CEDAR RAPIDS --- The attorney for a Charles City man accused of child pornography has asked the court to push back filing deadlines in the case.
The government has offered Casey Frederiksen, 26, who was arrested on porn charges in the wake of the investigation into the death of his live-in girlfriend's daughter, a plea agreement, according to documents filed by his attorney, Federal Public Defender Jane Kelly.
Details of the agreement aren't available, but Kelly asked the court to postpone the deadline to file pretrial motions in connection with the case.
Frederiksen was indicted in September and November on federal charges of receiving and possessing child pornography after authorities allegedly found images on a computer seized during the investigation into the slaying of 5-year-old Evelyn Miller.
Kelly received the government's proposed settlement agreement Thursday, and she requested time to travel to West Union where Frederiksen is being housed in the Fayette County Jail to meet and discuss the proposed agreement.
"It is possible there may not be a need to file any pretrial motions once counsel has had the opportunity to go over the plea agreement with Mr. Frederiksen," Kelly wrote in her request.
The deadline to file motions in the case was set for Feb. 6, and Kelly asked they be pushed to Feb. 13.
The prosecutor in the case, Assistant U.S. Attorney Sean Berry, didn't resist the postponement, records state.
Kelly and Berry couldn't be reached for comment Monday.
No one has been charged in Evelyn Miller's death, and authorities are continuing their investigation.
She disappeared from her home July 1 apparently while Frederiksen was asleep. Her mother, Nicole Miller, said she realized Evelyn was missing when she returned home from work at 6 a.m.
Evelyn's body was found in the Cedar River July 6. The death was ruled a homicide, but other details haven't been released because of the ongoing investigation.

Pretty standard, especially in these porn cases. I've never heard of one actually getting to trial. Usually the evidence is overwhelming.
I do doubt that they'd be offering him a plea bargain if they thought he was responsible for Evelyn's death. Roger Bentley, who killed Jetseta Gage, another young Iowa girl, was just convicted yesterday of 1st degree murder and will do life in prison (no possibility of parole). There was no talk of plea arrangements in that case.
These porn charges are in the federal system, and depending what you read, Frederiksen would face anywhere from 200-260 years if convicted, which is basically a life sentence. Even though the two cases are separate, I would think that state and federal officials would be coordinating or cooperating with each other and would want to proceed to trial and get a full sentence for Frederiksen if they think closure to the homicide investigation isn't going to happen.
I guess we'll see.
I wonder if we'll ever see justice for little Evelyn!
