Posted on 04/13/2006 2:47:47 PM PDT by george76
Secretary of Defense Donald Rumsfeld should withhold federal funds from a California college given the failure of the college to ensure the safe presence of military recruiters on campus, the Secretary was advised by a public interest law firm in a letter released today.
According to news reports, military recruiters were forced to flee yesterday from a University of California Santa Cruz job fair because of a raucous mob.
Mountain States Legal Foundation advised Rumsfeld that the colleges actions violate the Solomon Amendment, which requires that colleges permit military recruiters on campus or lose all federal funds.
UC Santa Cruz received $80 million in federal funds during 2005.
A unanimous Supreme Court ruled the Solomon Amendment constitutional early last month.
It is outrageous that members of the Armed Forces, who are asked to serve in harms way in Afghanistan and Iraq, are driven from a campus by a mob in America, said William Perry Pendley, president and chief legal officer of Mountain States Legal Foundation.
Unless Secretary Rumsfeld responds to this craven violation of federal law, radicals on other campuses will be emboldened, will endanger the lives of men and women in uniform, and will deny students the right to learn how they may serve their country.

I have no problem if Rumfeld does this. I hope he does.
quickest way to get anyone to change their mind on anything is to hit them in the pocketbook..
If terrorist can recruit at California Colleges,
then our military should be allowed to recruit, too.
If there's a petition to sign, let me know.
Time to push back against these pussy punks.
I don't think it would work. They are provacateurs and would try to use such a step as a way of ginning up public support.
gosh..you may be right..if only that pesky law wasn't in the way..
We will see them ignore their principals when they might lose some of our tax money.
Withholding federal funds? Would that even be in Rumsfelds job description? I think they are talking to the wrong agency.
Losing $80 million in federal funds should get the attention of the anti-war crowd in a hurry, and college presidents.
Here is the the author.
I agree, that's not his job. He has more pressing matters, leave that to the peons
We'll show those warmongers.
Agreed... I don't think Sec. Rumsfeld controls this money.
Also, the school didn't deny the recruiters - there was a protest and the recruiters left. Now... if the school refuses in the future to protect the recruiters, then there may be grounds for this action.
I doubt he has the ability to do so.
Where in the budget are the funds sourced?
If DOD then he might but if Education he has no say.
Here is a report...
Funds should be stopped for the entire Univ. of CA system, including Berkeley, UCLA, etc.
my first question
my first question
Thanks. I read the reports yesterday.
My point is that the school did not prohibit the recruiters - the recruiters chose to leave during the protest.
The school needs to find a way to protect the recruiters while still upholding the right of the students to protest.
Exactly, especially after reading post #16. UCal knew it before hand and let the mob control the situation.
If terrorist can recruit?
Reads as though they , the terrorist, have completed their recruiting on this campus.
Hold the funding, this will get their attention real fast.
In the first place I don't think that the funding comes from the Defense Department so I doubt Rumsfeld could cut off the federal dollars even if he would. Second, the college allowed the recruiters on campus as required by the Solomon Amendment. I think you would have to show that they aided the bozos who harassed the recruiters until they left.
You are correct.
I wonder how hard the school tried to protect the recruiters. It looks like a very minimal effort. The school should try harder.
And the money should be cut off until the school gets enough protection to allow the recruiters to be on campus safely.
If the administration doesn't do something about this the end is near.
They might start by hoiring cops who know something about riot control. Not every flatfoot can so this job, just as not everyone can handle traffic jams.
Leave it to the peons?
We have left it to the peons for five years, they don't have the spine to with hold the funding, their too busy playing the old game of indolent pleasures.
Since when does the left worry about the law, or getting busted for it? I will give the Hispanic demonstators in Dallas credit for doing it right, but then most of them are not leftists--yet.
Probably DOE, which is full of leftists.
"Withholding federal funds? Would that even be in Rumsfelds job description? I think they are talking to the wrong agency."
It doesn't matter what you think. What matters is how the law is written:
Yes, Rumsfeld needs to demand enforcement, or none will occur.
I second that.
power of the purse strings is indeed very powerful.
The administration should make an immediate verbal statement and then follow up with action.
Actually start the process to cuting off the federal money.
Send the University a formal notice, hold a hearing, what ever it takes.
Get a clue! Read the law!
"Second, the college allowed the recruiters on campus as required by the Solomon Amendment"
Maybe so, but in any case I sense that the Bush administration won't enforce the law on the issue, just as it hasn't enforced the law regarding immigration. (Nor did Clinton during 8 years.) So we have both major political parties unwilling to enforce the law on these issues, and many more, after they win elections.
The President of the University should be served with formal papers.
Then let the University start begging.
That will get the old media's attention.
Thanks for the link.
The law is clear.
I have a problem if Rumsfeld doesn't hammer them. And hard as sh$*. Sick of this college crap and the weak politicians we have.
That might create a few awkward situations since Berkeley is in charge of Los Alamos National Laboratory, Lawrence Livermore National Laboratory, the Lawrence Berkeley National Laboratory and several other highly classified government operations. The government is already in bed with the universites and has been for 50 years. Holding them accountable for defying the law is as difficult as enforcing security regulations.
I have no problem if Rumfeld does this. I hope he does.
I don't either, but hearing the recruiters talking about the school, they said that the school has ALWAYS been courteous and kind to them and let them have what they needed to succeed. This problem was with some of the stupid students who could not keep control of themselves. I would hate to keep money from the school that has been decent just cause of a group of students. I think we should hold the presses on this until we find out what the school with do to these kids first.
Perhaps they do not give a damned about federal funds with all kinds of strings attached, cut them off and be done with it.
The military was prevented from recruiting at USCD.
You, presumably, are trying to make a distinction between the prevention being a direct result of the administration and/or faculty vs. their student proxies. It's a moot point, since the university adminstration has legal control of the campus, and knew that the protest would take place, then they made no effort to prevent the protesters from blocking the recruiting.
The UCSD administration did it this way, because they thought they could get away with it. If the DOD calls their bluff (to the tune of $80M), all universities will get the message and this crap will stop.
Most of our universities have become anti-America and anti-defence.......shut them down with no more financial support !!!!!
