Nipple Pincher Gets Juvenile Detention

GOLD HILL, Ore. - A teen who pinched and twisted another boy's nipple while standing in line at a deli has been sentenced to four days in juvenile detention because he refused to write a letter that explained his actions.
David Thumler, 16, was convicted of offensive physical touching in July 2005, after the victim's parents complained to police. The Crater High School student paid a $67 fine and served three days of community service.
"I emptied trash cans, mowed lawns and shoveled gravel," Thumler said.
But Thumler's refusal to comply with the final piece of his sentence will cost him four days in detention. He was required to write the letter during four classes put on by Mediation Works, which operates the victim-offender program for Jackson County Community Justice. Mary Miller, executive director of Mediation Works, said the purpose of the letter is to prepare teens to be accountable for their offenses.
"They don't have to apologize," she said. "But they are required to be accountable."
The offender is required to describe the act in detail, explain "thinking errors," "express empathy" and describe any resultant life changes.
Miller said the program is "often a very, very healing experience between the victim and youth offender." Thumler said he presented a rough draft of his letter in the third session. He said he balked when told he must also describe his "criminal thought processes." He said that would imply malicious or criminal intent, and "none of that applied to my feelings or actions." Thumler said he had no criminal intent because he considered the victim to be a friend at the time of the incident _ which he deemed horseplay. Including the language sought by Mediation Works, he said, would turn his prior court statements into lies.
"It was a matter of conscience," Thumler said. "I figure the worst is already over."
Ken Chapman, a Community Justice juvenile probation supervisor, verified Thumler's sentence.
"The judge found a willful violation of the court order," Chapman said.

Or a noogie. My brother was the worst offender. Heck, I'm 44, and he STILL grabs me in a neck lock and scrubs the top of my head with his knuckles.
That's ok. When he's 80, I'll be 70, and then I'll try to remember to give paybacks.
Even if I have to go to lock-up for it.

There isn't much that provokes me to instant rage, but I have decked more than a few people who have tried to grab my nipple. Flick my ears, give me a friendly head butt, and you can even slap me in the butt...but reach for my nipples and you get punched. There just isn't a good reason for any guy to grab another guy's nipple.

He wasn't sentenced because of the incident, but because he didn't comply with the judge's sentence. All he had to do was write a letter. It's equivalent to getting a ticket for running a stop sign, refusing to pay your ticket and then saying how you got your license suspended for only running a stop sign.
I just skimmed through another article. Turns out, they weren't friends. And the other boy was 13.You don't just go up to some random person in a deli, grab their nipple and twist it.

Here's a crazy idea; why don't we teach kids how to deal with problems and let them do it?
From what I gathered the "aggressor" was 16 and the "victim" was 13. From what I read here they didn't know each other.
I'm guessing the 16 year old was a bully. The 13 year old should be taught to stand up for himself. Even if he's a little guy he can deal with a bully when he has had enough. Most of the time bullies back down when they know their target won't take their crap.

In the cruel reality that is high school, the poor kid who needed mommy and daddy to protect him from junior high "grab assing" or a Nipple Cripple...will become the target of more and more harassment. Wedgies are next. Then atomic wedgies.
If and when it morphs from "boys will be boys" into bullying, then the authorities can appropriately be called. Till then... There is no parent, no court and no law that can require kids to play fair. Life is unfair. And High School is life's proving ground.

johnny is right. That's one thing I never did. I understood the concept of "going too far." I also could fight back well enough so I never received one either!
I gave a few wedgies (and got some too), played some dodge ball, and I survived childhood without running to the government with a case of the freakin vapors.

I didn't get into much of any fights in school because I was a vicious kid. In the 8th grade some insane guy with a death wish decked me in the back of the head for no reason at all with his bookbag in the cafeteria. So, I grabbed him by the neck, slammed him to the floor, and pounded the shi'ite out of him until they dragged us off to the office where I actually felt a tiny bit bad watching him cry for two hours before the principal finally came in from the field day to suspend him and send me on my way. :)
So, everyone kind of kept a proper distance after that. But! That's not the point here. My junior year some guy suddenly lunged at me in the hall and I decked him about five feet away before he even reached his target. As it turned out, he was trying to grab my nipple. That was the only time it happened to me! If I'd known what was up I probably would've just let the nipple get tweaked though.

This is where training children up the way you want them to be comes into play. I am a little old fashioned, if I see some jackass victimizing someone who can't defend themselves I step in. There is always someone bigger, faster or stronger than the bully.
I was a small until I hit about 20 years old. But I was quick and strong for my size. The big guys would mess with me until they got to know me. Even if I lost a fight I made sure they would remember me for a few days.
I am assuming this 13 year old was not in a wheel chair or suffering from cerebral palsy. They would have reported that. This was an older/bigger kid trying to be tough or funny. We don't even know if he was really "bullying" or just clowning around.
At 13 I might have asked the 16 year old if he knew the capital of Tai land. I then would have informed him it was "Bang-Cock," dropped low and let loose with an uppercut to his baggage.
The 13 year old would have his 15 minutes of fame, the 16 year old would at least respect him and maybe become his friend and, best of all, nobody would go to jail.
By the way; would you set up a special prison wing just for nipple twisters or would you put them in with the general population?
