RUMSFELD ASKED TO DENY FUNDS TO CALIFORNIA COLLEGE
Mountain States Legal Foundation ^ | April 12, 2006 | William Perry Pendley

Posted on 04/13/2006 2:47:47 PM PDT by george76

Secretary of Defense Donald Rumsfeld should withhold federal funds from a California college given the failure of the college to ensure the safe presence of military recruiters on campus, the Secretary was advised by a public interest law firm in a letter released today.

According to news reports, military recruiters were forced to flee yesterday from a University of California Santa Cruz job fair because of a raucous mob.

Mountain States Legal Foundation advised Rumsfeld that the college’s actions violate the Solomon Amendment, which requires that colleges permit military recruiters on campus or lose all federal funds.

UC Santa Cruz received $80 million in federal funds during 2005.

A unanimous Supreme Court ruled the Solomon Amendment constitutional early last month.

“It is outrageous that members of the Armed Forces, who are asked to serve in harm’s way in Afghanistan and Iraq, are driven from a campus by a mob in America,” said William Perry Pendley, president and chief legal officer of Mountain States Legal Foundation.

“Unless Secretary Rumsfeld responds to this craven violation of federal law, radicals on other campuses will be emboldened, will endanger the lives of men and women in uniform, and will deny students the right to learn how they may serve their country.”

No problem, I'm sure the students would be more than happy to return their Pell Grants, student loans and student federal aid. Also the professors and administrators will forgo federal grants a part of their salary.

We'll show those warmongers.

Agreed... I don't think Sec. Rumsfeld controls this money.

Also, the school didn't deny the recruiters - there was a protest and the recruiters left. Now... if the school refuses in the future to protect the recruiters, then there may be grounds for this action.

Where in the budget are the funds sourced?

If DOD then he might but if Education he has no say.

Here is a report...

"Military recruiters, confronted by crowd, leave campus job fair"

"Anti-war protesters at university block doors to building"

"University officials had been aware for weeks that Students Against War planned a protest to prevent military personnel from participating in the school's biannual job fair held for students."

"The student organization has become a bit of a cause celebre of the national anti-war movement ..."

Yep, UC Santa Cruz should lose all Fed funding till said students are expelled, arrested, and prosecuted for violation of recruiters civil rights. Then restore on a pro rata base. Funding for year begins on day students expelled. Permanent loss of share of funds prior to that date.

Thanks. I read the reports yesterday.

My point is that the school did not prohibit the recruiters - the recruiters chose to leave during the protest.

The school needs to find a way to protect the recruiters while still upholding the right of the students to protest.

Mountain States Legal Foundation advised Rumsfeld that the college’s actions violate the Solomon Amendment, which requires that colleges permit military recruiters on campus or lose all federal funds.

In the first place I don't think that the funding comes from the Defense Department so I doubt Rumsfeld could cut off the federal dollars even if he would. Second, the college allowed the recruiters on campus as required by the Solomon Amendment. I think you would have to show that they aided the bozos who harassed the recruiters until they left.

You are correct.

I wonder how hard the school tried to protect the recruiters. It looks like a very minimal effort. The school should try harder.

And the money should be cut off until the school gets enough protection to allow the recruiters to be on campus safely.

Withholding federal funds is not in Rumsfeld's job description.

But he could mention the lack of free speech on college campuses at his next press conference.

We should express our concerns to our local congress or senate reps...to start.

It doesn't matter what you think. What matters is how the law is written:

Yes, Rumsfeld needs to demand enforcement, or none will occur.

If they lost $80 million in federal funds, they would have to ask the illegal aliens to pay for their own tuition... Or increase the tuition on the rich liberal kids.

The administration should make an immediate verbal statement and then follow up with action.

Actually start the process to cuting off the federal money.

Send the University a formal notice, hold a hearing, what ever it takes.

////////////////////////////////////////////////////

No. Our military is not "allowed" to recruit, they are required to do so. We are all volunteer, these misguided clowns are still acting like there is a draft, and recruiting is "optional". Actually the Military has a right to recruit anywhere in this sovereign nation, even a Church or a mosque. Our military chooses not to disrespect the sanctity of the religious houses of worship.

Terrorists, on the other had are not permitted or allowed to recruit anywhere. Even though it has been documented that much of their real recruiting is carried out in mosques. But of course, to the terrorist murder is scared, just read the transcript from flight 93 and hear the words.......Allah Akbar! and "There is no God but Allah", and this becomes clear.

Maybe so, but in any case I sense that the Bush administration won't enforce the law on the issue, just as it hasn't enforced the law regarding immigration. (Nor did Clinton during 8 years.) So we have both major political parties unwilling to enforce the law on these issues, and many more, after they win elections.

That might create a few awkward situations since Berkeley is in charge of Los Alamos National Laboratory, Lawrence Livermore National Laboratory, the Lawrence Berkeley National Laboratory and several other highly classified government operations. The government is already in bed with the universites and has been for 50 years. Holding them accountable for defying the law is as difficult as enforcing security regulations.

I don't either, but hearing the recruiters talking about the school, they said that the school has ALWAYS been courteous and kind to them and let them have what they needed to succeed. This problem was with some of the stupid students who could not keep control of themselves. I would hate to keep money from the school that has been decent just cause of a group of students. I think we should hold the presses on this until we find out what the school with do to these kids first.

"Your point?"

The military was prevented from recruiting at USCD.

You, presumably, are trying to make a distinction between the prevention being a direct result of the administration and/or faculty vs. their student proxies. It's a moot point, since the university adminstration has legal control of the campus, and knew that the protest would take place, then they made no effort to prevent the protesters from blocking the recruiting.

The UCSD administration did it this way, because they thought they could get away with it. If the DOD calls their bluff (to the tune of $80M), all universities will get the message and this crap will stop.
