I don't see the problem. She was naked in public view - that's fair game. Some would think that 300 yards would be sufficient to avoid arousing prurient interest. I see her point (so to speak) if the guy is stalking her with a freaking 1000mm lens.

The original bloviating by Aniston's lawyer quoted in
this thread,
the topless photos were taken by paparazzo Peter Brandt, who allegedly used a "powerful telephoto lens" from a perch more than a mile away from Aniston's home,
was hard to accept. More than a mile away? That must have been quite some lens to see something that small from so far away... This article claims that Brandt was about 300 yards away, which is less than a quarter mile, which seems more credible...
