Alpharetta lawyer sues Bush over wiretaps

An Alpharetta man filed a federal lawsuit on Friday against President Bush, claiming the administration's secret wiretapping program aimed at nabbing terrorists is unconstitutional.

Mark Guzzi, 40, claims that the government's surveillance of telephone and Internet communications violates his First Amendment protection of free speech and the Fourth Amendment's right to privacy. Guzzi is a lawyer for the state Department of Corrections, but he said he filed the lawsuit as a private citizen.

The lawsuit names President Bush, the National Security Agency and the NSA's director as defendants.

Guzzi said Friday he has developed friendships overseas, before the 2001 terrorist attacks, and worries that communications with those friends are being monitored.

It was not unusual for him to discuss topics such as the mindset of terrorists, suicide bombings, the United States' approach to the war on terror, the war in Iraq and other related subjects in the course of a typical conversation — particularly since his friends are both of Middle Eastern descent, he said.

Guzzi said he has no way of knowing whether he was actually monitored, since the program is secret.

Guzzi emphasized that his lawsuit has nothing to do with his position as assistant general counsel — the No. 2 lawyer — for the Georgia Department of Corrections. Guzzi also said the lawsuit is not politically motivated and that he supports the war on terror and the goal of apprehending terrorists. He simply objects to the wiretapping, claiming that the administration is pursuing terrorists at the expense of his civil liberties and the American form of government.

This might turn out to be a good thing. Bring it before the Supreme Court. Let them decide if the President acted accordingly. And when they do decide, and the leftist libs go nuts about it, they will look that much more stupid.

Well I'm not an attorney, but I did sleep in a Holiday Inn Express some time ago.

This case will be tossed. I would think the loon would have to at least have some proof of damages.

I believe these jacka@@ are out of luck. I think it will be thrown out unless this fool can show damage as result of wiretap. He probably can't even prove he was wiretapped. Damn, where are these fools coming from?

The constitution provides for the authority of the President to order surveilance of the enemies of our nation in the interest of security. His argument is weak and will be struck down.

He's not sueing because he thinks he was wiretapped. He is sueing because he thinks the President's use of it without warrants is unconstitutional. Of course he is wrong, and maybe he does need to be wiretapped just to get some humorous material from when Ted calls and congratulates him.

I did. Then I found that a vietnamese ( from north or south I dont know) and son of a russian immigrant wrote it.

I don't know, is it just a coincidence that a guy from nam and a russian descendant wrote the act which takes away our civil liberties for a non existent security?

I know. But still, sometimes I just can't but wonder when I do the research to discover just who it is that would write such an unconstitutional act.

Able Danger revealed that data mining is a technique used by the government. He didn't file any lawsuits until the NYT and the demonrats decided to make an issue of it.

Maybe but it would be a big gamble. If you're correct, he may feel that if the court ruled the info was obtained illegaly, it then couldn't be used against him.

FOX's Judge Napolitano commented on another similar suit the other day. He said that one must not "blindly" put forth a suit, but prove that there was some kind of damage done, I think.

He has no grounds. If he is confessing that he believes his communications are being monitored then that implies he has had conversations with terrorists. If so, his conversations should all be monitored.
