WASHINGTON (Reuters) - The chance of a filibuster to halt the Supreme Court nomination of Judge Samuel Alito rose on news he once opposed 1960s Supreme Court rulings on reapportionment based on the principle of equal voting rights, a top Democrat on the Senate judiciary panel said on Sunday.
Sen. Joseph Biden, a Democrat from Delaware, told Fox News Sunday that a decision by Democrats to filibuster would depend largely on Alito's answers during judiciary committee questioning scheduled for January.
Prior to the Warren court's decisions, some state legislators were elected on a geographical basis, giving thinly populated rural areas more political heft than urban centers.
"If he really believes that reapportionment is a questionable decision -- that is, the idea of Baker vs. Carr, one man, one vote -- then clearly, clearly, you'll find a lot of people, including me, willing to do whatever they can to keep him off the court. We don't know that. We have to hear it," Biden said. "That would include a filibuster if need be."
Asked if this increased the chances of a filibuster, Biden said: "Well, I think based upon that job application where he said he strongly held these views, yes."

The idiot GOPers in the Senate didn't learn the lesson of the recent California election: giving your opponents the time to smear you is a big mistake. Arnold should have acted immediately, when his popularity was high. Likewise, the Senate shouldn't have put off the Alito hearings until January. It'll give the Democrats precious time in which to portray him as a monster bent on taking the nation back to Jim Crow, segregation, and pre-sufferage.
The democraps were planning to filibuster PRIOR to his being named. No surprise that the party of gloom, dispair and tragedy with NO PLAN has to defuggle the repubis to get TV time. They can't live on lies alone!

Baker v. Carr didn't even deal with one-man-one-vote per se. It dealt with who gets to draw district lines. Historically, that was (and still is) done by state legislatures. Prior to the Warren Court, the Political Question Doctrine (that's a doctrine saying that the Supreme Court should stay out of stuff that the legislatures should be dealing with) kept the judiciary out of the issue.
Either side of this particular issue is actually tenable; someone has to draw those lines, and it might be a good idea to have the courts as a backup in the case of gerrymandering. But Biden mischaracterized the living breathing hell out of what Alito's position was. Alito said that the courts should simply stay out of it, because an abusive court can be just as dangerous, if not more so, than an abusive legislature.
Biden translates this to mean opposition to the principle of one man, one vote.
After making the RATS on record by voting for bringing the troops home, and seeing how they all chickened out, nuking them finally AND SHUTTING THEM UP,would be a sweet ending to the year. Too bad we have to wait for them to come back from vacation to do it!Go for it RATS!
