RUSH: Here's a little story today in the New York Sun. Did you know that Judith Miller was back in court fighting with the special prosecutor, Patrick Fitzgerald, again? "Journalist Judith Miller and U.S. Attorney Patrick Fitzgerald squared off in court again yesterday, with a lot less public attention than last year, when the dogged special prosecutor in the Valerie Plame case had the then-New York Times reporter jailed for 85 days to force her to disclose the identity of an anonymous source. Yesterday appearance in Manhattan before the U.S. Court of Appeals for the Second Circuit was another instance of Mr. Fitzgerald trying to find out about Ms. Miller's sources, this time by looking at the New York Times's phone records, and prosecutors raised the prospect of pressing her directly yet again, as they did in the Plame case to disclose the sources.

"At the center of this leak case is the question of how Ms. Miller, who has since left the paper, and a second Times reporter came to learn of the government's plan to take action in the wake of September 11 against two Islamic organizations suspected of having terrorist ties." Now, she was subpoenaed. What this is all about, Judith Miller turned up in a federal appeals court in Manhattan yesterday for arguments over whether the feds have a right to subpoena her phone records as part of a probe into Islamic charities and terror financing. The New York Times wants to stop authorities from gaining access to records for calls that Miller and another reporter, Phillip Shannon, made to sources in the wake of the September 11th, 2001, attacks.

The reporters received information about the government's plan to block the assets and search the offices of two Islamic organizations, and apparently Judith Miller tipped off these fund-raisers to the upcoming FBI raid so they could destroy documents. Is that what this is about? I wonder what this could be about. If that's what this is about, the source of this tip is far more important than whether Valerie Plame -- was, wasn't, could have been, should have been, might have been, never was -- an undercover agent. If that's what happened, if the New York Times alerted these two Islamic charities to an upcoming FBI raid... Hell's bells here, folks! Do we need to redefine treason here? You know, I hope before this is all said and done the New York Times -- like Jane Harman said Sunday on Meet the Depressed -- ends up being prosecuted.

The New York Times is in the middle of all of this, be it this bogus domestic spying case that they published on December 16th, and now this Judith Miller business, and, by the way, Fitzgerald is not acting as special counsel or independent prosecutor. He's in his role here as a US attorney in this case. It's out there, and the New York Post has the story, the New York Sun has the story. Well, here it is: "Patrick Fitzgerald has alleged that the Times reporters tipped off these Islamic charities, the Global Relief Foundation and the Holy Land Foundation, before they were searched in December of 2001, thus compromising the actions. Both charities are accused of ties to Islamic extremist terrorists." Now, this is where Fitzgerald made his bones, going after these Islamic terrorists, and I think he was part of the blind sheik prosecution, Omar Abdel Rahman. If you've got the New York Times reporters tipping off Islamic charities that a raid is coming, hell's bells!

I wish callers to the Sean Hannity, Rush Limbaugh, Laura Ingraham, and all the other talk shows would flat out ask the hosts, "What is your definition of treason?"

I am getting so tired of the talk hosts skirting around what treason is. It is time to call it what it is. It's time to stop being weak kneed.

Miller has been accused of calling the charity and asking questions that tipped them off to the pending raid. They then had time to destroy evidence.

This is information that was on the internet, and FR, when Miller's name first came to light as someone who was going to jail for not giving up her source in the Plame case.

If it turns out that the Times newsette, et al, managed to somehow warn the worthy oriental gentlemen of an impending raid ... the Dems really got trouble.

Having a press badge does not give one the right to commit treason. The MSM HBM (Hate Bush Media) needs to be held accountable for partisan political attacks run amok.

Due directly to their blind hatred of this president, they have forfeited their newspaper circulation, TV ratings, advertising dollars, their credibility (Whatever they had left), and quite possibly their own freedom.

And I believe this is ALSO related to Miller's "condition" for testifying in the Plame case. Remember that she would ONLY agree to give information from ONE source...Libby. Now, it could be that she had other sources about Plame...but it could also be that she didn't want any questions about sources in THIS case.

Free Republic was all over this story BEFORE Judith Miller was imprisoned for refusing to testify. Part of the reason that she refused to testify was because she was afraid that the prosecutor would ask questions that would lead to this case. She made an agreement with the prosecutor to only talk about the Plame leak, no other questions.

Now we know why the NYT and the left were pushing so hard for a "whistleblower" law to shield journalists (at least those who work for the MSM) from having to disclose their sources. They want to cover up the fact that they are working with the terrorists.

There is someone here on FR that says YES and he refers us to the Pentagon Papers case. However, I do not believe the circumstances are the same, and I think Treason should apply. However no one is ever prosecuted for Treason any more, read what Victoria Toensing says about one of the latest potential treason cases - "If John Walker Lindh is not to be charged with treason, then who?"

I thought that that's what Miller got Fitzy's agreement on... that he would not ask her about this particular bit of (what seems to me) treason, when she agreed to testify.
