WASHINGTON (Reuters) - The chance of a filibuster to halt the Supreme Court nomination of Judge Samuel Alito rose on news he once opposed 1960s Supreme Court rulings on reapportionment based on the principle of equal voting rights, a top Democrat on the Senate judiciary panel said on Sunday.
Sen. Joseph Biden, a Democrat from Delaware, told Fox News Sunday that a decision by Democrats to filibuster would depend largely on Alito's answers during judiciary committee questioning scheduled for January.
Prior to the Warren court's decisions, some state legislators were elected on a geographical basis, giving thinly populated rural areas more political heft than urban centers.
"If he really believes that reapportionment is a questionable decision -- that is, the idea of Baker vs. Carr, one man, one vote -- then clearly, clearly, you'll find a lot of people, including me, willing to do whatever they can to keep him off the court. We don't know that. We have to hear it," Biden said. "That would include a filibuster if need be."
Asked if this increased the chances of a filibuster, Biden said: "Well, I think based upon that job application where he said he strongly held these views, yes."
No, Boxer is the dumbest hobbit in the Senate.
The idiot GOPers in the Senate didn't learn the lesson of the recent California election: giving your opponents the time to smear you is a big mistake. Arnold should have acted immediately, when his popularity was high. Likewise, the Senate shouldn't have put off the Alito hearings until January. It'll give the Democrats precious time in which to portray him as a monster bent on taking the nation back to Jim Crow, segregation, and pre-sufferage.
The democraps were planning to filibuster PRIOR to his being named. No surprise that the party of gloom, dispair and tragedy with NO PLAN has to defuggle the repubis to get TV time. They can't live on lies alone!
In his dreams !!!!!!!!!!!!!!!!!!!!!!!!!!!!
Well "thank" you very much Scottish Law. (feel free to substitute a 4-letter word that starts with an "F" for "thank")
I thought Biden would have got the message the first time. Good tagline!
Baker v. Carr didn't even deal with one-man-one-vote per se. It dealt with who gets to draw district lines. Historically, that was (and still is) done by state legislatures. Prior to the Warren Court, the Political Question Doctrine (that's a doctrine saying that the Supreme Court should stay out of stuff that the legislatures should be dealing with) kept the judiciary out of the issue.
Either side of this particular issue is actually tenable; someone has to draw those lines, and it might be a good idea to have the courts as a backup in the case of gerrymandering. But Biden mischaracterized the living breathing hell out of what Alito's position was. Alito said that the courts should simply stay out of it, because an abusive court can be just as dangerous, if not more so, than an abusive legislature.
Biden translates this to mean opposition to the principle of one man, one vote.
After making the RATS on record by voting for bringing the troops home, and seeing how they all chickened out, nuking them finally AND SHUTTING THEM UP,would be a sweet ending to the year. Too bad we have to wait for them to come back from vacation to do it!Go for it RATS!
You know, considering their retirement benefits, why DON'T they retire?
Ah yes, they wore out their welcome in "red" states and have to maintain power (for example: Byrd)
Exactly. republicans allow themselves to be put into the position of having to prove a negative.
When DIMs make outrageous charges they should publicly state that the DIMs must prove those charges. Never appear on the defensive.
Don't say stuff like "whine...it's unfair to say awful things like that....it's so partisan".
Say this: "Those charges are absolute hooey. Put up or shut up. We don't have to disprove them, you have to prove them."
Matter of fact, pubbies should be launching preemptive strikes that say, over and over, how the DIMs are going to lie and smear because they have no case.
If the Republicans haven't been buoyed by the recent public reaction to their decision to have a vote on immediate withdrawal from Iraq, they're hopeless.
If the Dems filibuster Alito, the Repubs will have another chance to show that they have a pair. If they don't, the public will soon forget the brilliance they showed this week in the Iraq vote. Let's see how short their memories are, or whether they give a damn about the opinions of those who put them where they are.
Joe's coming Presidential speech: "Four score and seven years ago, our fathers set....
"How do I love thee?
Let me count some ways......................
Biden: OK OK, I was deeply influenced by Browning's work!
Someone please explain to me why a person is an extremist when they consider the murder of a baby to be wrong, but if you support the right to murder babies, you're "normal".
What slugs dems are - Janet Reno believes in legalized prostitution, lowering the age of consent to 12 etc...she was confirmed.
This is the country we get when we have a spinless GOP and slimeball dems running it.
And if I remember correctly he denied it and denied it and denied it. Then they played the video tape. Burned badly.
Post# 66 will be next........Joe's Poetry Corner : )
It was funnier than heck....then he claimed he was a good student in law school, so some conserv looked it up, and he was next to the bottom...........
Biden said: "Well you know what they say; the A students teach, and the B students go to work for the C students"
Yeah sure, Joe....sure......
Hey Biden! Last time I checked, liberal judicial activism violates the principle of "one man, one vote". Since you claim to support that principle, I'm sure you'll join us in demanding that the people (rather than unelected judges) should decide the legality of abortion, voluntary school prayer, and gay "marriage". I also expect you to resign, since the very existence of the U.S. Senate violates the "one man, one vote" principle.
What Rat apparatchik isn't a crazy socialist perverted baby killing traitorous unAmerican yellow bellied crook anyways?.
We are fighting the ragheads abroad and the Democrats at home.
THE DEMOCRATIC PARTY IS ALLIED WITH THE ISLAMIC HOARDE.
Amen, brother! And I for one would like to hang a few Dims for Treason!
Ah, the Spectre delay tactic is working!
S. 9 (Daschle, Leahy, Biden, Kennedy, Torricelli, Schumer, Dorgan, Kerry, Lautenberg, Mikulski, Breaux, Durbin, Bingaman, Bryan, Moynihan): This is the Democratic version of the juvenile justice bill. It is an encyclopedia of anti-gun provisions. Some of them include:
section 1411, which would impose a lifetime gun ban on virtually anyone caught experimenting with drugs as a child;
imposing a mandatory minimum five-year prison sentence on a person who commits a crime of violence (including threatening to damage property) while "possessing" a firearm (arguably, the firearm does not need to be at the scene of the threat) (section 1413);
imposing a five-year prison sentence for inadvertently violating the labyrinthine rules for training a juvenile to use a handgun (section 1414); creating an across-the-board penalty for "conspiracy" to commit a firearms offense (section 1417);
establishing "juvenile gun courts," while providing no comparable special attention for crimes like murder, rape, etc. (section 1431 et seq.).
I don't have the time or the bandwidth to research the anti-gun salvos fired by Senator Biden in his career, along with his usual suspect partners. He is driven to disarm Americans for some purpose. Constitution be damned.
Obviously BUSH is not giveing them enough other things to think about.. What could be more important .?. A major FBI investigation on massive voter fraud.. on election of federal office holders..
As Ronald Reagan used to say, "Make my day." DemoRats will dig themselves an even deeper hole. Great!
And never did anything worthwhile. Couldn't tell shit from shinola. Still can't. He's the epitome of the rich political dorkhead.
"He is driven to disarm Americans for some purpose. Constitution be damned."
Maybe he figures they will go after him?
Bring it on - I for one would like to see the "Constitutional Option" enacted for Presidential nomination Senate consent. Leave the filibuster for legislation, but I don't think it should be a weapon for either side on Presidential nominations. That's my opinion.
Amen to that!
Yeah, and he has hay for hair too!!
Does anyone know Biden's I.Q.? Does the scale go that low?
ROTF.....I second the emotion!
Well, an idiot is 80 according to Stanford-Benet.....so? : )
Well, I guess he's still brighter than Bill Bradley - he was rumored to be the dumbest man in the Senate. I guess Biden is just one step up.
(I thought all Democrats were idiots.)
And Biden's propensity for plagiarism should be a cause for removing him for the senate. A liar and cheat does not deserve to be pointing fingers at others.
"(I thought all Democrats were idiots.)"
They might as well be. When you lack the ability to reason your way out of a small brown paper bag....well....... It must be hard to stare reality in the face and deny its there : )
"And Biden's propensity for plagiarism should be a cause for removing him for the senate."
Boxer and her 425 bounced checks to the House Bank......you and I would do 3-5 years for this!
Speaking of Biden's plagiarism here is a book by Theo Pappas that exposes all the dems who just can't leave others' writing alone but need to appropriate it for themselves without referencing!
Thanks much. Looks like a "must read"
I have not read it yet either. I plan to get it for reading over Xmas.
If you get the chance read the comments at Amazon - a blast!
I have been trying to learn Alito's actual view on the duplicate thread, but so far I haven't been able to figure it out. Could you be more specific as to why Alito would be against equal apportionment? Is there a case, or other writing that makes his view known?
