SARASOTA, Fla. - Joseph Smith should be executed for kidnapping, raping and murdering Carlie Brucia, the 11-year-old girl whose abduction was captured by a surveillance camera and broadcast around the world, a jury recommended Thursday.
Jurors deliberated five hours before arriving at their recommendation, voting 10-2 for the death penalty. Circuit Judge Andrew Owens ultimately will issue the sentence, as early as next month. Under the law, he must give great weight to the jury's choice before imposing a sentence of death or life in prison without parole.
This is the same state that killed Terri. One can only hope it's a better judge.

What is the death row wait in FL?
Ping me in 2016 and we'll celebrate when this pos dies finally.
Didn't Tookie wait 24 years?
OK, Ben ... I'm with you. :)
How in hell could there be two jurors refuse to execute this bastard..
He was FILMED taking the girl....
He told where the body could be found..
There is no question of his guilt....
In a just world - they would fry the two jurors with him...

USA avg
I can't imagaine that there is any question about the punishment he deserves! Good grief--draw and quarter him immediately!
Which celebrities will be protesting to save him?
The state did not kill terri.

There just isn't any "celebrity" appeal.
Technically, some dotor did the deed. The state is much to blame.
I thought it was Terri that did not want to live that way.
Won't happen. But just remember that this was an Eleven year old girl who had no chance once this POS grabbed her arm!
The earth is soiled by his continued presence.
A doctor killed Terri through Michael's exploitation of state policy. She left scant evidence of her own wishes.
It's time for Ol' Sparky to come out of retirement, and fry this creep like that one dude in "The Green Mile," in which the skull cap was dry.
Just think. This lucky guy's name will go in the hat to be heralded by the Liberal MSM as being the star of the 2000th execution! It could happen with the appeals and all.
Scant???
The judge stated he had "clear and convincing evidence" as to Terri's wishes, as told to him in sworn testimony by three different people when relating three different occassions.
The doctor allowed Terri to die by removing the surgically implanted feeding tube.
Take your propaganda elsewhere.
So two jurors think kidnapping, raping and killing is OK? Those two jurors are evil!
They feel they have the right to see her battered body.
DAMN THE MEDIA TO HELL FOR ALL TIME
? Think again.
Hell, he's still room temp, and has an "important meeting" with the governor this coming Tuesday!
"Ping me in 2016 and we'll celebrate when this pos dies finally."
11 years from now?!?!?! By the standards in place that would mean he is on a fast track.
She shoulda had it in writing...I think that's Steve's point.
Tookie won't be there, only his attorneys.
After rethinking, I've concluded that Terri that did not want to live that way.
Average 12.74 years.
It doesn't have to be unanimous for death penalty verdicts?
Just because they thought execution was inappropriate in this case does not mean they condone his acts. There's no need to stretch the truth, here.
Fortunately, your thoughts and mine are meaningless where the willful termination of a third party is concerned.
Most legislators agree Florida should abandon its 75-year reliance on the electric chair as the state's sole means of capital punishment. But the 3-day session may become bogged down by Gov. Jeb Bush's demand that lawmakers also shorten the appeals process for condemned inmates, who now spend an average 14 years on death row.
Good, it makes me sick to think of that poor little girl
So soon?
I knew the 70's were good for something...
If the state of florida would like to supply me a round trip plane ticket and a 1911 pistol, I'm willing to show up and do the job for them. I'll even supply my own ammo.
(note: I'd like to keep the 1911, though).
I agree. Those two jurors are the kind of enablers who allow pieces of dogcrap like Smith to do what they do. Those two scumbag jurors are culpable and should die with him.
MSM teases the verdict for the 11 PM news but who can wait that long when you know the answer is on FR!
Well....see....he was addicted to drugs. He had a back injury and was addicted to painkillers. And, when he was born, he had a cone head and 2 black eyes. And he had just lost his job and his wife had kicked him out. And when he was young, he helped his aunt make meatballs and drew her a pic of a rose and his old prom date testified that he was sweet and taught her to play pool and his barber likes him. And his addictionologist doctor loves him...she told him so last time she visited him in jail. And he's a very good mechanic and can fix roofs. whew
See?
Criminal verdicts must be unanimous. Jury recommendation at penalty phase is by majority.
Really now. I heard different.
"Statements which Terri Schiavo made which do support the relief sought by her surrogate (Petitioner/Guardian) include statements to him prompted by her grandmother being in intensive care that if she was ever a burden she would not want to live like that. Additionally, statements made to Michael Schiavo which were prompted by something on television regarding people on life support that she would not want [a] life like that also reflect her intention in this particular situation. Also the statements she made in the presence of Scott Schiavo at the funeral luncheon for his grandmother that "if I ever go like that just let me go. Don't leave me there. I don't want to be kept alive on a machine" and to Joan Schiavo following a television movie in which a man following an accident was in a coma to the effect that she wanted it stated in her will that she would want the tubes and everything taken out if that happened to her are likewise reflective of this intent."
"The court specifically finds that these statements are Terri Schiavo's oral declarations concerning her intention as to what she would want done under the present circumstances and the testimony regarding such oral declarations is reliable, is creditable and rises to the level of clear and convincing evidence to this court."
Your information is crap.
There's no shortage of those in Sarasota. I know, I used to live there.
Actually, according to terri's family, who are just as if not more reliable since they had no ulterior motives tat are apparent, she had never made ANY comments regardng that. I feel in a case such as this, where her parents were willing to take care of her, and since she had made no living will or any kind of formal declaration, they should have erred on the side of life.
If you have an opinion on things like that, have a living will, and make it official. I've had my living will since I was 19.
