It's ironic, I guess, but the notion of comparitive negelegence was itself seen a a reform from the strict contributory negelegence laws which bared the injured party from recovering anything if the situation were reversed an the defendant was 99% liable, but the plaintiff was only 1% to blame.

OK I have sympathy for the family for their loss and for the excruciating pain she must have endured before her death, but who doesnt know not to puncture an aerosol can and who the hell sprays hair spray near an open flame? Lack of common sense cannot be legislated and litigated. I hope they loose their case.
BTW, if your hair spray nozzle gets clogged, try running it under some warm water then turn the can upside down and depress and repeat until unlogged. Works for me every time.

That seems to be the common experience. I get pump bottles, but the same thing happens.
One would think. I am pretty sure that Aquanet isn't much more than compressed alcohol and sugar. This is off the top of my head, please correct me if I am mistaken.
I lived next door to a kid who was dropping firecrackers into a five-gallon gas can on the front porch. He went the same way as did his parents' house. I don't think they sued the gas station or the gas can manufacturer, though.
This is, in no way, the manufacturer's fault. If the seam of the can had opened by itself without any improper handling, or something of that sort, they might have a case.
The plaintiff will probably win the suit. It seems that whatever the most ridiculous and unjust possible outcome is in any particular case, in today's court system- that's always who seems to win.

What design defects?!! Will all Aquanet products be shipped now in a huge, steel tank that is normally used for liquid propane gas or something? What would keep the next idiot from taking a Sawz-All to it? Would that be Aqua-net's fault, too?
