then too many New Yorker Cityers moved in.

Not always. The American Army's flag patch on the right shoulder is on the upper right. There was a big discussion at www.americasarmy.com in the forums.

THe federal directive says it is that way so it looks like a flag waving in the wind as the soldier moves forawrd. If the flag had the stars in the upper left it would look like he is retreating.

What makes you say that? Seriously. I mean the people didn't do much against a Florida judge that forcibly starved to death an innocent handicapped woman, so why would it be much different if a judge says someone can't display a flag? I would think that forced starvation would cause greater outrage and action among people than telling someone they have to remove a flag.

Don't get me wrong, I think it's total garbage if a judge would order that. But if a judge does do that and it is upheld, nothing will happen to change it; just as nothing was done about Terri Schiavo, Kelo eminent domain ruling, or any other of the odious judical rulings that have come down recently that would be far worse than this.

I just called the mayors office.

They say that this is not about flags but about signs that a permit fee was not paid on.

We need confirmation on this ASAP.

Who is lying?

Good luck to them if they attempt this.  I had a liberal neighbor mention my flag to me last year, we don't talk anymore.  I guess he didn't like me questioning his patriotism ... and manhood.

"They say that this is not about flags but about signs that a permit fee was not paid on."

Soooo.... The city won't let the store owner display the US flag because she didn't pay fees for some other signs?

Or... The city now considers the US flag a sign and you have to pay a fee to display it? Either way this doesn't sound right to me...

O.K. just got off the phone with the business manager at Peacock Home Collection.

This is about the flags. The line I was given by the mayors office is BS to cover their a$$. the "permit" deal was about streamers hanging outside SIX MONTHS AGO and according to the Manager they were taken down the next day.

The city is currently harassing the business about the display of the U.S. Flag.

Send a letter to Disney telling them that you won't be taking any trips to Orlando if this is how they behave down there. I'm sure Disney will gently straighten them out if they think it's going to risk their profits.

Hold it right there, this has nothing to do with Disney. No need to bring them into this. Disney proudly displays the American flag down here. In fact Disney does not even sit in the Orlando city limits.

I'm sure the Orlando Regional Chamber of Commerce ( http://www.orlando.org/ ) would love to hear from those who might be persuaded to forgo any future vacation or business trips to Orlando until this little misunderstanding is straightened out. ;-)

The state of FL passed a law which prevents condos and homeowner associations from preventing US flag displays.

I bet there are similar rules regarding any display.

This is stupid.

Interesting that this woould happen in one of the red areas of FL.

As a native of Orlando (moved away 15 years ago, although to a really red area of FL), I have seen Orlando become more and more homocentric and thus more blue. It's not the Orlando that I knew and grew up in.
