Pathetic. The video link may be temporarily overloaded with traffic: keyword is "temporarily." I think I got lucky.

Why does she need to listen? She knows how she is going to vote before the case makes it to the court.

So what.. these people have their minds made up and their clerks know how they think and influence the decisions..
They might as well act like the senate and not even show up to the arguments (Ever notice how often the Senate is emtpy while Senators pontificate??)..

I see that sketch being used often on FR threads.......

I'd be careful about criticizing such behavior. Thomas just sits there with a pained expression because he knows that the oral argument thing is a sham.

Ever notice how often the Senate is emtpy while Senators pontificate?? Yes. It's one of the few hopeful things I see in Washington.
Anyone who's to dumb to avoid another Teddy blovation is probably too dumb to hold office. Or be let out of the house unescorted...

ARTICLE III Section 1. Judicial powers. Tenure. Compensation. In the movie about Oliver Wendell Holmes (
The Magnificent Yankee, 1950), Holmes began nodding off during arguments, and the other Justices went to him and informed him that it was time to retire.
I have no idea whether that occurrence was historically accurate, or simply a Hollywood creation, but it would seem to be an appropriate course of action in Justice Ginsburg's case. Though at 72, she's two decades younger than Holmes was at his retirement, she is in obvious ill health. Time for her to step down.
