Feingold quoting Patrick Henry has to be the most absurd thing I've heard all week. What Henry said was "Give me Liberty or Give me Death!" What Feingold is saying is " Give me the right to have private converstions with people who want to murder American men, women and children or give me death!"
If he and his dimwit friends keep at this they may get both. Unfortunately they'll drag alot of innocents with them.
I would admire him if he thought he might really have to sacrifice his own life. But that sort of thing doesn't happen in the Senate. I believe they have their own bunker.
The vigilance recommended in this quote is on the part of the people AGAINST ENCROACHING POWERS OF GOVERNMENT.

Patrick Henry was a Patriot. Feingold is a Democrat politician.

I do know some Democrat Patriots, they arent in politics and most of them switched over and voted for george Bush.

You are correct, but you might also consider that the Fourth Amendment protects us from UNREASONABLE search and siezure. It should also be noted that since the Prez is ordering these Outside-FISA intercepts, there is a record of them and others are privy to the info. Even without the at-the-moment court interaction, there is still a modicum of checks by virtue of the others knowing and a record of the orders. If the Prez did/does anything wrong or illegal, there will be a trail by which to hang him. Those doing the Chicken Little act are very aware of this and would be using more specific attacks if they thought they had any real ammo. There is still a dearth of information on citizens who have had their rights violated and we all know it would be headlined in the largest possible banners if there were any such folks.
Which is for Congress to decide, not the President.
The rest of your argument, while true, does not change the substantive fact that the President should have requested legislative authorization, after the fact if necessary. This is a delicate matter best decided in the open by representatives of the people.
I trust the Prez much more than I trust most of these "representatives of the people". If we hash it out in public, we might as well give the terrorists a handbook on how to avoid detection. The term "National Secrets" is not a misnomer; there are some things that cannot be made public without causing serious or grave damage to the country and the citizens. Most of the howlers were not as far in the dark as they claim - they are making a shameless and treasonous attack, at the peril of our country, for pure partisan reasons. Rockefeller was privy to much of the info and had a legitimate avenue to discuss any misgivings with the Prez at any time. Yet, he decided to haul out a letter that he had held for over two years in order to show that he had harbored misgivings. As the VP said, this is more than a little disingenuous.
From a legal and constitutional perspective, that means you trust Hillary, were she president, more than Congress.
No thanks. Making such powers permanent is not a good thing.
