HOLOCAUST VICTIMS SUE FRANCE OVER STOLEN PROPERTY

NEW YORK, March 3, 2006 (AFP) - Holocaust survivors and victims' families have filed a lawsuit in New York seeking compensation from France for property taken from 75,000 Jews who were deported to Nazi death camps in World War II.

As well as the French government, the lawsuit names the state-run SNCF railway and the pension manager for French civil servants, CDC, as defendants who "committed, conspired to commit and aided and abetted others who committed crimes against humanity."

France's culpability, according to the lawsuit filed in federal court in Manhattan on Thursday, stemmed from its operation of holding camps for Jews and others the Nazis deemed "undesirables" waiting to be shipped to places such as Auschwitz and Buchenwald.

When they arrived at the holding camps, internees were forced to turn over money and other objects of value to the French guards.

"The taking of property at the camps was organised and systematic," said the lawsuit.

The SNCF was cited for running the trains that took the Jews to the holding camps, and then on to the death camps.

"Once on the trains, SNCF took their suitcases and other valuables, telling the victims the property would be returned to them. It was not," the lawsuit said.

The CDC, meanwhile, was named as the recipient of the stolen money and goods.

"The CDC .... accepted, held, and is holding today, property consisting of money taken from the plaintiffs, or money received from the sale of the platiffs' non-monetary property," the lawsuit said.

The suit was filed by 26 individual plaintiffs, including Mathilde Freund, now a US citizen living in New York, who was deported with her mother and father.

"Everything they had was forcibly taken from them in the camps," the lawsuit aid.

In my opinion a fair judge would estimate the value at the time of confiscation, assess punitive damages, then add the compounded interest on the principle and the damages. If the IRS can do it, why not the CDC?
