Tell you what... let's have one bar in town for people that want to smoke, and we can have another whole bar for smug power freaks... then we can both be happy.

LOL. This was tried in the town I live in. We have two bars, one is a very conservative bar that resembles something out of Cheers. Another was recently opened by two people who are your stereotypical Democratic activists. They even used to have dinner with Paul Wellstone on occasion. Anyway, business was good until they decided to ban all smoking in their establishment. After that, the only people that went there were my dad and local DFL meetings. In the end, they nearly went out of business and had to reinstate smoking. Lucky for them, they had a choice. The communists haven't totally infiltrated this county yet.

judges can choose to credit or not credit a particular source cited in the course of a given proceeding but they cannot "vacate" it. the judicial branch is co-equal with the executive branch which produced the report. the net effect of a particular judge choosing to not give credence to a particular report is felt only in that case which is before him and has no effect on the report itself. it would be helpful if you would give a link to where this judge opined on the report, so people could read it and decide for themselves.

IT IS FURTHER ORDERED AND ADJUDGED that Defendants' Cross Motion for Summary Judgment is denied [1261]. The court vacates Chapters 1-6 of and the Appendices to EPA's Respiratory Health Effects of Passive Smoking: Lung Cancer and other Disorders, EPA/600/6-90/006F (December 1992). To ripen its judgment for purposes of appellate review, pursuant to Federal Rule of Civil Procedure 54(b), the court finds there is no just reason for delaying entry of judgment.
