Petition for the Withdrawal of the Nomination of Harriet Miers to the U.S. Supreme Court

WE ARE REPUBLICANS AND CONSERVATIVES who supported the election of George W. Bush in 2000 and 2004. Today, we respectfully urge that the nomination of Harriet Miers to the United States Supreme Court be withdrawn.

The next justice of the Supreme Court should be a person of clear, consistent, and unashamed conservative judicial philosophy.

The next justice should be a person of unquestioned personal and political independence.

The next justice should be someone who has demonstrated a deep engagement in the constitutional issues that regularly come before the Supreme Court — and an appreciation of the originalist perspective on those issues.

The next justice should be a person of the highest standard of intellectual and legal excellence.

For all Harriet Miers. many fine qualities and genuine achievements, we the undersigned believe that she is not that person. An attempt to push her nomination through the Senate will only split the Republican party, damage the Bush presidency, and cast doubts upon the Court itself.

Sometimes Americans elect Republican presidents, sometimes we elect Democratic presidents. Whatever the differences between the parties, surely we can at least agree on this: Each party owes America its best. There is a wide range of truly outstanding legal talents who share the president’s judicial philosophy. We believe that on second thought President Bush can do better — for conservatism, for the Supreme Court, for America.

I think this nomination is bad news for the Republic (the country, our form of government) and for the GOP - but at some point you have to let the kid make its own mistakes.

I don't support trying to influence the GOP with this "public petition mechanism." Frums is free to express his thoughts, but he should be content to leave it at that.

I don't see why people aren't entitled to say that she just isn't up to the job before the hearings start. After they are over will be too late.

Besides which, unless she has some sort of skeleton in her closet which detectives from the DNC manage to ferret out, the hearings are unlikely to reveal much of anything. The senators from both sides will pose for the cameras and make their usual fatuous comments, and if Miers has any brains at all (which I believe she has) she will refuse to answer any leading questions. So, where will that leave us? Right where we are now, but with Miers possibly confirmed. Those of us who think she should not have been nominated have no choice but to speak up now.

If judical conservatism can't win on the merits (be overt) now, what makes you think it can win on the merits with the next vacancy?

Frum's gone over the edge. I am not thrilled with this nominee for many reasons- and am not inclined to support the choice- regardless of the reason it was made.

But I am ashamed to watch this orgy of gleeful hatred directed at this president. It is one thing to take a stand on principle- it is another to do so in a way that demeans everyone who differs.

The NRO ought to know better.

Except fo the Republicans part, I agree with this 100%.

This includes the respectfully part. None of us on the anti side should be attacking the nominee personally. Heck I won't even attack the POTUS personally, but I will disagree with him when I feel he is wrong and I don't care who likes it or not!

Harriet Miers will be on the SC by Thanksgiving, Tom Delay will be leading the House by 2006 and all of the bitchen and moanen will be forgotten....... Tough sh*t for all you whiners. As the Aussies say, "piss off".

I'm not playing any role. I'm merely posting what I thought was an interesting development; my comment didn't take sides. I wanted to point out that the sides were moving further apart and hardening their positions. I don't like to see that happening.

These "conservatives" with all their concern for the Constitution want to short circuit it's provisions, like a bunch of seditious students!

There's nothing unconstitutional about withdrawing a nomination. Nice try, though.

To withdrawn is a sign of weakness. President Bush is our friend and I trust him. I guess, I am old-fashion, but I think loyalty and allegiance to him is a good thing. Our fellow posters need to know that our President is a force for good in the world, extending hope and freedom to others. A little loyalty, in the face of all the world's criticism of President Bush, is good thing.
