It is hard enough to obtain any conservative sympathy in the Northeast. So, when threads start getting goofy and wishing for another attack on NYC you begin to understand the enormous gulf that exists in points of view. If you were to interview one million people on the streets of NYC do you think you would find one person who would support another terrorist attack?

If this NSA database story is supposed to be the bombshell warning the American people that their government is stealthily laying siege to their constitutional rights and liberties, it is difficult to say whether the president’s critics have won or lost. They may have won in the sense that the masses are gullible and uneducated about what their rights are and therefore are likely to believe anything that “feels offensive” must violate their rights. I submit that even if we accept the allegations as true (and I do not know whether they are; thus far nobody knows for sure), the database does not contravene anyone’s civil rights.
I’ll admit, my heart started racing when I heard the NSA story. I was appalled, even frightened. Unfortunately for the Dems and the mainstream media, I was frightened enough to actually research the issue. What I found was legal authority that unanimously indicates the President’s program is consistent with our Fourth Amendment privacy interests. If it weren’t for my belief that questioning authority is the birthright of a free people, I would be ashamed for having doubted President Bush.
Again, I do not know whether the database story is true. I do know that so far, these are the allegations: NSA paid phone companies to turn over the phone records of all their customers. These records tell the government what phone numbers call what other phone numbers and how long each call lasts. Names and addresses are not part of the record but could easily be determined from the number. Let’s take these “facts” as true.
Rights are not something we have simply because someone asserts we have them. They have to come from somewhere. There is only one possible way that this database could violate our civil rights, and that is if the program contravened the United States Constitution. Civil rights are not freedoms we receive as a matter of legislative grace or whim; they are rights conferred on us by the Constitution, and the only provision of that document affecting individual rights that this program even arguably implicates is the Fourth Amendment, which protects the right of the people to be secure in their “persons, houses, papers, and effects, against unreasonable searches and seizures.” (“Effects” appears to mean stuff that belongs to you). Generally, where this security interest is implicated, the government must procure a warrant before they can conduct the search, so that a neutral magistrate can determine whether the search is reasonable and supported by probable cause.
Although the activist judges on our United States Supreme Court have decided that the drafters didn’t really mean to limit this privacy interest to “persons, houses, papers, and effects,” even they acknowledge that no Fourth Amendment interests are at stake unless the person has a “reasonable expectation of privacy” in the thing searched. The Supreme Court is the final arbiter of what the Constitution means, and the Court’s interpretation remains the law of the land unless and until overturned. Supreme Court case law is UNANIMOUS that very similar types of highly personal information are not protected by the Fourth Amendment.
In Smith v. Maryland, 442 U.S. 735 (1979), police acted without a warrant and applied a pen register, which records numbers dialed, to the defendant's home telephone line. They did so without a warrant. The U.S. Supreme Court rejected the notion that people have a reasonable expectation of privacy in the phone numbers they dial, stating, "This Court consistently has held that a person has no legitimate expectation of privacy in information he voluntarily turns over to third parties." The Court noted that people do give phone companies access to this information, for billing and a variety of other purposes. This case has NEVER been overruled. As such, it is binding precedent.
Some lawyers suggest this new program differs because the government also gets info. on the duration of the call and can figure out identity by looking through phone books and on-line services. I don’t buy this argument: Smith’s rationale was that phone companies already have access to the information the police sought. This reasoning was the same as the reasoning the court has given in a very similar situation: bank records. United States v. Payner and United States v. Miller, 425 U.S. 435 (1976) both recognized that bank records contain secret and highly personal information that customers expect banks not to divulge to outside parties. Despite this recognition, the Court decided in both cases that the police could obtain the defendants’ bank records—including deposit slips, cancelled checks, and FINANCIAL STATEMENTS, which by the way, usually have your name and address on them—without offending the Fourth Amendment. Miller said: “the depositor takes the risk, in revealing his affairs to another, that the information will be conveyed by that person to the Government.” It concluded that this was the case even if a person reveals information to a third party on the assumption that the third party will keep it confidential. The reason is simple: when you leave property in someone else’s hands, they, not you, have ultimate control over its dissemination, so it is not really private anymore. These cases also remain valid law.
None of the information NSA is gathering is any more personal than where you spend your money, when, and in what amounts, so even if you ignore that Smith is the Court’s final word, there is not much reason to think phone records are constitutionally protected.
As a side note, the Court has also ruled that once you abandon your garbage outside on the curb, the Fourth Amendment does not forbid the government to open up your trash and start digging around without a warrant. (I forget the case name, unfortunately). Talk about finding out some highly personal information! In fact, some people even throw away things like PHONE RECORDS. I guess one man’s trash could be NSA’s treasure, and without violating any Fourth Amendment rights.
Some academics have suggested that Smith is no longer good law because technology has changed and now the government is privy to more information than contemplated in Smith. One of these is Harvard professor Larry Tribe. (See www.law.harvard.edu website). Tribe’s op-ed is high on rhetoric and light on analysis. His position can basically be boiled down to a philosophy that permeates the majority of judicial activism. I’ll call it the “times is a-changin’” philosophy, which doesn’t sound like a legitimate legal doctrine because it isn’t. (As an aside, thank you, President Bush, for appointing two judges to the Court who have repudiated this sort of legal “analysis” in favor of intellectually honest interpretations of the Constitution). I find it interesting that technology allows liberals to invoke the “times is a-changin’” philosophy to expand the Fourth Amendment by fiat because of new technology but Bush can’t invoke an attack on American soil as an historic change that justifies returning to a narrower, more textually-based interpretation of the privacy interest in “persons, houses, papers, and effects” so as to allow the administration to conduct intelligence activities designed to protect us from terrorists. Not that he needs to so given the case law like Smith, Miller, and Payner, which were decided under the current “reasonable expectation of privacy” test. As usual, it seems that only self-proclaimed “progressives” can invoke the “times is a-changin’” philosophy. In any case, the Supreme Court is the final word, and until it overturns Smith, Miller, Payner, and their ilk, President Bush has every right to rely on settled constitutional law in setting his policies.
Some people wonder whether federal statutes like the Telecommunications Act and FISA can expand your constitutional “reasonable expectation of privacy.” I highly doubt it. Congress tried this with the First Amendment after the Supreme Court decided in Employment Division v. Smith. Employment Division said that a neutral, generally applicable law can be enforced against someone who has violated the law, even if they did so for religious reasons. Prior to Employment Division, the Court required the government to show that enforcement was narrowly tailored to a compelling state interest. Congress passed a law saying that attempted to resurrect the old constitutional test. The Court stated in City of Boerne v. Flores that Congress overstepped its constitutional authority in passing this law. If Congress can’t legislate changes in the First Amendment, it cannot do so in the Fourth. Thus, any “privacy interests” that federal statutes confer are statutory only and do not affect the extent of our constitutional expectation of privacy.
Whether the NSA program violates federal statutory law is another matter for a separate post, but rest assured that this program, if it exists at all, does not abridge our Fourth Amendment freedoms. Do not believe the lie that the Bush administration has turned against our civil rights.

"Unless we convince Americans that Democrats are strong on national security," he warns his party, "Democrats will continue to lose elections."

Helloooo? That the Democrats have to be spoon-fed what should be axiomatic post-9/11 is, in and of itself, incontrovertible proof that From's advice is insufficient to solve their problem.

From's failure to fully lay out the nature of the Democrats' problem is not surprising: he is the guy who helped seal his party's fate. It was his Democratic Leadership Council (DLC) that institutionalized the proximate cause of the problem, clintonism, and legitimized its two eponymic provincial operators on the national stage. The "Third Way" and "triangulation" don't come from the same Latin root for no reason.

That "convince" is From's operative word underscores the Democrats' dilemma. Nine-eleven was transformative. It is no longer sufficient merely to convince. One must demonstrate, demonstrate convincingly, if you will… which means both in real time and historically.

When it comes to national security, Americans will no longer take any chances. Turning the turn of phrase back on itself, the era of the Placebo President is over. (Incidentally, the oft-quote out-of-context sentence fragment alluded to here transformed meaningless clinton triangulation into a meaningful if deceptive soundbite.)

Although From is loath to admit it -- the terror in his eyes belies his facile solution -- the Democratic party's problem transcends its anti-war contingent.

With a philosophy that relinquishes our national sovereignty -- and relinquishes it reflexively… and to the UN no less -- the Democratic party is, by definition, the party of national insecurity.

With policy ruled by pathologic self-interest -- witness the "Lieberman Paradigm," Kerry's "regime change" bon mot (gone bad), Edwards' and the clintons' brazen echoes thereof (or, alternatively, Pelosi's less strident wartime non-putdown putdown)… and, of course, the clincher -- eight years of the clintons' infantilism, grotesquerie and utter failure -- the Democratic party is, historically and in real time, the party of national insecurity.

ASIDE: Wartime Bush-bashing sedition of the pre-Howard Dean, pre-Cindy Sheehan variety, with its sotto-voce old-school indirection, refinement and politesse, sounds almost quaint these days.

The Democrats used to be able to wallpaper their national insecurity with dollars and demogoguery. But that was before 9/11.

If we are to prevail, the rules of engagement--on both fronts--must change.

Marquis of Queensberry niceties, multicultural hypersensitivity, unipolar-power guilt, hegemony aversion (which is self-sabotage in the extreme--we must capture what we conquer--oil is the terrorist's lifeblood)... and, most important, the mutual-protection racket in Washington--pre-9/11 anachronisms all--are luxuries we can no longer afford.

Notwithstanding, the underlying premise of our hyperfastidious polity, (that we must remain in the system to save the system) is fallacious at best and tantamount to Lady Liberty lifting herself up by her own bootstraps.

To borrow from the Bard, let's start metaphorically, or better yet, economically and politically, by killing all the seditious solicitors, which include the clintons and their left-wing agitprop-and-money-laundering machine: the Viacom-Simon & Schuster-60-Minutes vertical operation, the horizontal (as in "soporific") Cronkite-ite news readers, the (hardly upright) Ben-Veniste goons and Gorelick sleepers, and, of course, the clueless, cacophonic, disproportionately loud, left-coast Barbra-Streisand contingent.

America must not pull her punches.

To prevail, America must defeat--thoroughly destroy--her enemies. On both fronts.
