Judge: 5-Foot-1 Child Molester Is Too Short for Prison

SIDNEY, Neb. -- A judge said a 5-foot-1 man convicted of sexually assaulting a child was too small to survive in prison, and gave him 10 years of probation instead.
His crimes deserved a long sentence, District Judge Kristine Cecava said, but she worried that Richard W. Thompson, 50, would be especially imperiled by prison dangers.
"You are a sex offender, and you did it to a child," she said.
But, she said, "That doesn't make you a hunter. You do not fit in that category."

If it were just limited to judges we would have a chance to fight them. This love affair with predators extends to the political level also. It is there that the rules for the application of justice are written. When they give judges too much leeway, we have atrocious decisions like this one.

I knew a guy who was only 4'10" and no one in their right mind would want to mess with him. Once he was in a bar and some big 6'5 280lb drunk redneck decided he wanted to use him for "dwarf tossing." It is there that the rules for the application of justice are written. When they give judges too much leeway, we have atrocious decisions like this one. Yeah, it's called "discretion" in legal terms and it's what judges love because it gives them more power. Judges don't typically have to be brilliant people. All they do, in theory, is look at behavior, reconcile that with existing laws, come to a determination of guilt if there's no jury, and then impose judgement.
It does require morality of a Judeo-Christian variety however, and that's what's sorely lacking in judgeships across our land, morality and integrity!

FYI I have seen many pedophiles tried and sentenced, and have seen psychological profiles introduced in court. It is very common for them to be short of stature. They are often child-like individuals, with deep feelings of inadaquacy. I'm not saying they are all short, but it seems they often are of small size, which contributes to their insecurity.
If you won't imprison short pedophiles, that will mean not imprisoning a lot of pedophiles.

Thompson will be electronically monitored the first four months of his probation, and he was told to never be alone with someone under age 18 or date or live with a woman whose children were under 18. Cecava also ordered Thompson to get rid of his pornography. He faces 30 days of jail each year of his probation unless he follows its conditions closely. Boy, she really threw the book at him.
"I want control of you until I know you have integrated change into your life," the judge told Thompson. "I truly hope that my bet on you being OK out in society is not misplaced."

District Judge Kristine Cecava of Cheyenne County on Tuesday sentenced Richard Thompson, 50, on two counts of sexually assaulting a minor. He given 10 years of probation by a judge who said the man was too small to survive prison.
On Thursday, Nebraska Attorney General Jon Bruning said hell appeal the decision.
Jon Bruning has proven time and again where children stand with him - they are a top priority. He has made some tough, yet warranted decisions regarding kids (Matthew Koso is one that comes to mind, not to mention Internet safety) and stands firm in his conviction to make sure kids are safe.
