Filibuster Alito by John Kerry

Do I support a filibuster? The answer is yes.

Yesterday Senator Kennedy and I spoke with our colleagues about it. I don't have a shred of doubt in my opposition to Sam Alto's nomination. I know Senator Kennedy does not either. He has truly been a great leader in the effort to oppose Judge Alito.

I spent a lot of time over the last years thinking about the Supreme Court and who America needs on the highest court in the land. So I don't hesitate a minute in saying that Sam Alito is not that person. His entire legal career shows that, if confirmed, he will take America backwards. People can say all they want that "elections have consequences." Trust me, more than anyone I understand that. But that seems like an awfully convoluted rationale for me to stay silent about Judge Alito's nomination.

John Kerry's diary :: :: I voted against Justice Roberts, I feel even more strongly about Judge Alito. Why? Rather than live up to the promise of "equal justice under the law," he's consistently made it harder for the most disadvantaged Americans to have their day in court. He routinely defers to excessive government power regardless of how extreme or egregious the government's actions are. And, to this date, his only statement on record regarding a woman's right to privacy is that she doesn't have one.

I said yesterday that President Bush had the opportunity to nominate someone who would unite the country in a time of extreme division. He chose not to do this, and that is his right. But we have every right, in fact, we have a responsibility, to fight against a radical ideological shift on the Supreme Court. Just think about how this nomination came to be. Under fire from his conservative base for nominating Harriet Miers--a woman whose judicial philosophy they mercilessly attacked--President Bush broke to extreme right-wing demands.

This was a coup.

Miers was removed and Alito was installed to replace the swing vote on the Court. The President gave no thought to what the American people really wanted--or needed. So it's up to us to think about what America really needs - that's part of the true meaning of "advice and consent."

Here's the bottom line though and I'll just be blunt and direct about it. It takes more than one or two people to filibuster. It's not "Mr. Smith Goes to Washington." I'm doing what I can, Senator Kennedy is doing what he can, but if, like me, you want to stop Judge Alito from becoming Justice Alito, we can't just preach to our own choir. We need even more of your advocacy.

That piece of garbage Kennedy wasn't embarrassed enough by the hearings.

He has blocked three supreme court judges. Two nixon judges and bork.

Kennedy's staffers are boasting about his prowess.

I would be confident except for the fact that this is the same party that blocked miguel estrada.

My guess is the dems are really going to use the filibuster if stevens retires and this is just an appetizer.

Kerry is sorry that Bush lived up to his campaign promise even though he could have offered someone whom Kerry MIGHT have approved. Short of nominating Dr Dean or Hillary, I'd find it difficult to believe Mr Kerry and this is yet another reason I'm GLAD he is STILL licking his wounds in Switzerland and not at Camp David. Between Gore and Kerry in their post-election rants and raves, thank GOD we got GWB!!!

Oh, you can bet on that . If Bush gets another appointment and the Republicans still control the Senate, the Dims will use every underhanded trick in their arsental to Deep 6 anyone Bush nominates. The hearings don't matter at all. That last seat could have the potential to push the court to a certain right majority for a long time, and our pathetic excuses for Americans know it.

To amend title 18, United States Code, with respect to protections for the Medal of Honor, and for other purposes.

IN THE HOUSE OF REPRESENTATIVES

July 19, 2005

Mr. SALAZAR introduced the following bill; which was referred to the Committee on the Judiciary

A BILL

To amend title 18, United States Code, with respect to protections for the Medal of Honor, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Stolen Valor Act of 2005'.

SEC. 2. FINDINGS.

Congress finds that--

(1) fraudulent claims surrounding receipt of the Medal of Honor, the Distinguished-Service Cross, the Air Force Cross, the Navy Cross, the Purple Heart, or any other medal or decoration awarded by Congress or the armed forces damage the reputation and meaning of these medals;

(2) Federal law enforcement officers are currently limited in their ability to prosecute fraudulent claims of receipt of military medals; and

(3) changes to the current statute are necessary to allow law enforcement personnel to protect the reputation and meaning of these medals.

SEC. 3. MILITARY MEDAL PROTECTIONS.

Section 704 of title 18, United States Code, is amended--

(1) in subsection (a)--

(A) by inserting `purchases, attempts to purchase, solicits for purchase, mails, ships, imports, exports, produces blank certificates of receipt,' after `wears'; and

(B) by inserting `attempts to sell, advertises for sale, trades, barters or exchanges for anything of value' after `sells';

(2) in subsection (b)(1), by inserting `or (b)' after `subsection (a)'

(3) by redesignating subsection (b) as subsection (c);

(4) by inserting after subsection (a) the following:

`(b) False Claims About Receipt of Military Medals- Whoever falsely represents himself or herself, verbally or in writing, to have been awarded any decoration or medal authorized by Congress for the armed forces of the United States, or any of the service medals or badges awarded to the members of such forces, or the ribbon, button, or rosette of any such badge, decoration or medal, or any colorable imitation thereof shall be fined under this title or imprisoned not more than six months, or both.'; and

(5) by adding at the end the following:

`(d) Other Medals- If a decoration or medal involved in an offense under subsection (a) or (b) is a Distinguished Service Cross awarded under Section 3742 of title 10, an Air Force Cross awarded under section 8742 of section 10, a Navy cross awarded under section 6242 of title 10, a silver star awarded under section 3746, 6244, or 8746 of title 10, or a Purple Heart awarded under section 1129 of title 10, or any replacement or duplicate medal as authorized by statute, in lieu of the punishment provided in that subsection, the offender shall be fined under this title, imprisoned not more than 1 year, or both.'.

The greatest threat to the sanctity and significance of the Purple Heart comes from the medal's easy availability. Anyone can buy one at flea markets, pawnshops or on the Internet, where Web sites offer the decoration, no questions asked, for as little as $35. An accompanying certificate on onion skin parchment and personalized with your name and any rank you choose costs about $25.

Such commerce in the symbols of American courage and sacrifice would be outlawed by a measure spearheaded last July by Rep. John Salazar, D-Colo.

His "Stolen Valor Act" would make it a federal crime to falsely wear the Purple Heart and other top military decorations, or to even list them on a resume if they were not officially earned.

But the proposed bill now sits in the House Judiciary Committee, and its fate remains unclear.

as guilty as the phonies that this bill targets.

The Swift Boat Vets already proved, beyond a doubt,
that hanoi kerry's 1st Purple Heart is fraudulent.

A US Attorney General can get ALL of hanoi kerry's
records and once and for all prove that the
Swift Boat Vets were accurate and true.

All that has to be done is to get this bill passed and signed into law now, before the '06 election.

Since hanoi kerry will be under indictment he'll
have to sit out the '06 election for his illegal seat
in the US Senate.

AND the best part is that it is a Democrat sponsored
bill that will his downfall.

WOW! I'M TRULY SHOCKED THAT A LEFTY WOULD OPPOSE ALITO.

Yesterday Senator Kennedy and I spoke with our colleagues about it. I don't have a shred of doubt in my opposition to Sam Alto's nomination. I know Senator Kennedy does not either. He has truly been a great leader in the effort to oppose Judge Alito.

AND BY "COLLEAGUES" I MEAN THE ACLU, ELF, ALF, CINDY SHEEHAN...

I spent a lot of time over the last years thinking about the Supreme Court and who America needs on the highest court in the land. So I don't hesitate a minute in saying that Sam Alito is not that person.

HE'S NOT THE TYPE OF SOCIALIST/COMMUNIST WE NEED ON THE COURT...

His entire legal career shows that, if confirmed, he will take America backwards.

HE'LL THROW OUT THIRTY YEARS OF FAILED, LEFT WING, DINOSAUR LAWS AND REGULATIONS THAT HAVE NO BEARING IN THE MODERN DAY.

People can say all they want that "elections have consequences." Trust me, more than anyone I understand that.

THE AMERICAN PEOPLE REJECTED MY BID FOR PRESIDENT AND NOW IT'S TIME THEY PAY!!!

But that seems like an awfully convoluted rationale for me to stay silent about Judge Alito's nomination.

I'M A LEFTY AND I'M PREPARED TO DIE FOR THE PEACENIK VOTE!

John Kerry's diary :: :: I voted against Justice Roberts, I feel even more strongly about Judge Alito. Why? Rather than live up to the promise of "equal justice under the law," he's consistently made it harder for the most disadvantaged Americans to have their day in court.

And, to this date, his only statement on record regarding a woman's right to privacy is that she doesn't have one.

AND BY "RIGHT TO PRIVACY" I MEAN ABORTION.

I said yesterday that President Bush had the opportunity to nominate someone who would unite the country in a time of extreme division.

AND BY "UNITE THE COUNTRY" I MEAN "ROLL OVER AND GIVE US LEFTIES EVERYTHING WE WANT."

He chose not to do this, and that is his right.

OF COURSE, WE COULD HAVE COMPROMISED TOO...

But we have every right, in fact, we have a responsibility, to fight against a radical ideological shift on the Supreme Court.

FROM WISHY WASHY AND UNPREDICTABLE TO FOLLOWING IT'S CONSTITUTIONAL DUTY = RADICAL SHIFT, HOW OFFENSIVE IS THAT?

Just think about how this nomination came to be. Under fire from his conservative base for nominating Harriet Miers--a woman whose judicial philosophy they mercilessly attacked--President Bush broke to extreme right-wing demands.

AND UNDER FIRE FROM LEFTIES FOR "CRONISM" DON'T FORGET. YEAH, BETTER IF HE HAD BUCKLED TO THE EXTREME LEFT.

This was a coup.

I'M REALLY PISSED OFF THAT I'M NOT IN POWER.

Miers was removed and Alito was installed to replace the swing vote on the Court. The President gave no thought to what the American people really wanted--or needed. So it's up to us to think about what America really needs - that's part of the true meaning of "advice and consent."

WHAT AMERICA WANTS: ABORTION OUTLAWED, VICTORY IN THE WAR ON TERROR, LOWER TAXES AND OTHER THINGS THAT LEFTISTS LIKE MYSELF ARE CONSTANTLY TRYING TO DEFEATING..

Here's the bottom line though and I'll just be blunt and direct about it. It takes more than one or two people to filibuster. It's not "Mr. Smith Goes to Washington." I'm doing what I can, Senator Kennedy is doing what he can, but if, like me, you want to stop Judge Alito from becoming Justice Alito, we can't just preach to our own choir. We need even more of your advocacy.

ADVOCACY FROM DAILYKOS IS PREACHING TO THE CHOIR. ONLY LIBERALS IN DENIAL BELIEVE OTHERWISE - BUT KEEP TALKING TO THEM KERRY.

FYI - as for the liberal Daily "Kos" mentioned as the Blog that posted Kerry's filibuster comment, in Persian the word "kos" is a word for female genitalia starting with a derogatory "c" in English.

There can be no successful filibuster since seven Democrats have pledged not to support a filibuster except under "extraordinary circustances". That criteria has not been met by any measure. Kerry is well aware that there will be no successful filibuster. The Democrats' near unanimous rejection of the Alito nomination is not about Alito - - it is about the NEXT Bush nomination. The Democrats are simply sending a message that the next nomination MUST be a moderate (liberal). Everything they're saying about Alito is just a bunch of phony bluster - - totally meaningless in and of itself.

And this "call for a filibuster" by Kerry is all about the Democrat primary and the support of MoveOn.org and the rest of that goofy, bitter, far-left ilk (the Democrat "base"). It was meant as a shot across the bow of the Evil Ship Hillary!. The Democrat primary will be a bloodbath. David Schippers once said that Bill Clinton ran the White House "like a Mafia don", and I believe he was being only slightly rhetorical. In my opinion John Kerry better watch his back - - the Clintons will stop at nothing. Nothing.
