Ronnie Earle is the first county official to take that power to go after federal officials. I think he's going to get squished like a bug, and the Texas Constitution is going to be amended.
This power is enable via legislation or the Constitution, I don't remember which that allows him to have proscuting jurisdiction over the federal elected officals. There has been talk in the past that it should be removed from the Travis Cty DA and placed in the hands of the State Attorney General. I suspect that will come now that the Republicans have control of the state House/Senate.

Tom Delay does have civil rights, and they have been violated. Do you have any authority for this statement?
There will be no political trial of Tom Delay in Texas
It looks to me like there will be a trial. I've looked at the charges and I doubt they will be dismissed. Can Ronnie Earle prove conspiracy on DeLay's part? Who knows, at this point I doubt it. But from what I can tell, the indictments survive a motion to dismiss.
