No charges filed in dog shooting

Anyone who has a concealed weapons permit knows it is extremely serious to use their gun anytime, against people, animals etc. It's not something that is ever done lightly. Look at the grief that it's bringing this guy.

I love dogs too but I give the shooter the benefit of the doubt. For everyone who says just learn how dogs behave, their dog would never do it, hold out their hand, don't act afraid, etc, we weren't there.

If this guy feared for his safety he was justified what he did. If he is a cowboy and has a history of this then that's different, but it's probably not the first time he's had a dog act aggressive towards him.

A large full size dog can do tremendous damage to an adult.

And yes the advice from law enforcement, attorneys and everyone else is never fire a warning shot against man or beast.

It's 2-year-old chocolate Labrador mix,

I've never seen a Labrador be aggressive at anything but play

The problem is, what's in the mix? I love labs and have several friends who have great ones that are big love bugs. For all we know this dog could have been half pit bull or some other agressive breed.

No one here has any idea what the nature and temperment of this dog was, or how it was raised or trained.

My problem is with posters that characterize the neighbor as some kind of trigger happy nutjob.

Chocolate Labs are friendly dogs. I'm sure some are mean tempered though.

I will guarantee I know more about firearms and have fired more rounds than most on this site, and yes, against an animal a warning shot is as effective deterrent as opposed to killing someones pet who slipped his leash and is lose. This isn't an armed criminal who can respond in kind, its a dog who's fight or flight instincts will take over and unless trained not to will probably run like hell at a firearm discharging into its face.
Which is safer, a round fired into a grass lawn or a round fired int a bony head, do it 100 times and tell me which is more likely to ricochet into a home or towards someone. This guy was in his right to shoot this animal if he genuinely was in fear of being bit, and it is hard to tell from the article if he had other options, the type of neighborhood he was in and how much time he had to react.
I scare roaming dogs off my property all the time, it has never taken more than 1 shot to send them running, I don't want to kill someones pet who got lose because my dogs have roamed before when they slip out without being seen, I would hate like hell to have someone kill him for barking at them unless they truly thought he was vicious.

Where did you fire all these rounds at? A shooting range perhaps? When you are in real world situations and are being attacked by man or beast you simply DO NOT FIRE WARNING SHOTS!!! As I have said before too many things can and will and have gone wrong with this practice. Law enforcement learned along time ago and it is common knowledge that you JUST DON'T DO IT! Too many innocent people have been hurt or killed because of warning shots. You are right when you say a boney skull of an animal can cause the bullet to deflect and ricochet to places unknown but this is the chance you have to take when defending yourself, but you don't take a chance of this happening with a warning shot SORRY...The only person at fault here is the owner period!

I suppose the problem is nobody knows what was in his mind.
Allot of people are fanatical about their animal's.
They don't give the age of the shooter, I'd feel better about it if it turned out to be an older man

Dogs I have come across would chew your hand off and then start on your b@lls if you stuck your hand out and said "here now nice little puppy it's ok run back to mama now" HA HA! Mankind never ceases to amaze me.
So what your saying is every dog that charges you will just merrily go on his way after you have soothed him and stroked him a few times.
You must not get much jogging done if you have to stop at every barking dog and sooth and comfort them in their moment of " doing what dogs are supposed to do"
Dogs are not supposed to charge at pedestrians or anyone else near their front yard barking and snarling. This is the sign of an illbehaved dog not a good boy just doing his job. His job is to alert his master if someone is trying to break in the house or attack anyone trying to harm them not a jogger or a postman or schoolchildren walking by.
It is the job of the master to teach the animal the difference between threats and normal activity in a residential neighborhood.
It would be different if this dog was on a 2 acre parcel of land on a dirt road with no neighbors homes in sight but this sounds like a neighborhood in a residential area with sidewalks and schoolchildren nearby.
This animal sounds like it wasn't trained properly or is just dumb. Some dogs are just dumb and will bark and charge at anything they see.
This is the outcome of poor training and poor discipline and poor control by the pet owner.
By your logic a person who means to do me harm can approach my yard and when my dog charges him all he has to do is extend a warm smile, a soothing voice, and pet him a few times then proceed to rob and rape or kill me after the dog has been fooled into a false sense of security.
I'm sorry but me thinks you have not been exposed to a truly mean dog on your little jogging adventures.
The main reason I have a dog and I thought the reason most people have a dog is for companionship not for security detail of the front yard.
Dogs need to be taught early that they and their owners are not the only living creatures on this earth that have a right to the public streets and front yards in the proximity and that other dogs and humans have just as much right being near or even on their property (electric meter reader,water meter reader, catv guy, phoneman etc. you get the idea) unless of course they are out in the boonies.
I still say this was more than likely a dumb dog with a dumb owner and believe me there are many of them out there.
The guy putting out fliers telling neighbors that a legal citizen armed and carrying a concealed permit and shooting a threat presented to him because of this pet owners negligence tells me that he is a moron.

I read the article from your link and I can tell you why the man has not been charged and never will be. If you read the story it clearly states that a group of men or boys had an altercation with one man.

Anytime you are approached and threatened by 2 or more people and you are alone and you fear harm may come to you, you are within your rights to shoot to kill.

It's easy to play monday morning quarterback and say coulda shoulda woulda but when you are faced with an angry mob or a group as the news article called it you have a good reason to fear for your life.

All it takes is one good kick or punch to the head and you could die or be brain damaged for life.

The problem with young men these days are they think they can play tough guy like they see on tv or MTV or the computer and then they run across someone like this guy who considers his life valuable enough not to take chances that may result in his death.

Also it says that the group of men were just trying to disarm him after he displayed the gun in his waistband.

A word of advise to all: never try to disarm any man no matter how noble the cause unless you are willing to get shot!

I'm sorry but that is very stupid. The best thing they could have done was get in there car and leave. This outcome doesn't surprise me at all.

By the way I'm not ranting at you or saying you are wrong about any of this I am just responding to the story on your link.

It just amazes me how stupid people can be.

To get shot and killed over a parking spot if that is indeed the reason seems very stupid.

Anyone who shoots my dog is really going to have to defend himself. I'll make my business to see that he has to defend himself, from me!

I understand, and I love my dog.... BUT NO DOG SHOULD BE AT LARGE roaming the neighborhood. It's all of our responsibility to fence our dogs.

I had to hit one with a broom handle several times before he even realized he was hit. That dog adrenline keeps them going. And yes, I am working with them, training wise. They are just two big males from the same litter, and each wants to be top dog.

Neutering them both will be necessary to living together if they are this aggressive.

You are oh so right. My dog is large and some people might be afraid of him. Harm barks to alert me that someone is there and checks them out. He has never bitten or growled at anyone. Well, he did pin a guy against my foyer wall, but he deserved it.

I think that man should have called to the owner if the owner was in sight. Otherwise, if he was that scared and decided to use the gun, he could have fired over his head and scared the dog away. There was no need to shoot it in the head.

If someone shot my dog, he better run pretty fast. My SUV goes from 0-60 in less than a minute and I would be in pursuit!

The repair men who come to my house are never afraid of Harm, who is an 85 pound Malamute/Husky /Lab cross. They say the ones to watch out for are the small dogs.

If I lived in that neighborhood, I would certainly want to know that there was someone there who would shoot my dog if Harm barked at him.

However, I do live in the Boonies. I have no neighbor who can see my house. I am a widow. My dog has never hurt anyone, but he would protect me with his life. He always stands between me and any strange man who comes to my door.

This does not sound like a dangerous dog to me. Most dogs, when in serious pain, will bite. My late husband tried to pick up his sheltie when it had been mauled. Teddy bit him really badly on the hand. Teddy adored my husband and never would have done such a thing had he not been in extreme pain.

Just because he was happy to see his owner doesn't mean he did not look threatening to a stranger walking. Dogs should not be loose to harrass passer's by. They should be fenced. For their own safety, and to respect others.

In cities, yes. I agree. However, not on my land. I lock my dogs in the house if I run out to the store. Otherwise, they are free to go out the pet door.
