I disagree with your interpretation. Using your logic, anything Barbara Streisand says cannot be repeated by any publication.

There is something about a person being a public figure that exempts him from what you claim is his right to copy write protection. According to you any politician need only claim any and all he says may not be reproduced without his permission. This would immediately have the effect of them not ever being held accountable by the media or the other Party for anything he says.

Okay I am down to post 49 and you keep spouting off your knowledge of the laws about this subject. Several others have posted material backing their position but you have not posted one single thing backing yours except your own statements. How 'bout you posting something from your law books or what ever you have that you are basing your positions on. In clearer terms, put your money where your mouth is. Up until now you are doing what Ward Churchill does, spouting off with no backing. Make us look bad with some REAL documentation.

I think 14erClimb and veronica posted something that Crowell also noted: *tangible form.* If Churchill records ("tangible form") all of his speeches, and then registers them, he can sue. Otherwise, he's stuck. He can't just prattle on and say it's copyrighted.

But them I'm not a lawyer. Are you? Is ANYONE posting here? Law isn't for amateurs, I have friends who are attorneys (yeah I know so does everyone else) and what is obvious to an amateur isn't necessarily the way it is in court. And your Constitutional provision refers to *writings and discoveries* not *speaking*.

I am NOT a copyright attorney, but my understanding is that the "any tagible medium of expression," includes giving a speech.

"speech, in and of itself," means freedom of speech, not the right to plagarize.

Copyright generally is based on HOW MUCH of what is written, recorded, given in a speech, etc. is used without the permission of the author. The bottom line is whether you use so much of another person's material that you deny him the right to make money from it.

I think perhaps our thread poster misunderstood his attorney's advice, but I WISH HIM THE GREATEST GOOD LUCK in his duel with Churchill.

If any copyright attorney would care to comment, I would be delighted to discover that I am wrong.
