Second Reporter Asked to Testify on Leak

WASHINGTON -- A second Time magazine reporter has been asked to testify in the CIA leak case, this time about her discussions with Karl Rove's attorney, a sign that prosecutors are still exploring charges against the White House aide.

Viveca Novak, a reporter in Time's Washington bureau, is cooperating with Special Counsel Patrick Fitzgerald, who is investigating the leak of CIA operative Valerie Plame's identity in 2003, the magazine reported in its Dec. 5 issue.

Novak specifically has been asked to testify under oath about conversations she had with Rove attorney Robert Luskin starting in May 2004, the magazine reported.

Novak, part of a team tracking the CIA case for Time, has written or contributed to articles quoting Luskin that characterized the nature of what was said between Rove and Matthew Cooper, the first Time reporter who testified in the case in July.

A grand jury indicted I. Lewis "Scooter" Libby, Vice President Dick Cheney's former chief of staff, on perjury and obstruction charges on Oct. 28. Fitzgerald said in court papers earlier this month that he will present additional evidence to another grand jury.

Understand that we're talking about conversations that occurred almost a year after Plame's name was published, six months after Fitzgerald began his investigation. And we're talking about conversations with Rove's attorney, not Rove himself.

What the hell is Fitzgerald fishing for now?

Fitzgerald is braindead. This story has no legs, and Fitzgerald is passe. He's about as dumb as one can come. Boring!!! Libby's lawyers will him do in, with no need. He'll do a fine job on himself. The real criminals and traitors are Valerie Plame and Joe Wilson!!! The truth will opt!!!

He's still ignoring all the facts, some of which are pretty glaring, and going on a fishing expedition.

At this point, I hope everyone in the administration has been told to plead the Fifth Amendment and refuse to give him any more testimony, because there's no other way to avoid some minor verbal contradiction that could lead to another indictment.

By the way, exactly who in the Justice Department renewed this clown's lease?

Trying to use Rove's lawyer's statements to a reporter to impeach Rove's testimony to Fitzmas and the GJ. Try to indict Rove.

I will be hard to get Rove's lawyer to turn on Rove though. Lawyers are not required to tell the truth to reporters.

Precisely. Such a conversation has exactly zero bearing on what Rove testified in court.

Rove could have testified before the GJ that "The sky is blue" and Luskin could have told Novak that Rove actually claimed "The sky is falling". But a reporter is not an officer of the court and the attorney is not under oath.

Smells of wild goose chase...

Actually, I don't know what the heck I'm talking about but I thought a stupid baseball analogy was in order.

I'm beginning to think Fitzgerald is an idiot. He's botched the case and can only redeem himself by getting Rove.

And how do we know that the little time reporter isn't helping Rove, oh, that's right.

I find this statement to be odious. Valerie was not covert. Thus, she was not outted. Fitzgerald brought charges for obstruction and perjury, not outting. The next thing we know, another unnamed insider is talking to SpecPros about an earlier knowledge (as reported).

Is it not possible that the charges against Libby are a sting operation to identify the mole in the White House and CIA, as well as their reporter sources?

Even if Libby can't save his own ass in his trial, his team needs to get Wilson, Mitchell, Cooper et al on the stand so that the core truth of what was happening gets out. Wilson's lies need to be exposed, as does the complicity in the media throughout this entire affair. And as far as I'm concerned, Fitz is now fair game; Libby's lawyers need to undermine his credibility, his utter lack of concern about the core fact that started this whole thing - the lies of Joseph Wilson. Libby's team needs to portray Fitz as a willing pawn of the Wilson lie machine.

The further this whole thing goes, the less impressed I am with Fitz. He is gong after minutiae and seems oblivious to the big picture, a classic example of not seeing the forest for the trees. And now his ego is entering into the picture; he is clearly warming to the role of media hero, and he's fishing for anything he can get.

They need to be careful about that; the press will jump all over that. But as I said in another post, Libby's team should discuss the possibility of attacking Fitz's credibility. They need to fight this on more than the factual level, but on the moral level. They need to change the context of the entire story line. They need to show that Libby was defending the truth, that Wilson was the big liar who started all this, and that Fitz is now aiding and abetting Wilson. Libby's team needs to portray Fitz as defending the BIG LIE of Joseph Wilson.

Voters are complaining in droves about Fitzmas. My congressman said they are getting many calls calling for Fitz's head. I believe Libby's lawyers will be doing as you say from things I've been reading. Woodward has decimated Fitz's case whatever it is.

Libby's team needs to play on the Woodward thing and the Mitchell thing, to show that memories and public statements of other key players are inconsistent, so as to relativize Libby's inconsistencies and make them appear plausible as memory lapses. And they need to highlight Wilson's lies. They need to undermine the MORAL basis of the charges, to show that Libby was no more culpable than many players who weren't charged with anything. They need to portray the charges as UNFAIR, even if technically true.

To clarify one point: Libby's team should not explicitly concede that the charges are technically true but unfair; they should highlight the unfairness, and hope that for the jury this overrides the factuality of the charges. And at the same time, they should do whatever they can to make the technical charges ambiguous and less than certain.

I am thinking some Demrat is threatening his family; or maybe holding a family member hostage. . .what else could make him push this dog and poney show?

ALL he has to do, is keep the 'scandal'. . . well, keep it a 'scandal' and one for Bush to deal with; . .a Repub 'scandal' to report on; keep in the news; NO MATTER WHAT. His Father's ear in the mail. . .a cousins?

The truth of the Dems is not up for public scrutiny or debate; period. And what better way to keep them out of 'harms way'.

This is such phoney-baloney; you would think that even Fitz has his limits. . .the needle is well past embarrassing on the truth meter. But then, ears are important. . .and so if family.

Fitzgerald has Novak's source and Woodward's source. This is a totally new turn because it's about Cooper.

Remember a couple of things....Cooper called Rove on July 11th and ASKED Rove about Valerie which means Cooper knew "something" beforehand otherwise the question couldn't exist.

Cooper called Libby on July 12th and pulled the same "sneaky question" bit.

Now why in the world would Libby OR ROVE give info to a Dem Operative like Cooper??? I'm sure Rove and Libby know he's married to Mandy Grunwald, Hillary's best friend, MEDIA manager and likely her "secret" campaign manager.

Cooper said Libby was not his first source AND that he was surprised that Libby was charged because of his (Cooper's) testimony.

Let's see how this chick is connected to Hillary and Grunwald!!!

Fitzgerald is looking for an out!!

When the Woodward story broke, I said Fitzgerald looked dum. I also said he has a big ego and that his reaction would be to indict somebody else. He's only interested in indicting people in the White House no matter where the truth leads him. I wish the President would stop giving him credibility because he doesn't deserve it.

RATS must be fairly confident that Bush is coming down (through impeachment or some other devious method). Hear a lot of veiled threats toward Bush (non-impeachment variety) lately on Errhead America. The vitriol is ratcheting up every time RATS have to take a step backward on the impeachment march.

Unfortunately, history shows that it'll only take one NYT article accusing them of trying to cover for the administration to send the GOP congressmen and senators sprinting for the tall grass with their tails between their legs.

Luskin, by the time he talked to Time's Novak, was in full client protection mode. It's hard to imagine anything damaging he might have said.

I think it's not entirely outside the realm of possibility that Fitzgerald was rankled by the mild triumphalism that emanated from the West Wing when Rove was not indicted with Libby, and now, especially after the Woodward revelations have muddied his timeline vis-a-vis Libby, just for spite, he wants to rattle Karl's cage a little.

But has he got anything really new on Rove? I seriously doubt it.
