FNC (Gibson) reports DeLay's lawyer just filed a motion charging Earle with prosecutorial abuse. If proven it could result in the dismissal of the indictments.

The judge who was with Gibby kind of gave an exclaimation when Gibby mentioned it.
The Judge said that it sounds like Earle either did not tell the GJ everything. (hard to do with a GJ that meets for less than 4 hours) or it gave misinformation to the GJ.
